Proposed Settlement: The proposed settlement will resolve VPG's liability for damaging the Sayle Creek resource, as follows: Injunctive Relief: The proposed settlement, requires VPG to construct a Restoration Project composed of not less than 11.2 acres of freshwater wetlands and 4.5 acres of riparian habitat. The Restoration Project will be located adjacent to an existing waterway and connected to the waterway in such a manner that the waterway periodically supplies water to the constructed wetlands and at such time provides for the opportunity for ingress and egress of aquatic organisms. However, the Restoration Project site shall not be adjacent to or connected directly to Sayle Creek. The wetlands component of the project shall be comprised of a complex of interconnected open water and vegetated marsh areas. The wetlands shall be composed of multiple (greater than three) permanently flooded open water ponds adding up to a total of 2-3 acres, with the remainder of the area being made up of depressional wetlands and shelves that are connected via multiple channels to the open water ponds. Wetland areas shall be planted with multiple species of high, emergent and floating wetland vegetation indigenous to or compatible with the local area. The required riparian areas shall be interspersed around and throughout the wetlands in a logical pattern that maximizes the opportunity for wildlife access and cover. Riparian vegetation shall be composed of a variety of ground cover, mid-story and over-story species indigenous to or compatible with the local area that provide beneficial services for wildlife and shall include hardwood tree species. VPG shall pay all costs associated with site acquisition and the design, planning, construction, maintenance, and monitoring of the Restoration Project, up to $800,000. The main scrap facility is on 18 acres. The main scrap facility tract is roughly rectangular and consists of six abandoned buildings and two stockpiles of soil. The remainder of the property is undeveloped. A remedial investigation was initiated and completed in October 1996. The results of the investigation and laboratory analyses show that the primary soil contaminants at the Houston Scrap site are metals associated with battery recycling. The metals contamination is generally confined to the upper six inches of soil. The highest lead concentrations were in the battery recycling buildings. However, due to the temporary storage of batteries and processed battery casing mounds around the site, elevated levels of metals are found throughout the site. Other contaminants found in ground-water samples were lead, antimony, arsenic, barium, beryllium, cadmium, chromium, and nickel. These exceeded the Maximum Contaminant Levels in at least one monitor well. The TNRCC is proposing the on-site containment of contaminated soil and materials at the Houston Scrap State Superfund site. The soil will be excavated and consolidated on-site to reduce the surface area of the containment cell. The soil containment area will be designed to minimize leaching of the soil contaminants to the ground water and will be covered by a cap that will eliminate surface exposure. An industrial tank farm is located approximately 1/4 mile southwest of the site. The Houston Scrap, North Cavalcade and South Cavalcade Superfund sites are located within one mile northwest of the site. A remedial investigation was completed in August 1996. The results of the investigation and laboratory analyses show that the primary soil contaminants at the Jensen Drive Scrap site are lead, arsenic and polychlorinated biphenyls (PCBs) associated with transformer reclamation. The lead, arsenic and PCB contamination is generally confined to the upper three to four feet of soil. The highest lead and arsenic concentrations were located north of the existing building in the southwest corner of the site. The highest PCB level in the soil was located in the central portion on the site near the previous location of the metal crusher. Initial groundwater sampling results in 1996 indicated detectable concentrations of lead and PCBs in only two wells at the site. Lead was detected at 0.2 mg/l in both MW-5 and MW-6 and PCBs were detected at .00082 mg/l in MW-4 and .003 in MW- 2. The second sampling event in 1997 indicated no detectable concentrations of lead or PCB's in any of the monitor wells at the site. Arsenic was not detected in either of the groundwater sampling events.
