Proposed sec.701.51 provides "A user who is not capable of producing more than 25,000 gallons of underground water a day from a well or well unit shall not be required to apply for an initial regular permit." This proposed rule purports to expand the statutory small well exemption to apply to any well regardless of the particular use of the water. Under the Edwards Aquifer Authority Act, Chapter 626, 73rd Legislature, Regular Session (1993), as amended (the "Act"), the Edwards Aquifer Authority is statutorily charged with the task of reviewing applications and issuing permits for the withdrawal of water from the Edwards Aquifer. Each existing user is required to file Declarations of Historic Use on or before December 30, 1996, in order to preserve such user's right to withdraw water from the aquifer after that date. The Authority has proposed a set of regulations governing the administrative and technical review, hearings and final decisions on applications for initial regular permits. Those rules were published in (21 TexReg 11071), November 12, 1996. The public comment period ends on December 12, 1996. One of the provisions of these proposed rules, 701.51, purports to expand the small well exemption beyond the express exemption provided for in the Act at sec.1.16(c). Proposed rule sec.701.51 provides that any small well, regardless of use, that is not capable of producing in excess of 25,000 gallons a day is not required to seek an initial regular permit for the Authority. Section 1.16(c) of the Act provides that "An owner of a well from which the water will be used exclusively for domestic use or watering livestock and that is exempt under Section 1.33 of this article is not required to file a declaration of historical use." Proposed rule sec.701.51 purports to expand this exemption to any small well regardless of the use of water. The Board of the Authority has reconsidered expanding this exemption even though several public policy reasons support allowing the expansion, including, the administrative costs to review and issue such permits relative to a small use of water and a similar exemption in Chapter 36, Texas Water Code. On the advice of counsel, the Board will not adopt proposed sec.701.51. Publication of the proposed rule without any further action by the Board may misinform a small well owner that he does not need to file a declaration of historic use, thereby jeopardizing his future right to pump. Accordingly, the Board directed the publication of this notice. This serves as a notice to all users of the Edwards Aquifer that the Board intends to withdraw proposed sec.701.51 before final adoption. A timely filed withdrawal of proposed sec.701.51 will be filed with the Texas Register after the close of the public comment period on December 12, 996. Because that date, December 12, 1996, is so close in time to the date that Declarations for Historic Use must be filed, December 30, 1996, the Board has determined that it is in the public interest to provide early notice to the public of its intent to withdraw sec.701.51. Contract Number 05- 745P5002: Professional engineering services to develop the plans, specifications and estimates (PS&E) for the East-West Freeway in Lubbock, Texas. The project involves converting an 8.75 mile length of U.S. 82, a four to six-lane arterial street to a four-lane controlled access freeway facility with continuous frontage roads. The project begins at the west city limits of Lubbock and proceeds northeast and east to I.H. 27 in east central Lubbock.
