TEXAS STATE AFFORDABLE HOUSING CORPORATION MULTIFAMILY HOUSING REVENUE BONDS (WHAC ALLIANCE DEVELOPMENT) SERIES 2001

Notice is hereby given of a public hearing to be held by the Texas State Affordable Housing Corporation (the "Issuer") on May 3, 2001 at 11:30 a.m., at the Austin History Center, 810 Guadalupe St., Reception Room, Austin, Texas, 78701, with respect to an issue of multifamily housing revenue bonds (the "Bonds") to be issued by the Issuer in one or more series in the aggregate amount not to exceed $130,000,000, the proceeds of which will be loaned to WHAC Alliance LLC, an Internal Revenue Code Section 501(c)(3) corporation, to finance the acquisition and rehabilitation of ten separate multifamily housing projects (collectively, the "Projects") located in the cities of Amarillo, Austin, Corpus Christi, Houston, Lubbock, San Antonio, Temple, Texas. The public hearing, which is the subject of this notice, will concern the Lakeview Apartments containing 504 units, located at 2401 S. Lakeshore Blvd., Austin, Texas 78741. The Projects will be owned by WHAC Alliance LLC.

All interested parties are invited to attend such public hearing to express their views with respect to the Projects and the issuance of the Bonds. Texas Health and Safety Code Notice of Settlement of State Superfund Claim

Notice is hereby given by the State of Texas of the following proposed resolution of a claim for response costs under the State Superfund provisions of the Texas Health & Safety Code. The State of Texas, on behalf of the Texas Natural Resource Conservation Commission, has reached an agreement with Southern Pacific Transportation Company, St. Louis Southwestern Railway Company, Union Pacific Transportation Company, SP Environmental Systems, Inc., Industrial Compliance, Chickasha Cotton Oil Company, Tomen Corporation and Tomen America, Inc.(the "Settling Defendants") to resolve the Settling Defendants' liability to the State for natural resource damages and response costs incurred by the TNRCC arising from the release and threatened release of hazardous substances from the Hi-Yield State Superfund Site, Commerce, Texas. The Attorney General will consider any written comments received on the settlement within 30 days of the date of publication of this notice.

Case Title and Court: Southern Pacific Transportation Company v. Texas Water Commission, Travis County District Court, 167th Judicial District, No. 92-06288.

Under the proposed settlement, the State will receive $300,000 in past response costs related to the Hi-Yield State Superfund Site. The State was previously reimbursed $2,564,000 for past response costs by other Potentially Responsible Parties.

Public Comment: The Office of the Attorney General will receive comments relating to the proposed settlement for 30 days following publication of this Notice. Texas Water Code Settlement Notice

Notice is hereby given by the State of Texas of the following proposed resolution of an environmental enforcement lawsuit under the Texas Water Code. Before the State may settle a judicial enforcement action under the Water Code, the State shall permit the public to comment in writing on the proposed judgment. The Attorney General will consider any written comments and may withdraw or withhold consent to the proposed agreed judgment if the comments disclose facts or considerations that indicate that the consent is inappropriate, improper, inadequate, or inconsistent with the requirements of the Code.

Case Title and Court: Harris County, Texas, and the State of Texas v. Lincoln M. LaCour, Individually and d/b/a A&M Recycling, Adrian LaCour, and Paten Bell, Case No. 2000-57895, in the District Court of Harris County, Texas, 133rd Judicial District

Nature of Defendants' Operations: Defendant, Lincoln M. LaCour, operates an unpermitted municipal solid waste facility located at 9009 East Mt. Houston Road, in Harris County. In this suit Harris County and the State, as a necessary and indispensable party, contend that Defendant Lincoln LaCour was in violation of the Texas Solid Waste Disposal Act and rules of the Texas Natural Resource Conservation Commission ("TNRCC") regarding the unlawful storage, processing or disposing of municipal solid waste.

