Texas Department of Agriculture Boll Weevil Eradication Penalty Guideline The Texas Agriculture Code (the Code) at Chapter 74, Subchapter D, (Vernon, 1995, as amended by Senate Bill 1196, 74th Legislature, 1995) provides for the establishment of the Texas Boll Weevil Eradication Foundation (the foundation) as a vehicle for developing and implementing programs for the suppression and eradication of the boll weevil and pink bollworm in Texas. The foundation is charged with the establishment of eradication zones and assessments by referenda of eligible cotton growers. The Code, sec.74.118, provides the department with the authority to establish rules relating to the prohibition of planting of cotton in an eradication zone and participation in an eradication program established by the foundation and to set penalties to be assessed against cotton growers in an established boll weevil eradication zone who have failed to comply with department rules. Those rules are found at Title 4, Texas Administrative Code, sec.sec.3.50-3.57. The department has developed the following penalty guideline to ensure that the department's administrative enforcement actions are fair, consistent, and appropriate. The following penalty guideline supersedes the penalty matrix published in the October 24, 1995, issue of the Texas Register (20 TexReg 8841). The penalty matrix was modified to provide for greater deterrence, a more timely resolution of the penalty assessments, and to reduce the resources needed to implement the penalty scheme. This penalty guideline is effective for non-payment of cotton assessments assessed after January 1, 1996. Penalty Guideline A producer shall owe a penalty in the amount of 50% of the unpaid foundation assessment if the assessment amount if received by the foundation on or within 14 days of the issuance of a notification letter by the department. A producer shall owe a penalty in the amount of 100% of the unpaid foundation assessment if the assessment amount is received by the foundation after 14 days of the issuance of a notification letter by the department. This project will NOT involve creating a Metropolitan Transportation Plan. The SETRPC-MPO is the Metropolitan Planning Organization for the JOHRTS area and is responsible for regional transportation planning efforts and ensuring that the region is in compliance with federal transportation planning mandates. The Metropolitan Transportation Plan is the document that guides long-range transportation planning in the three county region (Jefferson, Orange, and Hardin Counties). The work to be performed will involve assistance with creation of the text for various elements (chapters) of the JOHRTS MTP. Several elements/chapters currently exist; these may require some restructuring to integrate them into the finished product.
