Restrictions On Use of Funds: This project will be funded with oil overcharge monies, specifically State Energy Conservation Program/Exxon monies, which have been approved for this purpose by the Department of Energy. Oil Overcharge funds are monetary settlements returned to the states as a result of litigation by the U.S. Department of Energy against certain oil companies for alleged violations of price controls in effect between 1973 and 1981. The courts returned these funds to the states for use in energy programs deemed to provide restitution to citizens aggrieved by the overcharges. Funds are subject to program guidelines of the DOE State Energy Conservation Plan (SECP) and the U.S. v. Exxon court decision and may be used to pay for indirect or administrative costs. These funds may be used to supplement existing programs, but may not supplant funds already allocated to the program. This Consultant Proposal Request is funded with 100% of oil overcharge Exxon and 0% Non-oil overcharge funding authorized through the DOE to the State Energy Conservation Office. The Lavaca-Navidad River Authority owns a 42.67% interest in the certificate, as amended, and the Texas Water Development Board owns the remaining 57.33% interest. Of the above authorizations, the following all have a time priority of May 15, 1972: 1) to impound water in the reservoir, (2) to divert and use 17,826 acre-feet of water per annum from the lake for municipal purposes, and (3) to divert and use 57,174 acre-feet of water per annum from the lake for industrial purposes. The balance of water diversions authorized have a time priority of May 24, 1982, and are as follows: (1) to divert and use 952 acre-feet of water per annum from the lake for municipal purposes, and (2) to divert and use not to exceed 3,048 acre-feet of water per annum from the lake for industrial purposes. The commission will defer the approval of the designation of water quality protection zones for contiguous tracts containing less than 1,000 acres but not less than 500 acres until adoption of final rules. This guidance applies only to those areas in which one or more water quality protection zones may be designated within the extraterritorial jurisdiction, outside the corporate limits of a municipality with a population greater than 5,000, and in which the municipality either: has enacted or attempted to enforce three or more ordinances or amendments thereto attempting to regulate water quality or control or abate water pollution in the area within the five years preceding June 17, 1995, whether or not such ordinances or amendments were legally effective upon the area; or enacts or attempts to enforce three or more ordinances or amendments thereto attempting to regulate water quality or control or abate water pollution in the area in any five-year period, whether or not such ordinances or amendments are legally effective upon the area. This guidance does not apply to an area within the extraterritorial jurisdiction of a municipality with a population greater than 900,000 that has extended to the extraterritorial jurisdiction of the municipality an ordinance whose purpose is to prevent the pollution of an aquifer which is the sole or principal drinking water source for the municipality. The public hearing is to receive comments from interested parties concerning new Commission rules sec.801.2 and sec.801.3, proposed under the Labor Code, Texas Civil Statutes, sec.302.063, as amended by Chapter 655, Acts of the 74th Legislature, 1995, which directs the Commission to develop objective criteria for the granting of waivers under the Government Code, Texas Civil Statutes, sec.sec.2308.264, 2308.267, and 2308.312; and under the Labor Code, Texas Civil Statutes, sec.302.041 and sec.302.042, as amended by Chapter 655, Acts of the 74th Legislature, 1995, which direct the Commission to design and implement a state-local planning process for workforce training and services, to review local plans and to make recommendations to the Texas Council on Workforce and Economic Competitiveness regarding plan implementation. Any interested person may appear and offer comments or statements, either orally or in writing. While any person with pertinent comments or statements will be granted an opportunity to present them during the course of the hearing, the Commission reserves the right to restrict statements in terms of time or repetitive content.
