Chapter 31. AGENCY PROCEDURES

The Texas Commission on the Arts adopts the repeal and replacement of §31.10, concerning Financial Assistance Application Form, without changes to the proposed text as published in the January 23, 2004, issue of the Texas Register (29 TexReg 583) and will not be republished.

Elsewhere in this issue of the Texas Register , the Texas Commission on the Arts contemporaneously withdraws the repeal and replacement of §31.10 which was adopted on an emergency basis. The withdrawal becomes effective on March 25, 2004.

The purpose of the repeal and replacement is to be consistent with changes to programs and services of the commission as outlined in the Texas Arts Plan as amended December 2003.

No comments were received regarding adoption of the rule.

The repeal is adopted under the Government Code, §444.009, which provides the Texas Commission on the Arts with the authority to make rules and regulations for its government and that of its officers and committees.

This agency hereby certifies that the adoption has been reviewed by legal counsel and found to be a valid exercise of the agency's legal authority.
