37 TAC §23.61, §23.62

The Texas Department of Public Safety adopts amendments to §23.61, relating to Procedures for Certification, and a new §23.62, relating to Certification of External Inspector Training Schools without changes to the proposed text as published in the November 2, 2001, issue of the Texas Register (26 TexReg 8770) and will not republish them.

Section 23.62 is necessary to establish requirements for certification of external instruction facilities an instructors to offer training for applicants seeking to become state certified vehicle inspectors. Amendments to §23.61 were necessary to allow for implementation of the instructional facilities allowed in §23.62.

No comments were received regarding adoption of the amendment or new section.

The amendment and new section are adopted pursuant to Texas Government Code, §411.004(3), which authorizes the Public Safety Commission to adopt rules considered necessary for carrying out the department's work and Texas Transportation Code, §548.002 and §548.401.

Chapter 405. CHARGES FOR PUBLIC RECORDS

37 TAC §§405.1, 405.3, 405.5, 405.7, 405.9, 405.11, 405.15, 405.17

The Texas Commission on Fire Protection (TCFP) adopts amendments to §§405.1, 405.3, 405.5, 405.7, 405.9, 405.11, 405.15, and 405.17, concerning charges for public records, without changes to the text published in the September 14, 2001 issue of the Texas Register (26 TexReg 7073).

The amendments provide clearer and consistent agency-wide guidelines for providing access to and copies of public records.

The amendments update the language of the rules and the charges for providing public records to match the rules of the General Services Commission.

There were no comments received on the proposed amendments.

The amendments are adopted under Texas Government Code, §419.008, which provides the TCFP with authority to adopt rules for the administration of its powers and duties, and Texas Government Code, §552.262, which requires each state agency to specify by rule the charges the agency will make for copies of public records.

The Texas Commission on Fire Protection (TCFP) adopts the repeal of §405.13, Examples of Charges for Public Information, without changes to the text published in the September 14, 2001, issue of the Texas Register (26 TexReg 7077).

The repeal of §405.13 contributes toward clearer and more consistent agency wide guidelines for providing access to and charging for public records.

The repeal of §405.13 removes information which was a duplication of information found in §405.15 and §405.17.

There were no comments received on the proposed repeal.

The repeal is adopted under Texas Government Code, §419.008, which provides the TCFP with authority to adopt rules for the administration of its powers and duties, and Texas Government Code, §552.262, which requires each state agency to specify by rule the charges the agency will make for copies of public records.

Chapter 407. ADMINISTRATION

37 TAC §407.1

The Texas Commission on Fire Protection (TCFP) adopts amendments to §407.1, Inscription on Texas Commission on Fire Protection Vehicles, without changes to the text published in the September 14, 2001, issue of the Texas Register (26 TexReg 7077).

The amendments clarify that the State Fire Marshal's Office is no longer merged with the TCFP.

The amendments remove references to law enforcement and the state fire marshal.

The amendments are adopted under Texas Government Code, §419.008, which provides the TCFP with authority to adopt rules for the administration of its powers and duties, and Transportation Code, §721.003, Exemption From Inscription Requirement for Certain State-Owned Motor Vehicles

Chapter 453. MINIMUM STANDARDS FOR HAZARDOUS MATERIALS TECHNICIAN

The Texas Commission on Fire Protection (TCFP) adopts amendments to §453.3, Minimum Standards for Hazardous Materials Technician Certification, and §453.7, International Fire Service Accreditation Congress (IFSAC) Certification, without changes to the text published in the September 28, 2001, issue of the Texas Register (26 TexReg 7519). The amendments correct a typographical error and punctuation.

The amendments improve the readability of the TCFP's rules.
