EMERGENCY RULES An agency may adopt a new or amended section or repeal an existing section on an emergency basis if it determines that such action is necessary for the public health, safety, or welfare of this state. The section may become effective immediately upon filing with the Texas Register, or on a stated date less than 20 days after filing and remaining in effect no more than 120 days. Physician Assistants 22 TAC sec.185.7 The Texas State Board of Medical Examiners adopts on an emergency basis an amendment to sec.185.7, concerning physician assistants. The proposed amendment will allow the executive director to issue a limited temporary license to a physician assistant whose file is substantially complete. The rule is adopted on an emergency basis to possibly place health care providers more quickly in underserved areas. The amendment is adopted on an emergency basis under Texas Civil Statutes, Article 4495b, which provide the Texas State Board of Medical Examiners with the authority to make rules, regulations and bylaws not inconsistent with this act as may be necessary for the governing of its own proceedings, the performance of its duties, the regulation of the practice of medicine in this state, and the enforcement of this act. Article 4495b-1 is affected by this amendment. sec.185.7. Temporary License. (a)-(b) (No change.) (c) The council may issue a limited temporary license during the period January 15, 1995 to March 1, 1995 to an applicant who: (1) has submitted for licensure which includes verification of the education requirements for license or certificate from NCCPA, has submitted a photograph, a fingerprint card, and the application questionnaire which, in the opinion of the executive director of the board, is substantially complete; and (2) requests the issuance of a limited temporary license on a form prescribed by the council and pays the appropriate fee prescribed by the council. (d) A limited temporary license shall expire on either June 16, 1995, upon the issuance of a permanent license, or upon the initial determination by the Licensure Committee of the Council that the applicant is ineligible for license, whichever event occurs first. General Provisions Introductory Provisions 31 TAC sec.363.3 The Texas Water Development Board (board) adopts on an emergency basis amendment to 31 TAC sec.363.3, conerning adoption of memorandum of understanding by reference. The amendment to sec.363.3 will provide for a first amendment to the memorandum of understanding which is adopted by reference. This amendment is adopted on an emergency basis to provide immediate release of approximately one-half of the state's $2 million commitment in order to avoid delays in construction of a wastewater treatment plant that will treat a major discharge of sewage that currently flows into the Rio Grande, threatening the public health and safety. Imminent peril to the public health requires adoption of this amendment on fewer than 30 days notice. The amendment is adopted on an emergency basis under Texas Water Code, sec.6.101, which requires the board to adopt rules to carry out the powers and duties of the board, under the Texas Water Code, and other laws of this state, this amendment on fewer than 30 days notice. sec.363.3. Adoption of Memorandum of Understanding by Reference. A memorandum of understanding between the board and the United States Section of the International Boundary and Water Commission and a first amendment to the memorandum of understanding

This memorandum of understanding concerns the application process for funds made available from the Water Loan Assistance Program to the United States Section of the International Boundary and Water Commission by the Texas Water Development Board for the purpose of participating in the joint construction of a wastewater treatment project to improve the quality of the water being discharged into the Rio Grande.
