Chapter 302. FEES

10 TAC §302.1

The Texas Residential Construction Commission (commission) adopts new §302.1, relating to Adoption of Fees, without changes to the proposed text as published in the January 9, 2004, issue of the Texas Register (29 TexReg 270).

The rule implements new legislation enacted during the 78th Legislative, Regular Session, specifically House Bill 730, which created the commission and which authorized the commission to adopt and collect fees as reasonable and necessary to cover the administrative costs of implementing Title 16, Property Code.

The commission received no comments on the new rule.

The new rule is adopted under Property Code §408.001, which provides general authority for the commission to adopt rules necessary for the implementation of Title 16, Property Code, and under the specific authority provided in Property Code §408.002, which provides in part that the commission may adopt reasonable fees to administer Title 16, Property Code.
