Chapter 523. AGRICULTURAL AND SILVICULTURAL WATER QUALITY MANAGEMENT

The Texas State Soil and Water Conservation Board (TSSWCB) adopts an amendment to 31 TAC §523.3, concerning water quality management plans, without changes, to the proposed text as published in the August 24, 2001, issue of the Texas Register (26 TexReg 6277) and will not be republished.

The adopted amendment implements Senate Bill 1339 of the 77th Legislature which requires owners or operators of poultry facilities to implement and maintain certified water quality management plans.

No comments were received regarding adoption of the amendment.

The amendment is adopted under Chapter 201.020 Agriculture Code which provides the Texas State Soil and Water Conservation Board with the authority to adopt rules as necessary for the performance of its functions under the Agriculture Code.

This agency hereby certifies that the adoption has been reviewed by legal counsel and found to be a valid exercise of the agency's legal authority.

31 TAC §525.9

The Texas State Soil and Water Conservation Board adopts new §525.9, defining guidelines for audit and financial reporting by Soil and Water Conservation Districts, without changes, as published in the October 5, 2001, issue of the Texas Register (26 TexReg 7812) and will not be republished.

The new §525.9 explains the compliance contingencies of audit and financial statement reporting to the Texas State Soil and Water Conservation Board by Soil and Water Conservation Districts.

No comments were received regarding adoption of the new rule.

The new rule is adopted under Chapter 201.020 Agriculture Code which provides the Texas State Soil and Water Conservation Board with the authority to adopt rules as necessary for the performance of its functions under the Agriculture Code.
