The Texas Natural Resource Conservation Commission (commission) withdraws proposed new §114.160 (Definitions), §114.161 (Applicability), §114.162 (Emission Requirements and Prohibitions), §114.163 (Exemptions), §114.164 (New Vehicle Certification and Testing), §114.165 (Reporting Requirements), §114.166 (Enforcement), §114.167 (Aftermarket Parts), and §114.169 (Affected Counties), which appeared in the December 31, 1999, issue of the Texas Register (24 TexReg 11924), based on an analysis of the comments received on this proposal. These revisions were proposed to Chapter 114 (Control of Air Pollution from Motor Vehicles), Subchapter E (Low Emission Vehicle), Division 2 (California Low Emission Vehicle Requirements), and to the state implementation plan (SIP).

The commission evaluated the comments received on the proposal to implement a California Low Emission Vehicle (Cal LEV) program throughout the State of Texas.

The commission received comments both in support of and in opposition to the proposal. Comments supporting the proposal were generally in support of the advanced automobile technology encouraged by the Cal LEV program in order to address air quality concerns. However, comments opposing the proposal were generally in support of using the federal Tier II motor vehicle standards to address air quality concerns.

The commission did not vote to adopt or reject these proposed rules. Instead, the commission voted to adopt a motion that the state would follow the federal Tier II motor vehicle standards and to accept commitments from the automobile industry to voluntary install California evaporative emission control equipment on new automobiles sold in Texas and to encourage the early introduction of advanced technology vehicles into Texas.
