Chapter 71. TEXAS STATE CEMETERY

13 TAC §§71.3, 71.11, 71.13-71.15, 71.17, 71.19, 71.21, 71.23

The Texas State Cemetery Committee adopts the amendments to §§71.3, 71.11, 71.13, 71.15, 71.17, 71.19, 71.21, and new §§71.14 and 71.23 concerning the Texas State Cemetery Committee, cenotaphs and the cancellation of burial reservations without changes to the proposed text as published in the May 12, 2000 issue of the Texas Register (25 TexReg 4261). The text will not be republished.

The adoption of amendments to Title 13, TAC, Part 5, §§71.3, 71.11, 71.13, 71.15, 71.17, 71.19, 71.21, and new §§71.14 and 71.23 will clarify language in the rules and streamline definitions and guidelines for cenotaphs and cancellation of burial reservations.

The amendments and new rules will improve readability of the rules by providing a comprehensive set of definitions, revising or updating language, and by providing guidelines for cenotaphs and for the cancellation of burial reservations.

No comments were received regarding the amendments to Title 13, TAC, Part 5, §§71.3, 71.11, 71.13, 71.15, 71.17, 71.19, 71.21, and proposed new §§71.14 and 71.23.

The amendments and new rules are adopted under the authority of the Texas Government Code, Title 10, Subtitle D, §2165.2561 which provides the Texas State Cemetery Committee with the authority to promulgate rules necessary to implement the sections.

This agency hereby certifies that the adoption has been reviewed by legal counsel and found to be a valid exercise of the agency's legal authority.
