Executive Order RP 24
Relating to the creation of the a study committee
to advise the Texas Commission on Environmental Quality on issues related
to the regulation and permitting of rock crushers and quarries.
WHEREAS the Texas Clean Air Act is intended to safeguard the state's air
quality from pollution by controlling or abating air pollution and emissions
of air contaminants consistent with the protection of public health, general
welfare and physical property, including the aesthetic enjoyment of clean
air by the public and the maintenance of adequate visibility; and
WHEREAS the Texas Commission on Environmental Quality is charged with implementing
and enforcing the provisions of the Texas Clean Air Act; and
WHEREAS the provisions of the Texas Clean Air Act limit the authority of
the Texas Commission on Environmental Quality in its review of emissions of
air contaminants from rock crushers; and
WHEREAS these limitations may not allow the Texas Commission on Environmental
Quality to adequately address the concerns of all citizens regarding the construction
and operation of rock crushers, including rock crushers operating in association
with quarries; and
WHEREAS it is in the interest of all citizens of this state that the Texas
Commission on Environmental Quality be authorized to consider an appropriate
range of issues concerning authorizations for rock crushers, including rock
crushers operating in association with quarries;
NOW, THEREFORE, I, Rick Perry, Governor of the State of Texas, by virtue
of the power and authority vested in me by the Constitution and laws of the
State of Texas, do hereby order the following:
1. Creation. A joint committee to conduct a study on the authority of the
Texas Commission on Environmental Quality to consider all appropriate issues
in permitting and regulating rock crushers, including rock crushers operating
in association with quarries, is hereby created.
2. Composition. The joint committee shall consist of members appointed
by the governor. The committee shall be made up of three members of the senate,
three members of the house, and three members of the public. The governor
may designate a member to serve as chair of the committee.
3. Support. The Texas Commission on Environmental Quality shall provide
staff support for the study.
4. Report. The committee shall submit a full report, including findings
and recommendations, to the Governor and the members of the 79th Texas Legislature
no later than December 31, 2004.
This executive order supersedes all previous orders and shall remain in
effect and in full force until modified, amended, rescinded, or superseded
by me or by a succeeding Governor.

TO ALL TO WHOM THESE PRESENTS SHALL COME:
WHEREAS, the State of Texas has benefited greatly from the scientific and
technical achievement of retired Air Force Brigadier General Charles E. "Chuck"
Yeager, who received his basic training at Ellington Field near Houston and
later served as an instructor pilot at Perrin Field near Denison; and
WHEREAS, General Yeager was instrumental in shaping the future of space
flight not only as the first person to break the sound barrier, but also as
the commandant of the Aerospace Research Pilot School, training military astronauts
for the American space exploration program that contributed to the development
of the high-tech infrastructure of Texas at NASA and the Johnson Space Flight
Center; and
WHEREAS, as an active outdoorsman, General Yeager has set a high mark for
resource and habitat conservation, both as an avid outdoorsman and hunter
and as a board member of the National Fish and Wildlife Foundation, which
named a prestigious award in his honor to recognize individuals for superior
on-the-ground resource conservation;
NOW, THEREFORE, I, RICK PERRY, GOVERNOR OF TEXAS, under the authority vested
in me by the Constitution and Statutes of the State of Texas, do hereby declare
Retired Air Force Brigadier General Charles E. "Chuck" Yeager to be an honorary
citizen of Texas and further declare him eligible to obtain a lifetime resident
hunting license issued by the Texas Parks and Wildlife Department.
IN TESTIMONY WHEREOF, I have hereunto signed my name and have officially
caused the Seal of State to be affixed at my Office in the City of Austin,
