The Texas State Soil and Water Conservation Board (State Board) adopts new 31 TAC §518.5 concerning the Historically Underutilized Business (HUB) Certification Program. Adoption is without change from the proposed text as published in the December 17, 2004 issue of the Texas Register (29 TexReg 11561). The text of the rule will not be republished.

This new rule adopts by reference the rules of the Texas Building and Procurement Commission in 1 TAC §§111.11-111.28, as amended, and is adopted to guide this agency in the implementation of a HUB program.

No comments were received regarding the adoption of this rule.

The new rule is adopted under §201.020, Agriculture Code, which authorizes the State Board to adopt rules that are necessary for the performance of its functions under the Agriculture Code.

This agency hereby certifies that the adoption has been reviewed by legal counsel and found to be a valid exercise of the agency's legal authority.
