DESCRIPTION OF ACTIVITIES OF PRIVATE CONSULTANT:

The Office of the Attorney General of Texas ("the OAG") has entered into a major consulting services contract for the following services:

The OAG administers millions of dollars of federal funds for the Child Support (Title IV-D) and Medicaid (Title XIX) programs. The OAG recoups its indirect costs from these federal programs based on rates approved by the United States Department of Health and Human Services ("HHS"). Contractor will review the indirect cost methodologies of the OAG to determine areas of cost recovery which will maximize revenue from the recovery of indirect costs and will develop indirect cost rates throughout the OAG, as appropriate. Contractor will prepare Indirect Cost Allocation Plans for FY99 (based on actual expenditures) and for FY01 (based on budgeted expenditures) in accordance with OMB Circular A-87, for submission to HHS for federal approval and will negotiate approval of those plans with HHS. Contractor will also analyze existing legal billing rates of the OAG for purposes of reconciling those existing rates with actual costs of the OAG in providing the legal services and will provide to the OAG a report of that reconciliation. Contractor will develop the FY01 billing rates for legal services. Contractor will negotiate with HHS for approval of the FY01 billing rates. Finally, Contractor will provide guidance to the OAG in the implementation of these plans and billing rates.

NAME AND BUSINESS ADDRESS OF PRIVATE CONSULTANT:

The private consultant engaged by the OAG for these activities is DMG-Maximus, Inc., whose business address is 13601 Preston Road, Suite 400W, Dallas, Texas 75240.

TOTAL VALUE AND TERM OF THE CONTRACT:

The total value of the contract is $48,000. The term of the contract began on February 6, 2000, and will terminate on August 31, 2000, unless federal approval is still pending for the plans. In such case, the contract will continue until August 31, 2001 for the sole purpose of obtaining the necessary federal approval.

DATES ON WHICH REPORTS ARE DUE:

The Indirect Cost Allocation Plans must be submitted to HHS no later than April 28, 2000 . The final report regarding the FY01 billing rates for legal services must be submitted to the OAG no later than August 15, 2000 .

Texas Clean Air Act Enforcement Settlement Notice

Notice is hereby given by the State of Texas of the following proposed resolution of an environmental enforcement lawsuit under Texas Water Code §7.110. Before the State may settle a judicial enforcement action under the Texas Clean Air Act, the State shall permit the public to comment in writing on the proposed judgment. The Attorney General will consider any written comments and may withdraw or withhold consent to the proposed agreed judgment if the comments disclose facts or considerations that indicate that the consent is inappropriate, improper, inadequate, or inconsistent with the requirements of the Code.

Case Title and Court: State of Texas v. Kent L. Froelich dba Kent L. Froelich Company, Cause no. 99-08461, in the 200th Judicial District Court of Travis County, Texas

Nature of Defendant's Operations: Defendant Kent L. Froelich dba Kent L. Froelich Company operates a fiberglass reinforced plastic swimming pool manufacturing facility in Sanger, Denton County, Texas. The facility emits air contaminants such as styrene and acetone. The lawsuit by the State alleges that Froelich violated the Texas Clean Air Act, Texas Health & Safety Code Annotated Chapter 382, by failing to comply with an administrative Order issued by the Texas Natural Resource Conservation Commission (TNRCC) that he cease to emit air contaminants from his facility until such time as he obtained the proper permits and authorization from TNRCC.

Proposed Agreed Judgment: The Agreed Final Judgment calls for Froelich to pay the previously unpaid administrative penalty of $4,750, an additional civil penalty of $10,000, and attorneys fees of $6,000, plus court costs. The Judgment also enters a Permanent Injunction which requires Froelich to operate in accordance with his recently obtained authorization from the TNRCC.

Automobile Theft Prevention Authority

Request for Applications under the Automobile Theft Prevention Authority Fund

The Automobile Theft Prevention Authority is soliciting applications for grants to be awarded for projects under the Automobile Theft Prevention Authority (ATPA) Fund. This grant cycle will be one year in duration, and will begin on September 1, 2000. One or more of the following types of projects may be awarded, depending on the availability of funds:

Law Enforcement/Detection/Apprehension Projects, to establish motor vehicle theft enforcement teams and other detection/apprehension programs. Priority funding may be provided to state, county, precinct commissioner, general or home rule cities for enforcement programs in particular areas of the state where the problem is assessed as significant. Enforcement efforts covering multiple jurisdictional boundaries may receive priority for funding.

