The Texas State Board of Plumbing Examiners adopts an amendment
to §361.29 providing for the meetings at which the election of Board
officers shall occur and the length of terms that each officer shall serve
and eliminating the requirement for the Board to meet in July and September
of each year, without changes to the proposed text as published in the April
27, 2001 issue of the
Texas Register
(26 TexReg
3121).
The following is a restatement of the rule's factual basis: The amendments
to §361.29 are proposed in conjunction with additional planned rule amendments
which will allow the Board the ability to reduce the number of its annual
Board meetings from six to four, and eliminate the requirement in this rule §361.29
that the Board meet in September of each year.
No comments were received regarding the proposed amendments.
This rule amendment is adopted under the authority of, and affects
Tex. Rev. Civ. Stat. Ann. art. 6243-101, §5(a), (Vernon Supp. 2001),
and the rule it amends. §5(a) of the Act authorizes, empowers and directs
the Board to prescribe, amend and enforce all rules and regulations necessary
to carry out the Act. No other statute, article, or code is affected by this
proposed rule change.

by legal counsel and found to be a valid exercise of the agency's legal authority.