Proposed Agreed Judgment: The judgment permanently enjoins Defendant Lincoln LaCour from causing, suffering, allowing, or permitting any activity of storage, processing, or disposal of any municipal solid waste at the site unless he has obtained authorization from the TNRCC. The judgment further provides for specific actions Defendant Lincoln LaCour is to take with regard to certain materials already at the site. The judgment provides for $15,000.00 in penalties and $2,000.00 in attorney's fees.

Notice and Opportunity to Comment on Requests for Consistency Agreement/Concurrence Under the Texas Coastal Management Program

On January 10, 1997, the State of Texas received federal approval of the Coastal Management Program (CMP) (62 Federal Register pp. 1439-1440). Under federal law, federal agency activities and actions affecting the Texas coastal zone must be consistent with the CMP goals and policies identified in 31 TAC Chapter 501. As required by federal law, the public is given an opportunity to comment on the consistency of proposed activities in the coastal zone undertaken or authorized by federal agencies. Pursuant to 31 TAC §§506.25, 506.32, and 506.41, the public comment period for these activities extends 30 days from the date published on the Coastal Coordination Council web site. Requests for federal consistency review were received for the following projects(s) during the period of March 9, 2001, through March 29, 2001. The public comment period for these projects will close at 5:00 p.m. on April 30, 2001.

Applicant: Sabco Operating Company; Location: The project site is located in Corpus Christi Bay, Nueces County, Texas. The site location can be found on the U.S.G.S. quadrangle map entitled Portland, Texas. Approximate UTM Coordinates: Zone 14; Easting: 661,708; Northing: 3,075,220. CCC Project No.: 01-0099-F1; Description of Proposed Action: The applicant proposes to drill an oil well and install pipelines under the recently advertised Oil Field Development Permit 22174. The applicant proposes to drill Well #7 in State Tract 53 and install three pipelines from Well #7 to a production platform in State Tract 49. Brown Partnership; Location: The project site is located approximately 500 feet north of Star Bayou in wetlands adjacent to the Neches River at the East Beaumont Townsite Tract 3 in Orange County, Texas. The project can be located on the U.S.G.S. quadrangle map entitled: Beaumont East, Texas. Approximate UTM Coordinates: Zone 15; Easting: 400000; Northing: 3327800. CCC Project No.: 01-0103-F1; Description of Proposed Action: The applicant proposes to expand an existing 200-foot by 200-foot well pad to 240-foot by 350-foot Well Site 14-A. Approximately 4,889 cubic yards of clean fill will be imported for the pad and to create the perimeter levee. The fill will impact approximately 1 acre of emergent marsh. Type of Application: This application is being evaluated under Section 10 of the Rivers and Harbors Act of 1899 and Section 404 of the Clean Water Act.

Applicant: Louie's Backyard Restaurant, Inc.; Location: The project is located at 2305 Laguna Boulevard, South Padre Island, in Cameron County, Texas, on the Thompkins Channel of the Laguna Madre. The project site can be located on the U.S.G.S. quadrangle map entitled Port Isabel, Texas. Approximate UTM Coordinates: Zone 14; Easting: 683140; Northing: 2887980. CCC Project No.: 01-0104-F1; Description of Proposed Action: The applicant proposes to amend Department of the Army (DOA) permit 17416 to add a two-story, 60 foot long by 35 foot wide wood deck adjacent to an existing wood deck to increase dining space for a restaurant. Type of Application: This application is being evaluated under Section 10 of the Rivers and Harbors Act of 1899.

Applicant: City of La Porte; Location: The project site is located on the south side of the mouth of Little Cedar Bayou and Galveston Bay. The project can be accessed by Broadway at Little Cedar Bayou Park, approximately 0.5 miles downstream of the park entrance. The project can be located on the U.S.G.S. quadrangle map entitled LaPorte, Texas. Approximate UTM Coordinates: Zone 15; Easting: 305000; Northing: 3280800. CCC Project No.: 01-0105-F1; Description of Proposed Action: The Little Cedar Bayou Shoreline Stabilization Project includes the construction of four wave barrier/groins, approximately 318 feet in total length, to protect the eroding southern shoreline of Little Cedar Bayou. The southeastern shoreline located outside of the last groin and the northern shoreline will be stabilized with concrete rip-rap. The groins will vary in length from 32.7 feet to 111.3 feet. Type of Application: This application is being evaluated under Section 10 of the Rivers and Harbors Act of 1899 and Section 404 of the Clean Water Act.