Prosecution/Adjudication/Conviction Projects, to provide for prosecutorial and judicial programs designed to assist with the prosecution of persons charged with motor vehicle theft offenses.

Prevention, Anti-Theft Devices and Automobile Registration Projects, to test experimental equipment which is considered to be designed for auto theft deterrence and registration of vehicles in the Texas Help End Auto Theft (H.E.A.T.) Program.

Reduction of the Sale of Stolen Vehicles or Parts Projects, to provide vehicle identification number labeling, including component part labeling and etching methods designed to deter the sale of stolen vehicles or parts.

Public Awareness and Crime Prevention/Education/Information Projects, to provide education and specialized training to law enforcement officers in auto theft prevention procedures, provide information linkages between state law enforcement agencies on auto theft crimes, and develop a public information and education program on theft prevention measures.

State agencies, local general purpose units of government, independent school districts, nonprofit, and for profit organizations are eligible to apply for grants for automobile theft prevention assistance projects. Nonprofit and profit organizations shall be required to provide with their grant applications sufficient documentation to evaluate the credibility and the community support of the organization and the viability of the organization's existing activities in the context of providing automobile theft prevention assistance.

Notice and Opportunity to Comment on Requests for Consistency Agreement/Concurrence under the Texas Coastal Management Program

On January 10, 1997, the State of Texas received federal approval of the Coastal Management Program (CMP) (62 Federal Register pp. 1439 - 1440). Under federal law, federal agency activities and actions affecting the Texas coastal zone must be consistent with the CMP goals and policies identified in 31 TAC Chapter 501. Requests for federal consistency review were received for the following projects(s) during the period of February 3, 2000, through February 10, 2000:

FEDERAL AGENCY ACTIONS:

Applicant: Lido Harbor Association ; Location: The project site is located in Clear Creek, west of Davis Road, in League City, Galveston County, Texas. CCC Project Number: 00-0039-F1; Description of Proposed Action: The applicant proposes to extend the time to complete construction of a marina, originally authorized under Permit Number 11196. Archaeological site 41GV82 was previously recorded in the project area. This site has been mitigated under previous data recovery excavations undertaken by a 1982 Corps of Engineers civil works project. Therefore, no further archaeological investigations are necessary for this project area. Type of Application: U.S.A.C.E. permit application number 11196(06) under §10 of the Rivers and Harbors Act of 1899 (33 U.S.C.A. 403).

Applicant: Exxon Pipeline Company ; Location: The project is located in the Houston Ship Channel in the vicinity of St. Mary's Island (Bayou Reach Channel), south of Baytown in Harris County, Texas. CCC Project Number: 00-0040-F1; Description of Proposed Action: The applicant proposes to relocate twenty-six (26) pipeline crossings in the Houston Ship Channel in response to the deepening and widening of the channel. All 26 crossings will be entirely removed from the channel and 22 will be reburied at a deeper depth to accommodate the federal project. Approximately 8.5 acres of St. Mary's Island will be restored for use as a temporary staging area. Type of Application: U.S.A.C.E. permit application number 21917 under §10 of the Rivers and Harbors Act of 1899 (33 U.S.C.A. 403).

Applicant: U.S. Fish and Wildlife Service ; Location: The project is located on a trapper's ditch to Barnett Lake near the Gulf Intracoastal Waterway (GIWW), approximately at Latitude 29o45'30" and Longitude 94o02'30" within the McFaddin National Wildlife Refuge, Jefferson County, Texas. CCC Project Number: 00-0041-F1; Description of Proposed Action: The applicant proposes to fill 50 linear feet of the trapper's ditch to Barnett Lake with approximately 55 cubic yards of material from an adjacent spoil mound at the end closest to the GIWW to prevent saltwater intrusion into Barnett Lake in the event of future erosion along the GIWW. Type of Application: U.S.A.C.E. permit application number 21911 under §10 of the Rivers and Harbors Act of 1899 (33 U.S.C.A. 403) and §404 of the Clean Water Act (33 U.S.C.A. §§125 - 1387).

