Restrictions on the Use of Funds. This program is funded with oil overcharge funds appropriated to the Governor's Energy Office by the 71st Texas Legislature. Oil Overcharge funds are monetary settlements returned to the states as a result of litigation by the U.S. Department of Energy (DOE) against certain oil companies for violations of price controls in effect between 1973 and 1981. The courts returned these funds to the states for use in certain energy programs deemed to provide restitution to citizens aggrieved by the overcharges. Funds are subject to program guidelines of the DOE State Energy Conservation Plan (SECP) and the U.S. v. Exxon court decision, and may not be used to pay indirect or administrative costs. References from past or present clients, particularly those which involved similar projects, may be included; however, the proposer should limit the number of references to not more than five. Preferred proposers will have extensive knowledge of residential recycling methods, commercial and institutional recycling and waste reduction techniques, backyard and centralized composting methodology, and options for waste oil collection. A listing, by name in the proposal, of those individuals or employees that will work on the proposed project, highlighting their particular training and experience (as it may relate to these specific items) is required.
