The Texas Department of Housing and Community Affairs (Department) adopts new §1.6 without changes concerning the Department's Historically Underutilized Businesses (HUBs) policy and procedure to the proposed text as published in the November 17, 2000 issue of the Texas Register (25 TexReg 11354), therefore the section will not be republished. The section defines the Department's use of HUBs and the implementation of this policy through race, ethnic, and gender-neutral means. The purpose of this program is to promote full and equal business opportunities for all businesses in Department contracting in accordance with the goals specified in the State of Texas Disparity Study.

No comments were received on the proposed rule.

The new section is adopted under the Texas Government Code §2306.053, which provides the Texas Department of Housing and Community Affairs with the authority to promulgate rules consistent with the Code. No other code, article or statute is affected by the proposed action.

This agency hereby certifies that the adoption has been reviewed by legal counsel and found to be a valid exercise of the agency's legal authority.
