19 TAC §61.1001
The Texas Education Agency (TEA) adopts an amendment to §61.1001,
concerning management of assets, liabilities, and records of former county
education districts, without changes to the proposed text as published in
the December 27, 2002, issue of the
Texas Register
(27 TexReg 12152) and will not be republished. The section establishes
a distribution scheme to fulfill the legislative mandate to distribute county
education district funds in an orderly fashion to achieve specific priorities.
The adopted amendment qualifies reference to a former statute.
The adopted amendment to 19 TAC §61.1001 adds language in subsection
(a)(2) to qualify that Texas Education Code (TEC), §16.501, is referenced
as it existed on May 1, 1993. A technical edit is adopted in subsection (k)
to correct a reference from subsection (b)(3) to subsection (a)(3) of the
section.
No comments were received regarding adoption of the amendment.
The amendment is adopted under Senate Bill 7, §4.15, 73rd
Texas Legislature, 1993, which authorizes the commissioner to adopt rules
necessary to distribute county education district funds.
This agency hereby certifies that the adoption has been reviewed
by legal counsel and found to be a valid exercise of the agency's legal authority.