Applicant: Davis Petroleum Corporation ; Location: The project is located in State Tracts 220, 221, 251, 252, 250 (N/2) and 260 (N/2) in Galveston Bay, Chambers County, Texas. CCC Project Number: 00-0042-F1; Description of Proposed Action: The applicant proposes to amend Permit 21364 to add State Tracts 220, 221, 252 and 250 (N/2) to the list of authorized tracts where work will be performed under this permit. The original permit authorized the installation, operation and maintenance of structures for the purpose of oil and gas production in State Tracts 251 and 260 (N/2) involving installation of marine barges, keyways, shell pads, production facilities, flowlines and attendant features. Type of Application: U.S.A.C.E. permit application number 21364(01) under §10 of the Rivers and Harbors Act of 1899 (33 U.S.C.A. 403) and §404 of the Clean Water Act (33 U.S.C.A. §§125 - 1387).

Applicant: Craig R. Turner ; Location: The project is located on Dickinson Bayou at 10,000 San Leon Drive, in Texas City, Galveston County, Texas. CCC Project Number: 00-0043-F1; Description of Proposed Action: The applicant proposes to construct a marina designed to accommodate a proposed residential development. An existing lake, measuring approximately 1 acre, will be connected to Dickinson Bayou by a proposed access channel. The existing lake is approximately 2 feet deep, and the applicant proposes to excavate the lake to 5 feet deep. The lake measures approximately 420 feet along the northern shoreline, 125 feet along the eastern shoreline, 320 feet along the southern shoreline, and 100 feet along the western shoreline. The applicant proposes to excavate the lake to 5 feet deep. The proposed access channel will measure 250 feet long on the western side, and 170 feet long on the eastern side. The channel will be 112 feet wide by 6 feet deep. The applicant proposes to construct a total of 63 boat slips within the proposed marina. The boat slips will measure between 16 feet and 20 feet wide. Type of Application: U.S.A.C.E. permit application number 21907 under §10 of the Rivers and Harbors Act of 1899 (33 U.S.C.A. 403).

Applicant: Jefferson County Engineering Department ; Location: The project is located along La Belle Road between FM365 and Frint Road south of Beaumont, in Jefferson County, Texas. CCC Project Number: 00-0044-F1; Description of Proposed Action: The applicant proposes to widen a portion of La Belle Road from a substandard 2-lane roadway with no shoulders to a minimum Texas Department of Transportation standard 2-lane roadway with improved shoulders and appropriate drainage ditches. Construction is expected to impact approximately 60 feet west of the existing road beginning at FM 365 to approximately 3,300 feet north of Pevitot Gully, at which point construction will switch to the east side of the roadway for an additional 60 feet. The proposed project will involve the placement of fill into approximately 1.93 acres of forested wetlands and jurisdictional waterways along the expanded ROW. Type of Application: U.S.A.C.E. permit application number 21923 under §10 of the Rivers and Harbors Act of 1899 (33 U.S.C.A. 403) and §404 of the Clean Water Act (33 U.S.C.A. §§125 - 1387).

Notice of Request for Proposals: In accordance with Chapter 2254, Subchapter A, and Section 2305.038, Texas Government Code, the Comptroller of Public Accounts (Comptroller) State Energy Conservation Office (SECO) announces the issuance of its Request for Proposals (RFP) to provide energy management training, curriculum development and implementation assistance to the Local Government Energy Management Program (Program). The Program provides a range of integrated services to assist entities set up and maintain locally controlled energy management programs: including, but not limited to, energy manager training workshops for school and local government energy managers, business officials, building operations, and others responsible for energy efficient facility operation; energy cost performance assessments of facilities; an effective energy accounting system; a plan to control the run times of energy-using equipment; recommendations for replacement of old inefficient equipment with new energy efficient equipment; development of an energy policy; and assistance in identifying options for financing capital energy projects. Comptroller invites proposals from qualified professional engineering firms that specialize in creating educational materials to educate Texans about the economic and environmental benefits of energy conservation programs and technologies. The successful respondent(s) will be expected to begin performance of any contract(s) resulting from this RFP on or about May 22, 2000.