Applicant: The Nature Conservancy of Texas; Location: The project site is located in Moses Lake adjacent to the Nature Conservancy's Texas City Prairie Preserve property, approximately 3,900 feet northeast of the Highway 146 bridge over Moses Bayou in Texas City, Galveston County, Texas. The project can be located on the U.S.G.S. quadrangle map entitled Texas City, Texas. Approximate UTM Coordinates: Zone 15; Easting: 311189; Northing: 3257028. CCC Project No.: 01-0106-F1; Description of Proposed Action: The applicant proposes to create a 3,782-foot berm to protect the existing marsh along the north shoreline of Moses Lake from wave action. The berm will be constructed using dredged material obtained from the dredging of an adjacent barge access channel. The barge channel will be approximately 40 feet wide, 4,322 feet long, and 2.5 feet deep. The 16,640 cubic yards of dredged material will be utilized to create an approximately 36-foot-wide, (with a 7-foot crest) marsh berm. Type of Application: This application is being evaluated under Section 10 of the Rivers and Harbors Act of 1899 and Section 404 of the Clean Water Act.

Applicant: Edridge Construction; Location: The project site is located on the Sabine Pass Ship Channel at 5121 South First Avenue, at Station 210+00, in Jefferson County, Texas. The project can be located on the U.S.G.S. quadrangle map entitled: Sabine Pass, Texas. Approximate UTM Coordinates: Zone 15; Easting: 413532; Northing: 3290153. CCC Project No.: 01-0107-F1; Description of Proposed Action: The applicant proposes to expand its existing offshore rig refurbishing facility by constructing a dredge disposal site and additional buildings, and by dredging an access canal from the Sabine River. The proposed project will fill approximately 9.0 acres of wetlands to expand the facility for the dredged material disposal proposal area, buildings, parking area, and a storage area. A channel located south of the project area will be dredged to 125 feet long and 125 feet wide. Type of Application: This application is being evaluated under Section 10 of the Rivers and Harbors Act of 1899 and Section 404 of the Clean Water Act.

Pursuant to §306(d)(14) of the Coastal Zone Management Act of 1972 (16 U.S.C.A. §§1451-1464), as amended, interested parties are invited to submit comments on whether a proposed action is or is not consistent with the Texas Coastal Management Program goals and policies and whether the action should be referred to the Coastal Coordination Council for review.

Revised Notice of Intent to Amend Consultant Contract

Notice of Amendment: Pursuant to Chapter 2254, Chapter B, and §403.020, Texas Government Code, the Comptroller of Public Accounts (Comptroller) announces this notice of intention to amend and increase an existing consulting contract.

The Comptroller issued its Request for Proposals (RFP) from qualified, independent firms to provide consulting services to Comptroller to assist Comptroller in conducting management and performance reviews of the San Angelo, Christoval, Grape Creek, Veribest, Wall and Water Valley Independent School Districts (Districts). The RFP was issued on January 5, 2001. The notice of request for proposals (RFP #118a) was published in the January 5, 2001 issue of the Texas Register at (26 Tex Reg 902). The Notice of Award was published in the Friday, March 16, 2001 issue of the Texas Register at (26 Tex Reg 2224).

The contract was awarded to: Gibson Consulting Group, Inc., P.O. Box 163356, Austin, Texas 78716-3356. The total amount of the original contract is not to exceed $399,100.00. The total amount of the amended contract, with the increase of $14,850.00, is $413,950.00. The project will culminate in final reports due no later than August 31, 2001.

