Lower Colorado River Authority, Application Number 4428A to amend Water Use Permit Number 4137 pursuant to Texas Water Code, sec.11.122, and Texas Natural Resource Conservation Commission Rules 30 TAC sec.sec.295.1 et seq, Permit Number 4137 authorizes: (1) Construction and maintenance of a dam and exempt reservoir on an unnamed tributary of Big Sandy Creek, tributary of the Colorado River, Colorado River Basin, and impoundment therein of not to exceed 19 acre- feet of water. The project is located in Bastrop County approximately six miles north of Bastrop, Texas; (2) Diversion and use of not to exceed 34. 45 acre-feet of water per annum from the reservoir for mining purposes; (3) Diversion and use of the same 30 acre-feet per annum for irrigation of 46 acres in Bastrop County; (4) A maximum diversion rate of 1.34 cfs (600 gpm) from the perimeter of the reservoir; (5) That the permit shall expire upon cessation of mining & reclamation operations or upon termination of leases (with Steiner and Evans), whichever shall occur first; (6) That the permit shall expire on December 31, 1994, unless permittee applies for an extension and such application is granted for an additional term or in perpetuity. Applicant is requesting amendment to Permit Number 4137 to extend the term of the permit for an additional ten years and to reduce the amount of authorized use to ten acre-feet per annum, for irrigation purposes only. No other changes are requested. The water would be used for industrial purposes (fire suppression and control and for tank cleaning) at the applicant's chemical processing plant, located approximately 11 miles east of Houston, Texas. Applicant has indicated that none of the diverted water would be consumed. James Brockriede; Application Number 5393A to amend Water Rights Permit Number 5393 pursuant to Texas Water Code, sec.11.122, and Texas Natural Resource Conservation Commission Rules 30 TAC sec.sec.295.1 et seq, Permit Number 5393 authorizes: (1) impoundment of ten acre-feet of water on Beaver Creek, tributary of the Wichita River, tributary of the Red River, Red River Basin, and (2) diversion from reservoir of 300 acre-feet of water per annum. Diverted water is authorized to be used for irrigation of 300 acres of land in Wichita and Wilbarger Counties, approximately 25 miles west of Wichita Falls, Texas. Diversion of water under this permit is restricted to only those times when the gaged flow of Beaver Creek equals or exceeds 3.6 cfs at the USGS Gaging Station Number 07312200 near Electra and approximately one mile downstream of the aforesaid reservoir at the FM 2326 bridge. Applicant is presently seeking to divert an additional 150 acre-feet of water per annum from the aforesaid reservoir to irrigate an additional 150 acres of land and to increase the authorized diversion rate of the permit from 750 gpm to 1,250 gpm (an addition of 500 gpm). LCRA is also authorized to divert and use not to exceed 15 acre-feet of water per annum from the impoundment for mining (dust control) purposes at the Powell Bend Mine. Permit Number 4138 will expire and become null and void on December 31, 1994. Time priority of the owner's right is January 17, 1984.
