Railroad Commission of Texas
Title 16, Part 1
The Railroad Commission of Texas (Commission) files this notice of its
readoption of 16 TAC Chapter 9, relating to LP-Gas Safety Rules, in accordance
with Texas Government Code, §2001.039. The Commission's reasons for adopting
these rules continue to exist; however, in a separate pending rulemaking,
the Commission has proposed some amendments to §9.9, relating to Requirements
for Certificate Renewal, and §9.51, relating to General Requirements
for Training and Continuing Education. The Commission proposed the amendments
to §9.9 and §9.51 to improve the efficiency and to recover the cost
of administering LP-gas examinations, examination renewals, and training requirements
for persons who handle LP-gas in the course of their employment with a state
agency, county, municipality, school district, or other governmental subdivision
and who elect to become Railroad Commission certified to perform LP-gas activities
even though currently they are not required to do so. That proposal is still
pending.
The notice of intent to review the rules in Chapter 9 was published in
the November 18, 2005, issue of the
Texas Register
(30 TexReg 7747); the Commission received no comments. This concludes
the review of all rules in Chapter 9.
