Powell has been appointed to serve as the Chairman of the Summit and has extended an invitation to the Governor of Texas to lead a five-person delegation to the Summit; and WHEREAS, this administration has a sincere and firm commitment to the goals of providing children with access to the five fundamental resources that can help them lead healthy, fulfilling and productive lives: --an ongoing relationship with a caring adult- a mentor, tutor, coach; --safe places and structured activities during non-school hours to learn and grow; --a healthy start; --a marketable skill through effective education; --an opportunity to give back through community service NOW, THEREFORE, I, George W. As the pressing needs of the 75th Texas Legislature Session demand my presence in Austin, I hereby create a five person delegation to represent me and the State of Texas at the Presidents' Summit for America's Future. The delegation shall be led by First Lady Laura Bush and shall attend the Summit and report to me on the details of the goals of the Summit and recommend a course of action to implement those goals. The members of the delegation shall serve without salary or if state employees, without additional salary. The members of the delegation shall be reimbursed for their actual expenses in serving on the delegation. All agencies of the state are thereby directed to cooperate and assist the delegation in the performance of its duties. Bush, Governor of Texas TRD-9809578 Filed: June 15, 1998 THE STATE OF TEXAS EXECUTIVE DEPARTMENT OFFICE OF THE GOVERNOR-AUSTIN, TEXAS, EXECUTIVE ORDER GWB 97-20 RELATING TO THE CREATION OF THE GOVERNOR'S TASK FORCE ON ILLEGAL GAMBLING WHEREAS, Texas has a general public policy against gambling; WHEREAS, the citizens of Texas have approved of bingo, charitable raffles, pari- mutuel wagering, and the state lottery as the only exceptions to the State's general public policy against gambling; WHEREAS, the Governor has been advised by law enforcement officials that current state law does not make the prosecution of illegal gambling activities a priority; WHEREAS, the Governor believes that a systematic, state-wide evaluation of gambling in Texas is necessary; and WHEREAS, the Governor believes that it is appropriate to evaluate whether law enforcement officials have the necessary tools to enforce the State's public policy against gambling. NOW, THEREFORE, I, George W. Bush, Governor of the State of Texas, under the authority vested in me, do hereby create and establish the Governor's Task Force on Illegal Gambling, which shall serve in an advisory capacity to the Governor. This Task Force shall be composed of representatives from the Legislature, from the prosecutorial and law enforcement communities, from State agencies charged with the enforcement of gambling laws, and from the public. The Task Force shall accomplish the following objectives: (1) accumulate all available data on gambling in Texas, and analyze it to formulate an accurate picture of the current status and future growth of illegal gambling in this State; (2) solicit input from persons identified by the Task Force, who can provide relevant information on illegal gambling in Texas; (3) review all Texas laws that address gambling and suggest ways to enhance enforcement of those laws through legislative or administrative action; (4) devise proposed legislation that will amend chapter 47 of the Texas Penal Code and enhance enforcement of existing laws against the use of gambling devices; (5) suggest any other enhancements to the State's gambling laws that will advance Texas' general public policy against gambling; and (6) submit a written report to the Governor summarizing its' findings and recommendations on or before May 1, 1998. The Task Force shall have no final action authority and shall serve only in an advisory capacity. The Governor shall designate the Chair and vice Chair of the Task Force, who shall serve at the pleasure of the Governor. Members of the Task Force shall serve without salary or, if state employees, without additional salary. The members of the Task Force shall be reimbursed for their actual expenses incurred, pursuant to the limits allowed under the Texas General Appropriations Act of 1997, but shall not receive any monetary compensation or per diem for their work. The Task Force shall meet upon call of the Chair; and the first meeting shall occur as soon as practicable after the date upon which this Executive Order becomes effective. All agencies of the state are hereby directed to cooperate and assist the Task Force in the performance of its duties. Bush, Governor of the State of Texas, under the authority vested in me, do hereby extend the date for submitting a written report to the Governor summarizing its findings and recommendations from on or before May 1, 1998, to on or before September 30, 1998. Bush, Governor of the State of Texas, under the authority vested in me, do hereby order that the Governor's Commission for Women, hereafter referred to as the Commission, is continued without interruption. The Commission will consist of no more than