Proposed Action
The Commissioner of Insurance (Commissioner) will hold a public hearing
under Docket No. 2451 on August 31, 2000, at 10:00 a.m., in Room 100 of the
Texas Department of Insurance Building, 333 Guadalupe Street in Austin, Texas,
to consider a petition by the staff of the Texas Department of Insurance (Staff)
proposing amendments to the Texas Private Passenger Automobile Statistical
Plan (Statistical Plan). The Staff petition amends the use of an existing
data field to collect statistical experience concerning the use of rating
tiers for direct writing County Mutual companies. This proposal is based on
a petition filed with the Texas Department of Insurance by the Center for
Economic Justice requesting that these changes be made to the existing Statistical
Plan. Staff's petition (Ref. A-0700-17-I) was filed on July 3, 2000.
The petition proposes amendments to the Statistical Plan to amend the use
of an existing field to collect statistical experience concerning the use
of rating tiers. These amendments will only affect County Mutual companies
that write direct business.
The Commissioner has jurisdiction over this matter pursuant to the Texas
Insurance Code, Articles 5.96 and 21.69.

Comments on the proposed changes must be submitted in writing within 30
days after publication of the proposal in the Texas Register to the Office

An additional copy of the comment should be submitted to C.H. Mah, Senior
Associate Commissioner for Property & Casualty, P. O. Box 149104, MC105-5G,
Austin, Texas 78714-9104.
This notification is made pursuant to the Texas Insurance Code, Article
5.96, which exempts action taken under this article from the requirements
of the Administrative Procedure Act (Government Code, Title 10, ch. 2001).
