37 TAC §297.11
The Commission on Jail Standards adopts amendments to §297.11
concerning Compliance and Enforcement that addresses responsibility for payment
if the commission is found justified in their actions in regards to the issuance
of a remedial order and subsequent appeal requests, without changes to the
text as published in the December 24, 2004, issue of the
Texas Register
(29 TexReg 11944).
The adopted rule will specifically address which entity is responsible
for payment in contested cases.
No comments were received regarding the proposed amendment.
The amendment is adopted under Government Code, Chapter 511,
which provides the Texas Commission on Jail Standards with the authority to
adopt reasonable rules and procedures establishing minimum standards for the
custody, care and treatment of prisoners.
The statutes that are affected by this rule are Local Government Code,
Chapter 351, §351.002 and §351.015.
This agency hereby certifies that the adoption has been reviewed
by legal counsel and found to be a valid exercise of the agency's legal authority.