The term of the amended contract will remain March 5, 2001 through August 31, 2001.

Planning Forum and Public Hearing

The Health and Human Services Commission (HHSC), in collaboration with the Health and Human Services agencies and the Brazos Valley Council of Governments, will conduct one of a series of statewide public hearings to receive public comment on the development of the Health and Human Services Coordinated Strategic Plan and to fulfill statutory local planning requirements. The public hearing is required under §531.022(d)(4), Government Code, and §531.036, Government Code, and is intended to produce the following outcomes: (1) Increase local involvement and participation in the planning process. (2) Provide feedback to local communities on statewide and regional progress made on health and human services goals and strategic priorities since the community forums in 1999. (3) Solicit input from the communities on the effectiveness of current health and human services efforts. (4) Update regional demographic information and needs profiles. (5) Assess local capacity to address the strategic priorities. (6) Foster grass roots support for/build community coalitions to improve health and human service delivery in the area.

HHSC will conduct a planning forum immediately preceding each public hearing. The planning forum is intended to provide the opportunity for public input and participation. Agency clients and consumers of health and human services, advocates, consumer advisors, local state agency representatives, local governmental and non-governmental representatives, service providers and other interested parties are encouraged to participate.

The planning forum will be held on May 15, 2001, from 9:30 a.m. to 3:30 p.m., Central Time, at the Brazos Center, 3232 Briarcrest Drive, Bryan, Texas. The morning session will provide state and regional progress reports, needs assessments and demographic information.

The afternoon session will provide break-out group activities for members of the community to discuss specific strategic priorities that significantly impact the Bryan area, such as children's medical and insurance needs, assistance for working families, juvenile delinquency, long-term care, and specialized needs of infants, children and senior citizens.

A public hearing to receive public comment will begin at 2:45 p.m. Testimony and comments should focus on regional needs and suggestions for the most effective ways to deliver and coordinate services funded by the state. The Texas Department of Housing and Community Affairs (Department) did not include the Homebuyer Assistance Program in the application procedures and final filing section of the March 30, 2001 Texas Register issue, page 2560. Applications for the Homebuyer Assistance Program are currently available on the Department's website www.tdhca.state.tx.us . You may also call (512) 475-3109 to request an application on or after April 30,2001.

Hand delivered Homebuyer Assistance Program applications must be received by 5:00 p.m. on June 11, 2001. Mailed Homebuyer Assistance Program applications must be postmarked no later than June 11, 2001 and received at the HOME Program office within three (3) calendar days of the June 11, 2001 deadline. Applications will not be accepted by facsimile. Applicants must remit a non-refundable application fee at the time of submission in the amount of $30.00 per application to the Texas Department of Housing and Community Affairs. Announcement of Available Funds and Request for Proposals

Summary: The Texas Department of Human Services (DHS) announces the availability of funding for Targeted Assistance formula grant funds from the federal Office of Refugee Resettlement (ORR) in the Department of Health and Human Services. Targeted Assistance grants are designated for use in Dallas, Tarrant, and Harris Counties because of the large number of refugee arrivals in those counties. The amount of allocation for each area is $1,396,186 for Dallas and Tarrant counties, and $1,026,839 for Harris County. Consortium or collaborative arrangements are also welcome.

Legal Authorization: The Refugee Act of 1980, as amended (Public Law 96-212) and Title 45 of the Code of Federal Regulations (CFR) parts 400 and 401, give the State the authority to contract with public and private agencies for the provision of Targeted Assistance services. In Texas, DHS is the single state agency responsible for the administration of Targeted Assistance funds.

