37 TAC §§3.7 - 3.9
The Texas Department of Public Safety adopts the
repeal of §§3.7 - 3.9, concerning Crash Investigations,
without changes to the proposed text as published in the April 17,
2009, issue of the Texas Register (34 TexReg 2451).
Adoption of repeal of the sections is necessary due to the transfer
of the powers and duties for crash reports from the Texas Department
of Public Safety to the Texas Department of Transportation.
No comments were received regarding adoption of the repeals.
The repeals are adopted pursuant to Texas Government
Code, §411.004(3), which authorizes the Public Safety Commission
to adopt rules considered necessary for carrying out the department's
work; and Senate Bill 766, Acts 2007, 80th Legislature, Regular Session.
This agency hereby certifies that the adoption has been
reviewed by legal counsel and found to be a valid exercise of the
agency's legal authority.