The purpose of this RFP is provide the Program with assistance with energy manager training workshops for school and local government energy managers, business officials, building operators and others responsible for energy efficient facility operation as well as developing and implementing curricula specifically for high school students. The curriculum and instruction will provide the necessary information and training so that high school students can understand facility energy management. The students will be able to conduct energy audits, calculate energy savings, as well as perform other tasks necessary to insure that a facility operates efficiently. The Program is funded with oil overcharge funds appropriated by the 76th Texas Legislature.

Notice of Request for Proposals for Case Management and/or Community/Family Resource Services for Children with Special Health Care Needs

INTRODUCTION

The Texas Department of Health announces a Request for Proposals (RFP) for the provision of case management and/or community/family resource services for Children with Special Health Care Needs (CSHCN). For the purpose of this RFP, case management is defined as the assessment of the child's overall service needs and the development of a plan for meeting these needs. The services will be family centered, community-based, and culturally competent, and will assist children who need a variety of services. To be eligible for CSHCN case management, a child must be under the age of 21, a resident of Texas, have a special health care need, and not be able to access other appropriate case management services. Community and family resource activities should build community infrastructure and /or educate and support CSHCN and their families in promoting their health and well being. The RFP provides a listing of example activities.

ELIGIBLE APPLICANTS

Eligible applicants include public and private agencies, organizations, and individuals who are current or potential service providers for CSHCN.

AVAILABILITY OF FUNDS

It is expected that approximately $1,900,000 will be available for awards and that 14 or more proposals will be funded.

PROJECT AND BUDGET PERIODS:

Contracts will be funded for a 12 month period beginning September 1, 2000 through August 31, 2001.

REVIEW AND AWARD CRITERIA

Each application will be screened for minimum eligibility and completeness, as well as satisfactory fiscal and administrative history. Applications deemed ineligible, or that arrive after the deadline, will not be reviewed.

Eligible, complete applications will be reviewed and scored by evaluators, according to the quality and thoroughness of the application and the demonstrated potential of the applicant to provide quality case management and/or community/family resource services.

SUBMISSION REQUIREMENTS

The original and two copies must be received by Marjorie Doubleday, Bureau of Children's Health/Bureau of Nutrition Services, Contract Management Section, Texas Department of Health, 1100 West 49th Street, Austin, Texas 78756 by 5:00 p.m. Central Daylight Savings Time on April 24, 2000 . Request for Proposals

The Community and Technical Colleges Division (CTCD) of the Texas Higher Education Coordinating Board (THECB) is releasing a Request for Proposals (RFP) for the award of federal funds. These funds are provided to the State of Texas through the Carl D. Perkins Vocational and Technical Education Act of 1998 [P.L. 105-332] for the advancement of career and technical education in Texas.

General Information. The THECB seeks to fund projects in four competitive areas using State Leadership funds: Professional Development, Curriculum Development, Special Populations, and Other Topics. The THECB will also fund Tech-Prep Implementation Projects on a formula basis; supplemental topics related to the Tech-Prep initiative will be funded on a competitive basis. Applicants will be asked to respond to specific topics in each of the areas listed above.

Proposal Instructions . Detailed specifications concerning the State Leadership and Tech-Prep areas will be made available in the RFP, which will be available through the THECB web-site at the following address: http://www.thecb.state.tx.us/divisions/ctc/we/we.htm In general, applicants will submit an on-line Notification of Intent in order to receive a password and proposal number. The password will give applicants access to the on-line, web application. Both the Notification of Intent and the application will be available at the above web address. Proposals must be submitted using the on-line web application and will contain an application cover page, a project summary, a project rationale, goals and objectives, an evaluation plan, a list of project staff, coordination and linkages, a statement of commitment to continue the project, seven budget cost category schedules, a budget summary page, and contract provisions. The RFP contains specific details regarding submission requirements and applicants should review the RFP carefully prior to submitting proposal(s).

