Agency Rule Review Plans Texas Commission for the Blind Title 40, Part IV Filed: May 29, 1998 Texas Cancer Council Title 25, Part XI Filed: June 1, 1998 Texas Commission on Human Rights Title 40, Part XI Filed: June 3, 1998 Proposed Rule Reviews Texas Cancer Council Title 25 Part XI Notice of Intent to Review In accordance with the Appropriations Act of 1997, House Bill 1, Article IX, sec.167, the Texas Cancer Council will review its rules in their entirety for re-adoption, repeal or amendment beginning immediately. The rules to be reviewed are located at Title 25, Texas Administrative Code, and include: Chapter 701, Policies and Procedures; Chapter 702, Relationship Between Council and Private Organizations and Donors; and Chapter 703, Project Contracts and Grants. The Texas Cancer Council will consider comments received in response to this notice at its next meeting following the publication of this notice. The meeting is tentatively scheduled for August 1998. Changes to the rules proposed by the Council after considering comments received in response to this notice will appear in the "Rules Proposed" section of the Texas Register and will be adopted in accordance with the requirements of the Administrative Procedure Act, Texas Government Code Annotated, Chapter 2001. Executive Director Texas Cancer Council Filed: June 1, 1998 Public Utility Commission of Texas Title 16 Part II The Public Utility Commission of Texas files this notice of intention to review sec.23.48 relating to Continuity of Service pursuant to the Appropriations Act of 1997, House Bill 1, Article IX, sec.167 (Section 167). Project Number 19198 has been assigned to the review of this rule section. As part of this review process, the commission is proposing the repeal of sec.23.48 and is proposing new sec.25.52 of this title (relating to Continuity of Service) for electric service providers under Project Number 19198; and new sec.26.51 of this title (relating to Continuity of Service) for telecommunications service providers under Project Number 19199 to replace sec.23.48. The proposed repeal and new rules may be found in the Proposed Rules section of the Texas Register. As required by sec.167, the commission will accept comments regarding whether the reason for adopting the rule continues to exist in the comments filed on the proposed new sections. TRD-9808650 Rhonda Dempsey Rules Coordinator Public Utility Commission of Texas Filed: May 27, 1998 Adopted Rule Reviews Public Utility Commission of Texas Title 16 Part II The Public Utility Commission of Texas (commission) has completed the review of sec.22.21 relating to Meetings; and sec.22.22 relating to Service on the Commission as noticed in the March 20, 1998 Texas Register (23 TexReg 3049). The commission readopts these sections, pursuant to the requirements of the Appropriations Act of 1997, House Bill 1, Article IX, sec.167 (Section 167) and finds that the reason for adopting these rules continues to exist. Project Number 17709 is assigned to this proceeding. The commission received no comments on the sec.167 requirement as to whether the reason for adopting the rules continues to exist. As part of this review process, the commission proposed an amendment to sec.22.22 as published in the Texas Register on March 20, 1998 (23 TexReg 2930). The commission received no comments on the proposed amendment. These rules are adopted under the Public Utility Regulatory Act, Texas Utilities Code Annotated sec.14.002 and sec.14.052 (Vernon 1998) which provides the commission with the authority to make and enforce rules reasonably required in the exercise of its powers and jurisdiction, including rules of practice and procedure. TRD-9808700 Rhonda Dempsey Rules Coordinator Public Utility Commission of Texas Filed: May 29, 1998 Texas Rehabilitation Commission Title 40 Part II The Texas Rehabilitation Commission adopts for review the following sections from Chapters 101, 102, 104, 106, 108, 110, 115, 116, and 117, pursuant to the Appropriations Act of 1997, House Bill 1, Article IX, sec.167. As part of the review process, the Texas Rehabilitation Commission amended sec.sec.101.4, 106.36, and 115.2 and published them in the May 1, 1998, issue of the Texas Register (23 TexReg 4328). Section 106.36 is being adopted with changes to the proposed text and is being published in the adopted section of this issue of the Texas Register. The commission is also adopting for review the following sections without changes: sec.sec.101.3, 101.5, 101.14-101.22, 102.1-102.5, 104.1-104.4, 104.6-104.8, 106.35, 106.37, 108.1-108.7, 110.1, 110.2, 116.4, and 117.1-117.5. No comments were received on these sections during the proposed review. The Commission's reason for adopting these sections continues to exist.
