Texas Commission for the Blind

Rule Transfer

Through the enactment of House Bill 2292, the Governor and the Legislature have directed Texas health and human services agencies to consolidate organizational structures and functions, eliminate duplicative administrative systems, and streamline processes and procedures that guide the delivery of health and human services to Texans.

House Bill 2292, 73rd Legislative Session, 2003, abolished the Texas Rehabilitation Commission, the Texas Commission for the Blind, the Texas Commission for the Deaf and Hard of Hearing, and the Interagency Council on Early Childhood Intervention and transferred their respective powers, duties, functions, programs, and activities to the new Department of Assistive and Rehabilitative Services. The Texas Register is renumbering the rules of the Texas Commission for the Blind (Title 40, Part 4) and reorganizing them under the Texas Administrative Code, Title 40, Part 2, Chapters 101 and 106.

The transfer took effect March 1, 2004.

Texas Commission for the Deaf and Hard of Hearing

Rule Transfer

The transfer took effect March 1, 2004.

Interagency Council on Early Childhood Intervention

Texas Department of Health

Rule Transfer

As the sole state agency responsible for administering the Texas Medical Assistance (Medicaid) program, Texas Health and Human Services Commission (HHSC) transferred operation of the Medical Transportation Program from the Texas Department of Health to HHSC (42 U.S.C. §1396a; 42 C.F.R. §431.10 (2003); and Texas Government Code, §531.021(a) and §531.0055(b). See Senate Bill 509, 74th Legislature (1995).) House Bill 2292, 78th Legislature, 2003, §1.03 and §1.18(a)(3) and (4), also mandates the transfer.

To reflect the transfer of program responsibility, the Texas Register is renumbering and moving the rules under Texas Administrative Code, Title 25, Part 1, Chapter 40 to Title 1, Part 15, Chapter 380.