Funds will be awarded on a competitive basis to public and private agencies that can demonstrate the greatest aptitude for effectively providing the requested services to the target population in response to the Request For Proposals (RFP). The target population consists of persons admitted to the United States as "refugees" under Section 207 of the Immigration and Nationality Act (INA) or granted asylum under Section 208 of the INA. Eligibility also includes Cubans and Haitians under Section 501 of the Refugee Education Assistance Act of 1980 (P.L. 96-422); Kurdish asylees under 8 CFR 274.12(a)(5) and 8 CFR 272.12(c0(11); and certain Amerasians from Vietnam who were admitted to the U.S. as immigrants under Section 584 of the Foreign Operations, Export Financing, and Related Appropriations Act of 1988. Eligible persons must possess original Immigration and Naturalization Services (INS) documents that verify admission status under one of the above laws. Services are restricted to persons who have lived in the United States for five years or less.

Public Notice

The Texas Natural Resource Conservation Commission (TNRCC or commission) is required under the Texas Solid Waste Disposal Act, Texas Health and Safety Code, Chapter 361, as amended (the Act), to annually publish a state registry that identifies facilities that may constitute an imminent and substantial endangerment to public health and safety or the environment due to a release or threatened release of hazardous substances into the environment. The most recent registry listing of these facilities was published in the November 24, 2000 issue of the Texas Register (25 TexReg 11756).

Pursuant to §361.184(a), the commission must publish in the Texas Register and in a newspaper of general circulation in the county in which the facility is located a notice of intent to list a facility on the state registry of state Superfund sites. With this publication, the TNRCC hereby gives notice of a facility or area that the executive director determined eligible for listing, and which the executive director proposes to list on the state registry. This publication also specifies the general nature of the potential endangerment to public health and safety or the environment as determined by information currently available to the executive director. Additionally, this publication gives notice of the commission's intent to perform a removal at the facility. The removal can be completed without extensive investigation and planning and will achieve a significant cost reduction for the site. This notice concerning the facility was also published on Wednesday, April 25, 2001, in the Pearland Journal and Pearland Reporter News .

The facility proposed for listing is the Harkey Road Site, located at 17111 Harkey Road in an unincorporated section of Brazoria County approximately two miles south of the City of Pearland, Texas. The geographic coordinates of the site are 29 degrees, 31 minutes, 20.45 seconds North Latitude and 95 degrees, 18 minutes, 48.74 seconds West Longitude. The site, approximately 2/3 acre in size, is currently abandoned and fenced with posted warning signs. The fenced area consists of Lots #4 and #5 in Hasting Acres. The site was formerly owned by the late George Hastings and Nola Hastings. The description of the site is based on information available at the time the site was evaluated with the Hazard Ranking System (HRS). The HRS is the principal screening guide used by the TNRCC to evaluate potential, relative risk to public health and the environment from releases or threatened releases of hazardous substances. The description may change as additional information is gathered on the sources and extent of contamination.

The TNRCC has recently conducted a site investigation to gather information for the evaluation of the site by the HRS. Soil samples were collected from within the fenced area, the Right-of-Way and from some of the neighboring properties. Two soil samples were collected at each sampling location; an upper sample collected approximately six inches below the base of the source material, and a lower sample collected approximately 2.5 feet below the upper sample. Currently the allowable limit for lead concentration in a residential environment for soil (air/ingestion) is 500 mg/kg. Eleven soil samples from the site had concentration of total lead over 500 mg/kg, with the highest concentration being 2,800 mg/kg. Some portions of the neighboring properties were also found to be contaminated with lead. The source of lead contamination is believed to be buried lead-acid battery chips.

Three ground water samples were also collected on site in the shallow aquifer during the site investigation and were analyzed for total lead. The total lead concentrations in the ground water samples were found to be from 0.066 mg/l to 0.965 mg/l. The drinking water standard limits the Maximum Concentration Level (MCL) of lead in water to be 0.015 mg/l. However, samples of ground water in the deeper aquifer collected from a domestic supply well and from the City of Pearland public water supply well did not indicate any presence of lead above the MCL.

A public meeting will be held on Monday, June 4, 2001 at 7:00 p.m. in the cafeteria of H.C. Carleston Elementary School, 3010 Harkey Road in Pearland, Texas. The purpose of this meeting is to obtain additional information regarding the site relative to its eligibility for listing on the state registry and identify additional potentially responsible parties. The public meeting will be legislative in nature and not a contested case hearing under the Texas Administrative Procedure Act (Texas Government Code, Chapter 2001).

