The Texas Certified Self-Insurer Guaranty Association adopts the rules review and readopts Chapter 181, By-Laws, in accordance with the requirement of Texas Government Code, Section 2001.039, which requires state agencies to review and consider for readoption each of their rules every four years. The review must include an assessment of whether the reasons continue to exist. The proposed notice of intention to review was published in the August 31, 2001 issue of the Texas Register (26 TxReg) at page 6739.

No public comments were received. The necessity for the rules continue to exist.

Railroad Commission of Texas

Title 16, Part 1

The Railroad Commission of Texas has completed the review of 16 TAC §3.40, relating to Assignment of Acreage to Pooled Development and Proration Units, in accordance with the requirements of Texas Government Code §2001.039 ( as added by Acts 1999, 76th Leg., ch. 1499, §1.11(a) ). The proposed review was published in the October 5, 2001, issue of the Texas Register (26 TexReg 7899). In a separate concurrent proposal, the Commission also proposed amendments to §3.40. The Commission assessed whether the reasons for readopting §3.40, as amended, continue to exist. The Commission found that §3.40, as amended, continues to be needed for the purpose of avoiding the drilling of unnecessary wells, protecting correlative rights, or preventing waste.

The Commission received no comments on the proposed review and one comment on the proposed amendment of §3.40.

The Commission readopts §3.40, as amended, in accordance with Texas Government Code §2001.039 ( as added by Acts 1999, 76th Leg., ch. 1499, §1.11(a) ), and pursuant to Texas Natural Resources Code, §§81.051 and 81.052, which provide the Commission with jurisdiction over all persons owning or engaged in drilling or operating oil or gas wells in Texas and the authority to adopt all necessary rules for governing and regulating persons and their operations under the jurisdiction of the Commission; and Texas Natural Resources Code, Chapter 102, which gives the Commission the authority to establish pooled units for the purpose of avoiding the drilling of unnecessary wells, protecting correlative rights, or preventing waste.

The Railroad Commission of Texas (Commission) files this notice of completion of the review of §3.73, relating to Inscriptions on Railroad Commission of Texas Vehicles. The notice of intention to review was published in the November 9, 2001, issue of the Texas Register (26 TexReg 9231).

The review and consideration were conducted in accordance with Texas Government Code, §2001.039 ( as added by Acts 1999, 76th Leg., ch. 1499, §1.11(a) The Commission, in separate concurrent rulemakings, has repealed §3.73 and readopted its provisions in new §20.405 in order to move the rule text from Chapter 3, Oil and Gas Division, into Chapter 20, Subchapter D, relating to Vehicle Management. Other than the change in chapter and rule number, and correction of a statutory citation, there were no substantive changes to the current rule language adopted in new §20.405. The rule declares that Railroad Commission vehicles are exempt from the identification requirements imposed on agencies under Texas Transportation Code, §721.002, as permitted by Texas Transportation Code, §721.003(a)(8)

The Commission received no comments on the proposed review and repeal of §3.73.

The Railroad Commission of Texas files this notice of the completion of the review of 16 Texas Administrative Code, §20.1, relating to Protest/Dispute Resolution Procedures. The review and consideration were conducted in accordance with Texas Government Code §2001.039 ( as added by Acts 1999, 76th Leg., ch. 1499, §1.11(a) ). Notice of the intent to review was published in the November 9, 2001, issue of the Texas Register (26 TexReg 9232).

The Commission concurrently proposed the repeal of §20.1 and a new §20.1 in order to reorganize the rule, update statutory references, and clarify the Commission's procedures for these protests.

The Commission's reasons for adopting the rule continue to exist.

The Commission received no comments on the proposed review, repeal, and new §20.1.

CHAPTER 801. LOCAL WORKFORCE DEVELOPMENT BOARDS

The Texas Workforce Commission (Commission) adopts the review of Chapter 801 relating to Local Workforce Development Boards in accordance with Texas Government Code §2001.039. The proposed review was published in the October 26, 2001 issue of the Texas Register (26 TexReg 8552).

An assessment was made by the Commission as to whether the reasons for adopting or readopting the rules continue to exist. The rules reviewed were determined by the Commission to continue to be needed, reflective of current legal and policy considerations, and reflective of current procedures of the Commission.

No comments were received on the proposed review.

The rule review is adopted under Texas Labor Code §301.061 and §302.002, which provide the Texas Workforce Commission with the authority to adopt, amend, or repeal such rules as it deems necessary for the effective administration of Agency services and activities.

The rules affect Texas Labor Code, Titles 2 and 4 as well as Texas Government Code Chapter 2308.

CHAPTER 805. JOB TRAINING PARTNERSHIP ACT
