Notice and Opportunity to Comment on Requests for Consistency Agreement/Concurrence under the Texas Coastal Management Program

On January 10, 1997, the State of Texas received federal approval of the Coastal Management Program (CMP) (62 Federal Register pp. 1439-1440). Under federal law, federal agency activities and actions affecting the Texas coastal zone must be consistent with the CMP goals and policies identified in 31 TAC Chapter 501. Requests for federal consistency review were received for the following projects(s) during the period of March 5, 1999, through March 11, 1999:

FEDERAL AGENCY ACTIONS:

Applicant: Texas Parks and Wildlife Department; Location: The project is located on Jones Creek in the Peach Point Wildlife Management Area (PPMA), approximately 2 miles south of the city of Jones Creek, Brazoria County, Texas; Project Number: 99-0080-F1; Description of Proposed Action: The applicant proposes to fill 0.066 acre of adjacent wetlands and 0.024 acre of shallow water habitat to construct a bridge approach and riprap areas to stabilize bridge abutments. The bridge approach is located on the west side of Jones Creek and the abutments will be on both the east and west sides. Approximately 10 cubic yards of material will be placed in wetland area to build the approach. The material will be obtained from upland area along an existing road in the PPMA. A total of 70 cubic yards of concrete riprap will be used to build erosion control structures consisting of 35 cubic yards of riprap on each side of the creek. The purpose of the project is to connect the parts of the PPMA divided by Jones Creek to provide better access to the public and to Texas Parks and Wildlife Department staff; Type of Application: U.S.A.C.E. permit application number 21341 under §10 of the Rivers and Harbors Act of 1899 (33 U.S.C.A. 403), and §404 of the Clean Water Act (33 U.S.C.A. §§125-1387).

Applicant: The Louisiana Land and Exploration Co.; Location: The project site is located in the Gulf of Mexico, Matagorda Island area, in State Tract (ST) 520-L, north of the Three Marine League Line and outside of the Matagorda Island Anchorage Area, central to a point approximately 20 miles east from Port O'Connor, Texas; Project Number: 99-0081-F1; Description of Proposed Action: The applicant proposes to abandon-in-place two steel flow lines, a 6-inch-diameter and a 10-inch-diameter, that extend from the Number 1 Well in the SW/4 of the ST to the Number 6 Well located in the NW/4 of the ST. The lines are 50 to 200 feet outside of the northern boundary of the anchorage area. They are approximately 9,800 feet in length, 100 feet apart, and 3 feet below the sea bottom. A sonar survey of the flow lines conducted for the applicant did not show any exposed areas. The lines were originally authorized by Department of the Army Permit 9802/56 and were installed approximately 20 years ago. The applicant has reported that both lines have been purged and filled with seawater by a previous owner; Type of Application: U.S.A.C.E. permit application number 21445 under §10 of the Rivers and Harbors Act of 1899 (33 U.S.C.A. 403).

Applicant: Dwight E. and Rhonda C. Peake; Location: The project is adjacent to Lots 1 and 2 of Spartina Vista Subdivision, north of Spanish Grant Subdivision, Section 2, and at the end of Galleon Street, on the west bank of Spanish Grant Subdivision Canal, Galveston, Galveston County, Texas; Project Number: 99-0082-F1; Description of Proposed Action: The applicant proposes to construct a 562-foot-long bulkhead as shown on the enclosed plans. The purpose of the proposed project is to prevent bank erosion and to stabilize the predominantly steep bank along the canal frontage of the project site. There is an existing bulkhead at the south end of the proposed bulkhead, and no bulkhead next to the north end of the proposed bulkhead. The northernmost 477-foot-long section would be constructed on the upland side of the mean high tide (MHT) line. The remaining 85-foot length of the proposed bulkhead would be constructed below MHT, traversing a section of eroded shoreline adjacent to the existing Spanish Grant Subdivision bulkhead. Approximately 40 cubic feet of fill material would be placed below MHT behind the 85-foot length of the proposed bulkhead. Fill would consist of sand obtained from the existing high bank area adjacent to the canal. The fill would cover approximately 1,230 square-feet of unvegetated shallow water habitat, and is expected to be used as yard when a home is build on Lot 1 of the Spartina Vista Subdivision. The southernmost 85-foot length of proposed bulkhead would be made of 10-foot-long by 6-foot-wide by 7.5-inch-thick tongue-and-groove concrete panels, which would be jetted 7 feet deep. The northernmost 477-foot length of proposed bulkhead would be made of shorter, 8-foot-long concrete panels, which would also be jetted 7 feet deep. The applicant has proposed to create 2,660 square-feet of new Spartina alterniflora marsh. After construction of the proposed bulkhead, a 380-foot-long by 7-foot-wide area adjacent to the bulkhead would be planted with Spartina transplanted from an approved borrow site; Type of Application: U.S.A.C.E. permit application number 21501 under §10 of the Rivers and Harbors Act of 1899 (33 U.S.C.A. 403), and §404 of the Clean Water Act (33 U.S.C.A. §§125-1387).

