Subchapter I. MEMORANDUM OF UNDERSTANDING

The Office of the Governor, Criminal Justice Division (CJD), proposes an amendment to §3.9300, concerning CJD and the Department of Public Safety (DPS). The section contains the Memorandum of Understanding (MOU) pertaining to the coordination of drug law enforcement efforts between CJD and DPS. The proposed amendment to the MOU makes explicit the current law enforcement strategy jointly employed by the two.

Ken Nicolas, Executive Director of CJD, has determined that for the first five-year period the amendment is in effect there will be no fiscal implications for state or local government as a result of enforcing or administering the amended section.

Mr. Nicolas has also determined that for each year of the first five years the amendment is in effect the public benefit anticipated as a result of enforcing the amended section will be a clear statement of the joint law enforcement strategy employed by CJD and DPS. There will not be an effect on small businesses. There is no anticipated economic cost to persons who are required to comply with the proposed amendment.

The amendment is proposed under the Texas Government Code, §411.0096, which requires CJD and DPS to enter into a MOU.

The proposed amendment implements the Texas Government Code, §411.0096.

§3.9300.Texas Department of Public Safety.

Pursuant to §411.0096 of the Texas Government Code, CJD and the Texas Department of Public Safety have entered into a memorandum of understanding pertaining to the coordination of drug law enforcement efforts. This memorandum of understanding may be amended, as necessary, by subsequent written agreement adopted by rule. The current memorandum of understanding is listed in the following:

This agency hereby certifies that the proposal has been reviewed by legal counsel and found to be within the agency's legal authority to adopt.