The executive director of the TNRCC prepared a brief summary of the commission's records regarding this site. Notice of Petition for Rulemaking to Amend §26.272 Relating to Interconnection

On April 12, 2001, The Public Utility Commission of Texas (commission) received a petition for rulemaking from the Commission on State Emergency Communications and the Emergency Communication Districts (collectively, Texas 9-1-1 Agencies). The petition has been assigned Project Number 23957, Expedited Petition for Rulemaking of the Texas 9-1-1 Agencies to Amend Subsection (e)(1)(B)(v) of P.U.C. Substantive Rule §26.272 to Specifically Clarify Obligations Related to 9-1-1 Dedicated Transport. Under Texas Government Code §2001.021 the commission shall either deny the petition in writing, stating its reasons for denial, or initiate a rulemaking proceeding not later than the 60th day after the date the petition is filed.

Texas 9-1-1 Agencies request the commission to clarify its rules on the issue of whether Texas 9-1-1 Agencies are obligated to pay certificated telecommunications utilities (CTUs) for 9-1-1 dedicated transport connecting and /or interconnecting from a CTU's end office to a 9-1-1 selective routing tandem. Texas 9-1-1 Agencies assert that the ultimate cost responsibility of any CTU connecting or interconnecting its end offices to the 9-1-1 selective routing tandem should be borne by the CTU as a cost of conducting business. Texas 9-1-1 Agencies state that a rulemaking to address these issues is necessary and appropriate at this time in order to assist in resolution of current contested cases and conserve the resources of the commission staff, Texas 9-1-1 Agencies and CTUs. Texas 9-1-1 Agencies reference two contested proceeding in their petition: Docket Number 22920, Application of Verizon Southwest to Revise the GTE Southwest, Inc. Emergency Number Service (E-9-1-1) Tariff to Comply with P.U.C. Substantive Rule §26.433 and §26.207 ; and Docket Number 22954, Notification of Southwestern Bell Telephone Company to Introduce Rates for Universal Emergency 9-1-1 Service Pursuant to Substantive Rule §26.433.

Texas 9-1-1 Agencies state that there are inconsistent approaches to determining 9-1-1 dedicated transport arrangements, especially as to meet point issues and potential interLATA issues. To address these concerns Texas 9-1-1 Agencies request that the existing language in §26.272(e)(1)(B)(v) be deleted and replaced with "The 9-1-1 trunking connection and interconnection requirements in subsection (e)(1)(B)(i)(I) of this rule are a cost of providing telecommunications for all CTUs in Texas. A CTU may not charge a 9-1-1 administrative entity for any costs attributable to these requirements."

Public Notice of Interconnection Agreement

On April 6, 2001, Southwestern Bell Telephone Company and Lightyear Communications, Inc., collectively referred to as applicants, filed a joint application for approval of interconnection agreement under §252(i) of the federal Telecommunications Act of 1996, Public Law Number 104-104, 110 Statute 56, (codified as amended in scattered sections of 15 and 47 United States Code) (FTA) and the Public Utility Regulatory Act, Texas Utilities Code Annotated, Chapters 52 and 60 (Vernon 1998 & Supplement 2001) (PURA). The joint application has been designated Docket Number 23941. The joint application and the underlying interconnection agreement are available for public inspection at the commission's offices in Austin, Texas.

The commission must act to approve the interconnection agreement within 35 days after it is submitted by the parties.