Applicant: Petro-Guard Production L.L.C.; Location: The project is located in the S/2 of State Tract 60, San Antonio Bay, Calhoun County, Texas; Project Number: 99-0083-F1; Description of Proposed Action: The applicant requests authorization to install, operate and maintain structures and appurtenances necessary for oil and gas exploration, production and transportation. Proposed activities include installation of typical drilling barges and keyways, shell or gravel pads as needed, well protectors structures, wellheads and flow lines, pipelines and production platforms. Additional activities may include foundations for the installation of aids to navigation, construction of mooring dolphins and markers, driving of test pilings, and coring operations; Type of Application: U.S.A.C.E. permit application number 21557 under §10 of the Rivers and Harbors Act of 1899 (33 U.S.C.A. 403), and §404 of the Clean Water Act (33 U.S.C.A. §§125-1387).

Applicant: Petro-Guard Production L.L.C.; Location: The project is located in State Tracts (ST) 65, N/2 of ST 75, N/2 of ST 74, S/2 of ST 73 and N/2 of ST 99, Hynes Bay, Calhoun County, Texas; Project Number: 99-0084-F1; Description of Proposed Action: The applicant requests authorization to install, operate and maintain structures and appurtenances necessary for oil and gas exploration, production and transportation. Proposed activities include installation of typical drilling barges and keyways, shell or gravel pads as needed, well protector structures, wellheads and flow lines, pipelines and production platforms. The structure will be located at coordinates X = 3,155,573 and Y = 762,778; Project Number: 99-0085-F1; Description of Proposed Action: The applicant proposes to erect and maintain structures and appurtenances for the production of oil and gas, including a drilling barge, well access platform, well protectors, mooring piles and markers. They will drill wells Number 1 and Number 2 from the same structure. The work will include the placement of approximately 4,500 cubic yards of crushed rock or gravel for a 290-foot by 120-foot drilling pad; Type of Application: U.S.A.C.E. permit application number 21570 under §10 of the Rivers and Harbors Act of 1899 (33 U.S.C.A. 403), and §404 of the Clean Water Act (33 U.S.C.A. §§125-1387).

Applicant: Cockrell Oil Corporation; Location: The project is located in the south half of State Tract 170, Matagorda Bay, Matagorda County, Texas. The structure will be located at coordinates X = 3,154,904 and Y = 761,647; Project Number: 99-0086-F1; Description of Proposed Action: The applicant proposes to erect and maintain structures and appurtenances for the production of oil and gas, including a drilling barge, well access platform, well protectors, mooring piles and markers. They will drill wells Number 1 and Number 2 from the same structure. The work will include the placement of approximately 4,500 cubic yards of crushed rock or gravel for a 290-foot by 120-foot drilling pad; Type of Application: U.S.A.C.E. permit application number 21571 under §10 of the Rivers and Harbors Act of 1899 (33 U.S.C.A. 403), and §404 of the Clean Water Act (33 U.S.C.A. §§125-1387).

