An agreement for reasonable access may provide for, among other things, reasonable compensation for access to the property. The IOP, and this reference to reasonable compensation, is not intended to address such issues as permanent damages including damages due to remaining contamination after remediation, damages incurred due to deed notice or recordation, or any other damage caused by the contamination. To be eligible for certification as an innocent owner/operator, a person must apply to the agency. If the agency determines that the person is an innocent owner/operator, the agency will issue a certificate acknowledging such. The certificate evidences the person's immunity from liability under the Texas Water Code and the Health & Safety Code for investigation, monitoring, remediation, or corrective or other response action regarding the contamination from the off- site source. To qualify for funding: 1) each apprenticeship training program or new occupation within a program must be certified and registered by the Bureau of Apprenticeship and Training (BAT), U.S. Department of Labor, no later than August 1, 1998; 2) each apprenticeship training program must be sponsored by a public school district or a public postsecondary institution under a contract between the district or institution and an apprenticeship committee; 3) each apprentice must be registered with the BAT in Texas on or before September 1, 1998; 4) each apprentice must be a full-time paid employee in the private sector in Texas; 5) the number of related instruction hours per class must be certified by the BAT as verified in the program standards of the apprenticeship program; and 6) the class must start in September 1998 and conduct its fourth class meeting no later than October 3, 1998. Dates of Program. Each class may not start before September 1, 1998, and must end on or before August 31, 1999. Planning Allocation of Funds. The statewide total number of estimated contact hours that are submitted to the Texas Workforce Commission will be divided into the amount of funds available to determine a preliminary contact-hour rate, not to exceed $3.50 per contact hour. The Seventy-fifth Texas Legislature has mandated the Texas Veterans Commission complete this study.