Deadline Dates. The Notification of Intent is due Wednesday, March 15, 2000, by 5:00 p.m. and all proposals are due on Friday, April 14, 2000, by 5:00 p.m.

Selection Process. Proposal applications in the State Leadership and Tech-Prep Supplemental categories (new proposals only) will be reviewed and ranked by an expert panel from outside Texas and by members of the THECB staff. The recommendations of the reviewers will be presented to the Commissioner of Higher Education or his designee who will give final approval for the award of funds. The THECB will base selection on, among other things, specific criteria that includes statewide impact, plan for dissemination, coordination with lead consortium project (if applicable), identification of relevant outcomes, cost-effectiveness, technology driven, and relationship to the job market. Additional criteria may apply based on the category of the submission. All contract negotiations with Perkins-funded projects will be between the THECB staff and the contractor. The award of funds is contingent on the availability and approval of the expenditure of these funds by the appropriate Board (s).

Project Timing and Cost. Contingent upon negotiation of a contract, the period of the contract is anticipated to be September 1, 2000 -- August 31, 2001. The projects selected for funding will be required to submit quarterly progress and expenditure reports, final progress and expenditure reports, and a final product (if applicable). Funding ranges are dependent upon the submission category, but may range from $60,000 -- $100,000. Tech-Prep Implementation projects will be funded on a formula basis. The anticipated award date of the contract is September 1, 2000.

General Award and Conditions. The THECB reserves the right to accept or reject any or all proposals submitted. The THECB is not obligated to execute a resulting contract, provide funds, or endorse any proposal that is submitted in response to this RFP. The RFP does not commit the THECB to award a contract or pay any cost incurred in the preparation of a response.

The Executive Director of the TNRCC has prepared draft permits which, if approved, will authorize the minor amendments to these permits.

APPLICATION. Republic Waste Services of Texas II, LLC , 10554 Tanner Road, Houston, TX 77041, has applied to the Texas Natural Resource Conservation Commission (TNRCC) for a minor amendment to Permit Number MSW-1849A which would authorize a change in site operating hours allowing the facility to be open from 5:00am to 7:00pm, Monday through Saturday. Notice of Application for Municipal Solid Waste Management Facility

For The Period of February 02, 2000 to February 14, 2000

APPLICATION. Juliff Gardens, L.L.C. Landfill , 1219 Turncreek Lane, Katy, Texas, 77450. The site is located approximately 2,500 feet from the intersection of FM 521 and County Road 56 in Brazoria County. A proposed Type IV Municipal Solid waste (MSW) facility. The applicant has applied to the Texas Natural Resource Conservation Commission (TNRCC) for a Type IV landfill facility. This site will dispose of brush, construction demolition waste, rubbish, inert material, trash, yard waste which is free of putrescible and household waste, scap tires if they have been slit and quartered or do not come from a tire disposer/recycle who is reimbursed from the state tire recycling fund. The Juliff Gardens landfill will not accept Class I, Class II, or Class III non-hazardous industrial waste, radioactive waste, PCB contaminated waste, liquid waste, water and wastewater treatment sludges, grease/grit trap waste, and special waste which may cause an odor or nuisance, or which may require excessive or special procedures and handling requirements will not be accepted. The permit application is available for viewing and copying at the Angleton Public Library in Angleton , Texas, 77515, (409) 864-1519. The TNRCC Executive Director has determined the application is administratively complete and will conduct a technical review of the application. This application was submitted to the TNRCC on December 13, 1999. After completion of that review, the TNRCC will issue a Notice of Application and Executive Director's Preliminary Decision.

APPLICATION. The City of Temple , 2 North Main Street, Temple, TX 76501, has applied to the Texas Natural Resource Conservation Commission (TNRCC) to amend existing Permit Number MSW-692 (Proposed Permit Number MSW- 692-A) to expand the site vertically by approximately 114 feet to a final elevation of 759.00 above mean sea level and horizontally from 215.052 acres to a total of 269.02 acres. If the permit is granted, the applicant would be authorized to dispose of: (1) municipal solid waste resulting from or incidental to municipal, community, commercial, institutional, recreational activities, and construction or demolition projects; (2) Class II and III industrial solid waste; (3) and special wastes that are properly identified. The facility would be authorized to operate from 6:00 a.m. to 6:00 p.m., Monday through Friday; and 7:00 a.m to 5:00 p.m. on Saturday. The Executive Director of the TNRCC has prepared a draft permit which, if approved, would establish the conditions under which the facility must operate.

