republished. The repeal is adopted for cleanup and clarification as a result
of the four-year rule review requirement of Texas Government Code, §2001.039.
The board adopts the repeal of §§373.1 - 373.14, 373.16 - 373.30
and 373.32 - 373.44. The Construction Grants Program has expended all the
funds provided for it and all projects receiving funding from the program
have been closed out. In addition, there is no evidence that funding for this
program will be revived by the federal government.
No comments were received on the proposed repeal.
The repeal is adopted under the authority of the Texas Water
Code, §6.101 which provides the Texas Water Development Board with the
authority to adopt rules necessary to carry out the powers and duties in the
Texas Water Code and other laws of the State.
The statutory provision affected by the repeal is Texas Water Code, §16.093.
This agency hereby certifies that the adoption has been reviewed
by legal counsel and found to be a valid exercise of the agency's legal authority.