Applicant: Cockrell Oil Corporation; Location: The project is located in the south half of State Tract 170, Matagorda Bay, Matagorda County, Texas. The structure will be located at coordinates X = 3,155,470 and Y = 761,808; Project Number: 99-0087-F1; Description of Proposed Action: The applicant proposes to erect and maintain structures and appurtenances for the production of oil and gas, including a drilling barge, well access platform, well protectors, mooring piles and markers. They will drill wells Number 3 and Number 4 from the same structure. The work will include the placement of approximately 4,500 cubic yards of crushed rock or gravel for a 290-foot by 120-foot drilling pad; Type of Application: U.S.A.C.E. permit application number 21572 under §10 of the Rivers and Harbors Act of 1899 (33 U.S.C.A. 403), and §404 of the Clean Water Act (33 U.S.C.A. §§125-1387).

Applicant: Corkrell Oil Corporation; Location: The project is located in the north half of State Tract 161, Matagorda Bay, Matagorda County, Texas. The structure will be located at coordinates X = 3,154,476 and Y = 760,551; Project Number: 99-0088-F1; Description of Proposed Action: The applicant proposes to erect and maintain structures and appurtenances for the production of oil and gas, including a drilling barge, well access platform, well protectors, mooring piles and markers. They will drill wells Number 1 and Number 2 from the same structure. The work will include the placement of approximately 4,500 cubic yards of crushed rock or gravel for a 290-foot by 120-foot drilling pad; Type of Application: U.S.A.C.E. permit application number 21573 under §10 of the Rivers and Harbors Act of 1899 (33 U.S.C.A. 403), and §404 of the Clean Water Act (33 U.S.C.A. §§125-1387).

FEDERAL AGENCY ACTIVITIES:

Applicant: National Marine Fisheries Service; Project Number: 99-0089-F2; Description of Proposed Activity: The applicant proposes to implement an addendum to the draft Fishery Management Plan for Atlantic Tunas, Swordfish, and Sharks (HMS FMP) and specifically proposes to set Atlantic bluefin tuna (BFT) fishing category quotas and close an area off the New England and mid-Atlantic coast to pelagic longline gear. In addition, NMFS proposes BFT General category effort control specifications for the 1999 fishing season. The addendum addresses requirements of the Magnuson-Stevens Fishery Conservation and Management Act (Magnuson-Stevens Act) to establish a rebuilding program for BFT. The proposed rule is necessary to implement the 1998 quota recommendation of the International Commission for the Conservation of Atlantic Tunas (ICCAT), as required by the Atlantic Tunas Convention Act (ATCA), and to achieve domestic fishery management objectives.

Pursuant to §306(d)(14) of the Coastal Zone Management Act of 1972 (16 U.S.C.A. §§1451-1464), as amended, interested parties are invited to submit comments on whether a proposed action is, or is not consistent with the Texas Coastal Management Program goals and policies, and whether the action should be referred to the Coastal Coordination Council for review. The Consumer Credit Commissioner of Texas has ascertained the following brackets and ceilings by use of the formula and method described in Tex. Fin. Code §341.203. 1

The amounts of brackets in Tex. Rev. Civ. Stat. Ann. art. 5069-3A.301(a) (Vernon's 1997) are changed to $1,410.00 and $11,750.00, respectively.

The ceiling amount in Tex. Rev. Civ. Stat. Ann. art. 5069-3A.401 (Vernon's 1997) is changed to $470.00.

The amounts of the brackets in Tex. Fin. Code §345.055 are changed to $2,350.00 and $4,700.00, respectively.

The amounts of the bracket in Tex. Fin. Code §345.103 is changed to $2,350.00.

The ceiling amount of Tex. Fin. Code §371.158 is changed to $11,750.00.

The amounts of the brackets in Tex. Fin. Code §371.159 are changed to $141.00, $470.00, and $1,410.00, respectively.

The above dollar amounts of the brackets and ceilings shall govern all applicable credit transactions and loans made on or after July 1, 1999, and extending through June 30, 2000.

Corrections of Error

A correction of error was published in the February 26, 1999, issue of the Texas Register (24 TexReg 1485) for final rules for 22 TAC, Chapter 601, Medical Physicists, §§601.2, 601.4, 601.6, 601.8, 601.10, 601.11, and 601.21. The rules were published in the January 29, 1999, issue of the Texas Register (24 TexReg 559).

On page 1485, the correction of error should reference “22 TAC” instead of “40 TAC”.