PUBLIC COMMENT / PUBLIC MEETING. Written public comments and requests for a public meeting should be submitted to the Office of the Chief Clerk at the address included in the information section below within 30 days after newspaper publication of this notice. A public meeting is intended for the taking of public comment, and is not a contested case hearing. A public meeting will be held when there is a significant degree of public interest in the application.

The Texas Natural Resource Conservation Commission (TNRCC or commission) staff is providing an opportunity for written public comment on the listed Agreed Orders (AOs) pursuant to the Texas Water Code (the Code), §7.075. C. has applied to the Texas Natural Resource Conservation Commission (TNRCC) for a temporary water use permit to divert and use 82 acre-feet of water at a maximum diversion rate of 3.90 cfs (cubic feet per second) / 1750 gpm (gallons per minute) for mining (hydrostatic testing of tank) purposes during a one month period from the San Jacinto River (Houston Ship Channel), San Jacinto River Basin. The requested water will be diverted from a point approximately 1.0 mile east of Galena Park and 1.0-river mile upstream of the confluence of Greens Bayou and the Houston Ship Channel, Harris County, Texas. Public notice of the application is being mailed to all of the water right holders downstream of the applicants diversion point to the terminus of the Houston Ship Channel at Burnet Bay. Public Notice

The executive director of the Texas Natural Resource Conservation Commission (TNRCC or commission) is issuing a public notice of intent to delete (delist) a facility from the state registry (state Superfund list) of sites which may constitute an imminent and substantial endangerment to public health and safety or the environment due to a release or threatened release of hazardous substances into the environment.

The site proposed for deletion is the Houston Scrap state Superfund site that was originally proposed for listing on the state Superfund registry on October 16, 1987 (13 TexReg 427-428).

The Houston Scrap state Superfund site, including all land, structures, appurtenances, and other improvements, is approximately 20 acres, and is located at 3799 Jensen Drive, Houston, Harris County, Texas. In addition, the site includes any areas outside the site property boundary where hazardous substance(s) came to be located as a result, either directly or indirectly, of releases of hazardous substance(s) from the site property. Following deletion, the site (except for the fenced-in area of the containment cell) would be suitable for commercial/industrial use.

Houston Scrap was previously a rendering facility until approximately 1976, when the aluminum and lead-acid battery recycling began along with various other scrap metal recovery activities. It was estimated that the site contained about 7,500 cubic yards of used battery casings, scrap metal, used 55- gallon drums, household garbage, and approximately 1,000 used car and truck tires. Lead contamination was documented in the soil from residue washed from the used battery casings that were left exposed to wind and rain. Some soil was also contaminated with polychlorinated biphenyls. The metals contamination was generally confined to the upper six inches of soil.

Contaminated soil was excavated to a nonresidential cleanup level, consolidated on-site, and covered by an engineered cap to minimize leaching of contaminants to the groundwater. While groundwater remediation was not addressed as part of the cleanup, monitoring wells have been installed to detect any impact of the containment cell on the groundwater at the site.

A lien for recovery of environmental remediation costs has been filed by the TNRCC on the real property. The deed certification of remediation notices the owner, prospective purchasers and lessors of the property of the existence of the fenced-in contamination cell and cap, and the requirement that the property owner is responsible for maintenance of and compliance with engineered or institutional controls required by TNRCC.

The engineering and institutional controls required by TNRCC include maintenance of the fence around the containment cell, posting of signs warning of the presence of hazardous material in the cell, maintenance of the cap over the consolidated waste material in the containment cell, biannual monitoring of groundwater for the presence of antimony, arsenic, beryllium, and lead. There are seven monitoring wells around the containment cell inside the fence.

