The Office of the Secretary of State, Elections Division, adopts new rule, §81.10, concerning the distribution of any surplus computer equipment to eligible counties in order to comply with §18.063 of the Texas Election Code. Section 81.10 is being adopted without changes to the proposed text published in the December 21, 2001, issue of the Texas Register (26 TexReg 10460) and will not be republished.

No comments were received concerning the rule.

The rule is adopted under Texas Election Code, Chapter 31, Subchapter A, §31.003, which authorizes the Office of the Secretary of State to promulgate rules to obtain uniformity in the interpretation and application of the Code, and Chapter 18, §18.063 of the Code, which requires the Secretary of State to give surplus computer equipment to certain counties for the purpose of improving voter registration technology and complying with §18.063 of the Texas Election Code.

Texas Election Code, Chapter 18, §18.063 is affected by this adopted rule.

This agency hereby certifies that the adoption has been reviewed by legal counsel and found to be a valid exercise of the agency's legal authority.