The Texas Department of Health submitted proposed new rule for 25 TAC, §181.14. The rule appeared in the March 5, 1999, issue of the Texas Register (24 TexReg 1572).

Due to error by the Texas Department of Health, on page 1572, subsection (b) is incorrect, it should read as, “Only funeral directors or persons in charge of interment or in charge of removal of a body from a registration district for disposition may prepare and file the certificate of death and fetal death on the forms VS-112 and VS-113.”


Notice of Request for Proposals for Community-Centered Projects to Address the Goals of the Take Time for Kids Program

INTRODUCTION: The Texas Department of Health (department) requests proposals for community-centered projects that address the goals of the Take Time for Kids program: to increase the practice of positive parenting by expanding parenting education opportunities, to promote preventive health care for children under four years of age, and to support the coordination and growth of community efforts, resources, and services to maximize the healthy development of children. Proposals will be reviewed and contracts awarded on a competitive basis.

ELIGIBLE APPLICANTS: Eligible applicants include, but are not limited to, nonprofit, for-profit, private, and public organizations; entities in city, county, and state government; institutions of higher learning; independent school districts; faith-based organizations; former Take Time for Kids Award grantees; individual persons; and current department contractors in other department programs.

AVAILABLE FUNDS: Approximately $200,000 in state funds is expected to be available to fund a maximum of 20 projects, each with an 11-month budget. The maximum amount an individual applicant may request is $20,000. The specific dollar amount awarded will depend upon the merit and scope of the proposed project.

DEADLINE: Proposals prepared according to the instructions in the Request for Proposals (RFP) must be received by Ruth E. Andersen, Ph.D., Community Liaison, Take Time for Kids, Texas Department of Health, CIDC Mailroom, 1100 West 49th Street, Austin, Texas 78756-3199, on or before May 14, 1999, 5:00 p.m., Daylight Saving Time. EVALUATION AND AWARD CRITERIA: Each proposal will be initially screened for completeness. Proposals that do not meet the screening requirements in the RFP may not be considered for review, and the applicant will be so notified on or before June 1, 1999. Proposals that arrive after the deadline will not be reviewed. Proposals will be evaluated based upon the following criteria.

(1) The project plan addresses all three goals and uses some or all of the methods listed in the RFP under that goal.

(2) The applicant possesses the resources to carry out the proposed plan successfully.

(3) The applicant shows that the target community recognizes the need for the project.

(4) The applicant will effectively and efficiently carry out the plan.

The Health and Human Services Commission State Medicaid Office has received approval from the Health Care Financing Administration to amend the Title XIX Medical Assistance Plan by Transmittal Number 98-16, Amendment Number 555.

The amendment allows the State to limit the Medicare Part A deductible and coinsurance on inpatient hospital crossover claims to the amount the State would have paid under the Medicaid State Plan in accordance with §4714 of the Balanced Budget Act of 1997. The amendment is effective October 1, 1998.

The Texas Health and Human Services Commission (HHSC) announces the issuance of a Request for Information (RFI) consisting of a draft Request for Offers for development of an automated information system to support the Texas Integrated Enrollment and Services Project. The 75th Texas Legislature enacted House Bill Number 2777 which in pertinent part directs HHSC to develop and implement a plan for the integration of services and functions relating to eligibility determination and service delivery by state health and human services agencies, the Texas Workforce Commission, and other agencies. HHSC is authorized under the statute to contract appropriate professional and technical assistance to develop or implement the plan. The project, known as the Texas Integrated Enrollment and Services (TIES) Project, is managed by HHSC in cooperation with agencies whose programs are within the scope of TIES. HHSC invites comments from interested individuals or organizations regarding the RFI.

The RFI is available in electronic format beginning March 29, 1999, via the Internet at www.hhsc.state.tx.us.

Texas Natural Resource Conservation Commission

Invitation to Comment

The Texas Natural Resource Conservation Commission (TNRCC) announces the availability of the Draft February 1999 Update to the Water Quality Management Plan for the State of Texas.