Future use of the property is considered appropriate for commercial/industrial use according to risk reduction standards applicable at the time of this filing.

The executive director has determined that this site no longer presents an imminent and substantial endangerment to public health and safety and the environment and is therefore eligible for deletion from the list of sites proposed for the state Superfund registry in accordance with 30 TAC §335.344(c).

In accordance with 30 TAC §335.344(b), the TNRCC will hold a public meeting to receive comment on this intended deletion. This meeting will not be considered a contested case hearing within the meaning of Texas Government Code, Chapter 2001. The meeting will be held on March 28, 2000 at 7:30 p.m. at the Eva Alice McCrane Kashmere Gardens Branch Library, 5411 Pardee Street in Houston, Texas.

Request for Comments on Form for Earnings Monitoring Report for Non-IOU Transmission Service Providers

The Public Utility Commission of Texas (commission) proposes a new form, Earnings Monitoring Report for Non-IOU Transmission Service Providers to be used by utilities to fulfill the requirements of the commission's Substantive Rule §25.193(a)(5). Project Number 21496 is assigned to this proceeding. The proposed form will be used in the determination of any excess earnings related to the provision of transmission service by non-investor owned utility (non-IOU) transmission service providers required to file the report.

Copies of the proposed form are available in the commission's Central Records Division, Room G-113, under Project Number 21496 or through the commission's web page at www.puc.state.tx.us.

In addition to comments on the proposed new form, the commission also requests comments on the following:

Interested parties are asked to provide proposed methodologies with numerical examples for weather adjustments to ERCOT peak and hence to utilities' revenues. These comments will be used to develop Schedule IX - Normalization Adjustments to Revenue .

A petition by Neighbors for Neighbors requesting designation of certain lands in Bastrop and Lee Counties as unsuitable for surface coal mining operations was filed with the Railroad Commission of Texas. By this advertisement, the Railroad Commission of Texas provides notice to the general public that relevant information may be submitted by the general public regarding this petition and its request. Research and Oversight Council on Workers' Compensation

Notice of Consultant Contract Award

In accordance with the provisions of Article 5.76-6, Texas Insurance Code, the Research and Oversight Council on Workers' Compensation (ROC) announces this notice of consultant contract award.

Publication of Request for Proposals: The consultant proposal request was published in the November 12, 1999, issue of the Texas Register (24 Tex Reg 10242).

Consulting Services: The consultant will assist the ROC and the Texas Workers' Compensation Insurance Fund (Fund) in conducting a series of medical cost and quality studies and a safety and return-to-work study of the State's workers' compensation system, produce periodic progress reports, and assist in producing a final report to the ROC and the Texas Legislature. No award has been made for medical study number 3 or safety and return-to-work study number 2.

Contract and Consultant: The contract is awarded to MedFX, LLC, 386 Richardson Way, Mill Valley, California 94941. The total dollar value of the contract is not to exceed $767,624.00 in the aggregate. The contract was executed on or about February 15, 2000, and extends through August 31, 2001. MedFX will prepare a final report(s), which will be delivered to the ROC on or about November 2000.

This request for consulting services is filed under the provisions of Government Code, Chapter 2254.

The Board of Regents of Stephen F. Austin State University, Nacogdoches, Texas requests proposals from executive search firms interested in assisting the University in conducting a comprehensive search for an individual to fill the position of University President. The president is the University's chief executive officer, reporting to its nine-member Board of Regents.

Stephen F. Austin State University is located in an impressive setting of pine trees and natural beauty and serves the educational needs of East Texas. Founded in 1923, the institution has matured to a comprehensive university which enrolls over 11,000 students, employees over 500 FTE faculty members, and has an annual operating budget of approximately $106 million. The University offers 92 undergraduate degree programs through seven colleges, 62 masters degrees, and Doctorates of Forestry and Education.

The Board intends to make the selection of a presidential search firm at its regularly scheduled April 18, 2000 meeting. Previous experience in conducting executive searches, client references, and billing packages will be important considerations in the award of the proposed contract. Interviews with the board or its Executive Committee may be required prior to the April 18, 2000 meeting.