twenty-four (24) members appointed by the Governor for a two-year term. Members shall serve at the pleasure of the Governor. The Governor shall designate a Chair and Vice- Chair from the membership who shall hold such designations at the pleasure of the Governor. The Governor shall appoint an executive director who shall assist the Commission as it adopts rules and procedures and develops and implements activities consistent with the provisions of this executive order. The Commission shall have as its principal charge the achievement of the following: (a) Aid the Governor in finding and recommending qualified women for appointive office; (b) Identify, assess, and develop strategies, including community outreach activities, public-private partnerships, and coordination of community and state resources, to improve the status of women in Texas; (c) Hold workshops around the state to identify the needs and concerns of women and to recommend assistance and services in those areas; (d) Participate with established task forces and policy groups on issues affecting women; (e) Monitor federal and state legislation relating to issues affecting women; (f) Establish a State Agency Council to assist the Commission in fulfilling its charge; and (g) Support and promote volunteer efforts in Texas. The Commission shall make a biennial written report of its findings, activities, and recommendations to the Governor. The Commission shall meet quarterly or at the call of the Chair. A majority of the membership shall constitute a quorum for the purpose of conducting the business of the Commission. The members of the Commission shall serve without salary. All agencies of state and local governments are hereby directed to cooperate and assist the Commission in the performance of duties. Bush, Governor of Texas TRD-9809578 Filed: June 15, 1998 THE STATE OF TEXAS EXECUTIVE DEPARTMENT OFFICE OF THE GOVERNOR-AUSTIN, TEXAS, EXECUTIVE ORDER GWB 95-1B RELATING TO EMERGENCY MANAGEMENT WHEREAS, the Legislature of the State of Texas has heretofore enacted the Texas Disaster Act of 1975, Chapter 418 et seq. of Texas Government Code to: (1) Reduce vulnerability of people and communities of this state to damage, injury, and loss of life and property resulting from natural or man-made catastrophes, riots, or hostile military or paramilitary actions; (2) Prepare for prompt and efficient rescue, care and treatment of persons victimized or threatened by disaster; (3) Provide a setting conducive to the rapid and orderly restoration and rehabilitation of persons affected by disaster; (4) Clarify and strengthen the roles of the Governor, state agencies, and local governments in the prevention of, preparation for, response to, and recovery from disasters; (5) Authorize the provide for cooperation and coordination of activities relating to hazard mitigation, emergency preparedness, incident response, and disaster recovery by agencies and officers of this state, and similar state- local, interstate, federal-state and foreign activities in which the state and its political subdivisions may participate; (6) Provide a comprehensive emergency management system for Texas that is a coordinated effort to make the best possible use of existing organizations and resources within government and industry, and which includes provisions for actions to be taken at all levels of government before, during, and after the onset of an emergency situation; (7) Assist in the prevention of disasters caused or aggravated by inadequate planning for and regulation of public and private facilities and land use; and (8) Provide the authority and mechanism to respond to an energy emergency; and WHEREAS, under Section 418.013, Texas Disaster Act of 1975, Texas Government Code, the Governor is expressly authorized to establish by executive order an EMERGENCY MANAGEMENT COUNCIL composed of the heads of state agencies, boards, and commissions and representatives or organized volunteer groups to advise and assist the Governor in all matters relating to disaster mitigation, preparedness, response, and recovery; and, WHEREAS, FURTHER UNDER Section 418.041, Texas Disaster Act of 1975, Texas Government Code, a DIVISION OF EMERGENCY MANAGEMENT is established in the Office of the Governor and the Director of the DIVISION OF EMERGENCY MANAGEMENT is to be appointed by and serve at the pleasure of the Governor; and WHEREAS, with the aid and assistance of the EMERGENCY MANAGEMENT COUNCIL and DIVISION OF EMERGENCY MANAGEMENT, the Governor may recommend that cities, counties, and other political subdivisions of the state undertake appropriate emergency management programs and assist and cooperate with those developed at the state level; NOW, THEREFORE, I, George W. Bush, Governor of the State of Texas, under the authority vested in me, do hereby create and establish the EMERGENCY MANAGEMENT COUNCIL, to he composed of the Chief Executive Officers of the following state agencies, boards, commission, and organized volunteer groups: Adjutant General's Department, American Red Cross, Department of Information Resources, General Land Office *, General Services Commission, Governor's Division of Emergency Management *, Public Utility Commission of Texas, Railroad Commission of Texas *, State Aircraft Pooling Board, State Auditor's Office, State Comptroller of Public Accounts, Texas Attorney General's Office, Texas Commission on Fire Protection *, Texas Department of Agriculture *, Texas Department of Economic Development, Texas Department of Criminal Justice, Texas Department of Health *, Texas Department of Housing and Community Affairs, Texas Department of Human Services, Texas Department of Insurance, Texas Department of Mental Health and Mental Retardation, Texas Department of Public Safety *, Texas Department of Transportation *, Texas Education Agency, Texas Workforce Commission, Texas Engineering Extension Service *, Texas Forest Service, Texas Natural Resource Conservation Commission *, Texas Parks and Wildlife Department *, Texas Rehabilitation Commission, The Salvation Army. The specific duties and responsibilities of each member of this group shall be as designated in the State Emergency Management Plan and Annexes thereto. Each member of the group may designate a staff member representative to the COUNCIL. I further hereby designate the Director of the Texas Department of Public Safety to serve as Chairperson of the COUNCIL and as Director of the DIVISION OF EMERGENCY MANAGEMENT of the Governor's Office. The DIVISION OF EMERGENCY MANAGEMENT shall be my designated agency to exercise the powers granted to me under the Texas Disaster Act of 1975 in the administration and supervision of the Act, including but not limited to, the power to accept from the federal government, or any public or private agency or individual, any offer of services, equipment, supplies, materials, or funds as gifts, grants, or loans for the purpose of emergency services or disaster recovery, and may dispense such gifts, grants, or loans for the purposes for which they are made without further authorization other than as contained herein. The Director shall establish emergency operations areas to be known as Disaster Districts which shall correspond to the boundaries of the Texas Highway Patrol Districts and Sub-Districts and shall establish in each a Disaster District Committee composed of representatives of the state agencies, boards, commission, and organized volunteer groups having membership on the COUNCIL. The Highway Patrol Commanding Officer of each Highway Patrol District or Sub-District shall serve as Chairperson of the Disaster District Committee and report to the Director on matters relating to disasters and emergencies. The Chairperson shall be assisted by the COUNCIL representatives assigned to that DISTRICT, who shall provide guidance, counsel and administrative support as may be required. The COUNCIL is hereby authorized to issue such directives as my be necessary to effectuate the purpose of the Texas Disaster act of 1975, and is further authorized and empowered to exercise the specific powers enumerated in the Act. To carry out certain state emergency planning, community right-to-know, and response functions relating to hazardous materials, a standing element of the Emergency Management Council, designated the STATE EMERGENCY RESPONSE COMMISSION, will be composed of representatives named by the chief executive officers of the agencies and commissions marked with an asterisk(*) in the listing of the Emergency Management Council above. The State Coordinator shall chair the State Emergency Response Commission or designate a chairperson. Further, in accordance with Sections 418.102, 418.103, and 418.105 Texas Disaster Act of 1975, Texas Government Code, and published rules of the DIVISION OF EMERGENCY MANAGEMENT, I hereby designate the Mayor of each municipal corporation and the County Judge of each county in the state as the Emergency Management Director for each such political subdivision. The County Judge and Mayor shall serve as the Governor's designated agents in administration and supervision of the Texas Disaster Act of 1975, and may exercise the powers, on an appropriate local scale, granted the Governor therein. The Mayor and County Judge may each designate an Emergency Management Coordinator who shall serve as assistant to the presiding officer of the political subdivision for emergency management purposes when so designated. By the authority vested in me under Section 418.104, Texas Disaster Act of 1975, Texas Government Code, I further hereby authorize each political subdivision of the state to establish in the county in which they are sited, inter- jurisdictional agencies by intergovernmental agreement, supported as needed by local City Ordinance of Commissioner's Court Order, in cooperation and coordination with the DIVISION OF EMERGENCY MANAGEMENT of the Governor's Office. In compliance with Section 418.010, Texas Government Code, the presiding officer of each political subdivision shall promptly notify the DIVISION OF EMERGENCY MANAGEMENT of the manner in which it is providing or securing an emergency management program and the person designated to head that program.
