Subchapter B. HISTORICALLY UNDERUTILIZED BUSINESS PROGRAM

The General Services Commission adopts amendments to Title 1, T.A.C., §§111.12, 111.16 and new §111.28 regarding the Historically Underutilized Business Program complying with the requirements of the Texas Government Code, Chapter 2161, Subchapter B, §2161.065 concerning the Mentor Protege Program; Subchapter C concerning Planning and Reporting Requirements; and Subchapter F concerning Subcontracting (enacted by S.B. 178, 76th Leg. (1999)). The amendments and new rule are adopted without changes to the proposed text published in the April 14, 2000, issue of the Texas Register (25 TexReg 3119). The text will not be republished.

The amendments and new rule are being adopted to clarify terminology and to implement the HUB Subcontracting Plan, the agency planning responsibilities, and the new Mentor Protege Program.

The amendments and new rule will provide a streamlined method for securing more goods and services from HUB vendors. The rules will provide a benefit to all small businesses implementing the legislature's policy of providing opportunities to HUBs to do business with the state.

No comments have been received concerning the proposed amendments to §§111.12, 111.16 and new 111.28.

The amendments and new rule are adopted under the Texas Government Code, Title 10, Subtitle D, §2161.002, which provides the General Services Commission with the authority to promulgate rules under this Code.

This agency hereby certifies that the adoption has been reviewed by legal counsel and found to be a valid exercise of the agency's legal authority.