The commission finds that additional public comment should be allowed before the commission issues a final decision approving or rejecting the interconnection agreement. Any interested person may file written comments on the joint application by filing ten copies of the comments with the commission's filing clerk. Additionally, a copy of the comments should be served on each of the applicants. The comments should specifically refer to Docket Number 23941. As a part of the comments, an interested person may request that a public hearing be conducted. The comments, including any request for public hearing, shall be filed by May 9, 2001, and shall include:

1) a detailed statement of the person's interests in the agreement, including a description of how approval of the agreement may adversely affect those interests;

2) specific allegations that the agreement, or some portion thereof:

a) discriminates against a telecommunications carrier that is not a party to the agreement; or

b) is not consistent with the public interest, convenience, and necessity; or

c) is not consistent with other requirements of state law; and

3) the specific facts upon which the allegations are based.

After reviewing any comments, the commission will issue a notice of approval, denial, or determine whether to conduct further proceedings concerning the joint application. The commission shall have the authority given to a presiding officer pursuant to P.U.C. Procedural Rule §22.202. The commission may identify issues raised by the joint application and comments and establish a schedule for addressing those issues, including the submission of evidence by the applicants, if necessary, and briefing and oral argument. The commission may conduct a public hearing. Interested persons who file comments are not entitled to participate as intervenors in the public hearing.

Correction of Error

The Railroad Commission of Texas Adopted new 16 TAC §8.101. The rule appears in the April 27, 2001, Texas Register .

A typographical error in subsection (f) has been corrected in the print publication of the rule. However, the rule as published in the Texas Register daily Internet subscription service contained the typographical error.

In the last sentence of subsection (f) the word "with" should read "without", as in "...the pipeline segment can continue to operate without establishing pipeline integrity until...."

The subsection should read as follows.

"(f) If a pipeline that is not subject to this section undergoes any change in circumstances that results in the pipeline becoming subject to this section, then the operator of such pipeline shall establish integrity of the pipeline pursuant to the requirements of this section prior to any further operation. Such changes include but are not limited to an addition to the pipeline, change in the operating pressure of the pipeline, change from inactive to active status, change in population in the area of the pipeline, or change of operator of the pipeline segment. If a pipeline segment is acquired by a new operator, the pipeline segment can continue to be operated without establishing pipeline integrity as long as the new operator utilizes the prior operator's operation and maintenance procedures for this pipeline segment. If the population in the area of a pipeline segment changes, the pipeline segment can continue to operate without establishing pipeline integrity until such time as the operator determines whether or not the change in population affects the criteria applicable to the integrity management program, but for no longer than the time frames established under 49 CFR Part 192 or 195."

The Commissioners' Court of Somervell County, pursuant to House Bill 606, 75th Regular Legislative Session, hereby gives notice of its intent to request that the Texas Department of Human Services contract for additional nursing home beds under the state Medicaid program in Somervell County without regard to the occupancy rate of available Medicaid beds.

Further, the Commissioners Court request proposals from persons interested in providing additional; Medicaid beds in the County, including persons providing Medicaid beds in a nursing home facility with a high occupancy rate.

Notice of Available Funds for Fiscal Year 2002 for New or Established Apprenticeship Training Programs Not Currently Receiving Funding from the Texas Workforce Commission under the Texas Education Code, Chapter 133.

Filing Authority. The notice of available funds for apprenticeship training programs is authorized under the Texas Education Code, Chapter 133.

Eligible Applicants. The Texas Workforce Commission is requesting preliminary contact-hour estimates from public school districts, education service centers, and state post-secondary institutions for job-related instruction (apprentice) classes for new or established apprenticeship training programs not currently receiving funding from the Texas Workforce Commission under Texas Education Code, Chapter 133.

Description. Funds will be available for Fiscal Year 2002 (September 1, 2001 - August 31, 2002) to fund programs or new occupations within a program not currently receiving funding under the Texas Education Code, Chapter 133. The purpose of the funds is to provide classroom instruction for job-related instruction (apprentice) classes of apprenticeship training programs registered with the Bureau of Apprenticeship and Training. The amount of funding for Fiscal Year 2002 is unknown at this time and is contingent upon appropriation by the Texas Legislature. The Texas Workforce Commission estimates that a total between $65,000 to $95,000 may be available to supplement new apprenticeship programs.

