22 TAC §651.1
The Executive Council of Physical Therapy and Occupational
Therapy Examiners proposes an amendment to §651.1, concerning Fees. This
section is being amended to raise the fee for applications and renewals in
compliance with House Bill 2985, and add a new fee for ACH return fee.
John P. Maline, Executive Director of the Executive Council of Physical
Therapy and Occupational Therapy Examiners, has determined that for the first
five-year period the amendment is in effect there will be fiscal implications
for state or local government as a result of enforcing or administering the
amendment.
Mr. Maline also has determined that for each year of the first five years
the amendment is in effect the public benefit anticipated as a result of enforcing
the amendment will be the creation of the Office of Patient Protection within
the Health Professions Council. There will be a small effect on small businesses.
There are fee changes from $2 to $5 of anticipated economic costs to persons
who are required to comply with the amendment as proposed.

The amendment is proposed under the Executive Council of Physical
Therapy and Occupational Therapy Act, Title 23, Subchapter H, Chapter 452,
Occupations Code, which provides the Executive Council of Physical Therapy
and Occupational Therapy Examiners with the authority to adopt rules consistent
with this Act to carry out its duties in administering this Act.
Title 3, Subtitle H, Chapter 452, Occupational Code is affected by this
amended section.