Qualifications for Funding. To qualify for funding: 1) each apprenticeship training program or new occupation within a program must be certified and registered by the Bureau of Apprenticeship and Training (BAT), U.S. Department of Labor, no later than August 1, 2001; 2) each apprentice must be registered with the BAT in Texas on or before September 1, 2001; 3) each apprentice must be a full-time paid employee in the private sector in Texas; 4) the number of job-related instruction hours per class must be certified by the BAT as verified in the program standards of the apprenticeship program; 5) a public school district, education service center, or state postsecondary institution must act as fiscal agent for the funds pursuant to a contract between the apprenticeship program sponsor and the district or institution; and 6) the job-related instruction (apprentice) class must start in September 2001 and conduct its fourth class meeting no later than October 6, 2001.

Dates of Program. Each class may not start before September 1, 2001, and must end on or before August 31, 2002.

Planning Allocation of Funds. The statewide total number of estimated contact hours that are submitted to the Texas Workforce Commission will be divided into the amount of funds available to determine a preliminary contact-hour rate, not to exceed $4.00 per contact hour. Planning allocations are made to eligible applicants based on the number of estimated contact hours submitted to the Texas Workforce Commission, multiplied by the preliminary contact-hour rate.

Use of Funds. Funds can only be used for job-related instruction costs such as instructor salaries, instructional supplies, instructional equipment, and other operating expenses. No more than 15 percent may be used by the eligible applicants for administrative purposes, such as supervisory and/or secretarial salaries, office supplies, or travel.

Request for Proposals, Training and Technical Assistance for WIA Youth Program Services

A. PROPOSAL DESCRIPTION

The Texas Workforce Commission is soliciting proposals from contractors to provide intensive training and technical assistance to local area youth services staff in both on-site and off-site capacities. The services purchased will be for the purpose of improving the Boards' WIA Youth Programs and to meet program objectives. The selected contractor will target those areas with high concentrations of disadvantaged youth.

B. AUTHORIZATION TO AWARD CONTRACT

TWC procures these services in accordance with §302.002(b) of the Texas Labor Code and WIA Section 134(a)(3)(A), the Uniform Grants Management Standards (UGMS), and the Uniform Administrative Requirements for State and Local Governments (OMB Circular A-102) using competitive negotiation. Unlike formal advertising (i.e. sealed bids) , cost is not the only factor evaluated.

C. AVAILABLE FUNDING

Approximately $1,500,000 will be available to fund the selected proposal(s) under this RFP. The contract will include an initial time period for the contractor to become familiar with Texas youth policies and procedures, the grandfather provisions and their impact on WIA services in Texas, and The Workforce Information System of Texas (TWIST). Funding will be for the contract period of July 23, 2001 through June 30, 2003.

D. ELIGIBLE APPLICANTS

Contractors familiar with or able to become familiar with WIA Youth Program Services in order to provide intensive training and technical assistance to local area youth services staff in both on-site and off-site capacities. (Local Workforce Development Boards are not eligible to submit proposals under this RFP.)

E. PROJECT SCHEDULE

Application submission deadline is June 1, 2001. The anticipated contract effective date is July 23, 2001.

F. SCORING CRITERIA

The evaluation criteria for this RFP and their relative weights for scoring are: Demonstrated Ability to Perform Services, 20 points; Proposed Approach, 50 points; Project Administration, 20 points; and Budget Information, 10 points.

G. SELECTION, NOTIFICATION AND NEGOTIATION PROCESS

TWC will use competitive negotiation to determine awards. The Agency evaluates proposals received, ranks them, and may request an oral presentation by the offerors submitting top ranked proposals covering topics identified by the Agency. After the oral presentation (if any), the Agency makes a tentative selection decision, and negotiates with the selected offerors. When negotiations are completed, a contract is executed, and the award is announced.

H. PAYMENT

The basis of payment for this award shall be actual allowable cost based on performance of contract deliverables, subject to budget limitations.