The Water Quality Management Plan (WQMP) is developed and promulgated pursuant to the requirements of the federal Clean Water Act (CWA), §208. The law requires area-wide water quality management planning in areas having significant water quality problems which can only be addressed on an area-wide basis. The governor of each state is authorized to designate such planning areas and representative organizations within them to develop area-wide waste treatment management plans. There are seven designated areas in Texas. A regional council is the designated planning agency in each of these areas. The water quality agencies for these seven areas are: the Lower Rio Grande Valley Development Council, the Coastal Bend Council of Governments, the Houston-Galveston Area Council, the South East Texas Regional Planning Commission, the Central Texas Council of Governments, the North Central Texas Council of Governments, and the Ark-Tex Council of Governments. The portion of the state outside these designated areas is known as the non-designated area. The TNRCC is the water quality agency for the non-designated area, which is divided into 23 separate planning areas, primarily along major river basin boundaries.

The Draft February 1999 WQMP Update includes projected effluent limits of indicated domestic dischargers useful for water quality management planning in future permit actions. Inclusion of these projected effluent limits in the Draft February 1999 WQMP Update will allow wastewater permitees the opportunity to seek Texas Pollutant Discharge Elimination System (TPDES) wastewater permits issued by the TNRCC.

Public Hearing Notice

Notice is hereby given that pursuant to the requirements of the Texas Health and Safety Code Annotated, §382.017 (Vernon's 1992) and Texas Government Code Annotated, Subchapter B, Chapter 2001 (Vernon's 1993), the Texas Natural Resource Conservation Commission (commission) will conduct a public hearing to receive testimony regarding the Texas Risk Reduction Program rule.

The proposed rule, commonly referred to as the Texas Risk Reduction Program rule, will establish a uniform set of risk-based performance-oriented technical standards to guide response actions at affected properties regulated via the agency's Office of Waste Management program areas and other applicable program areas. The rule will be promulgated as a new chapter (i.e., 30 Texas Administrative Code (TAC) Chapter 350). Currently, several different rules govern corrective actions, closures, and post-closure care within the agency's waste management programs. The State Superfund program, the Industrial and Hazardous Waste program, and the Voluntary Cleanup Program use the existing Risk Reduction Rule in 30 TAC Chapter 335, Subchapters A and S for risk-based corrective action. Any person who stores, processes or disposes of hazardous waste is also subject to the closure and post-closure care requirements in 30 TAC Chapter 335, Subchapters E and F. The Petroleum Storage Tank (PST) program uses 30 TAC Chapter 334, Subchapters D and G for risk-based corrective action. Corrective action and closure requirements for operating municipal solid waste landfills subject to federal Resource Conservation and Recovery Act Subtitle D requirements are found in 30 TAC Chapter 330. There are no specific corrective action requirements for other municipal landfills. Corrective action requirements for the Underground Injection Control program are found in 30 TAC Chapter 331, Subchapter C. Spill response actions regulated under 30 TAC Chapter 327 that will take longer than six months to complete follow the Risk Reduction Rule or the PST rule, whichever is appropriate for a particular release. 30 TAC Chapter 332, relates to Composting. 30 TAC Chapter 333, relates to the Brownfields Initiatives. 30 TAC Chapter 37 Subchapter N, relates to Financial Assurance Requirements for the Texas Risk Reduction Program rules.

Request for Proposals

Filing Authority. This Request for Proposals (RFP) Number 582-9-15891 is filed under the authority of Texas Government Code, Chapter 2254, Subchapter B.

Eligible Proposers. The Texas Natural Resource Conservation Commission (TNRCC) is requesting proposals from nonprofit organizations, institutions of higher education, private companies, individuals, regional education service centers, and other entities. Historically underutilized businesses (HUBs) and Texas vendors are encouraged to submit a proposal.

Description. The State Implementation Plan (SIP) process is the mechanism by which the TNRCC develops plans for bringing nonattainment areas into attainment with National Ambient Air Quality Standards (NAAQS). The state is held accountable for achieving the emissions reductions proposed under the plan. Unfortunately, the TNRCC does not currently have a reliable way to track those emissions reductions and relate them to the reductions required in the SIP. As the new NAAQS go into effect, additional areas will require SIPs, and this will further stress the TNRCC's data management systems and processes.

In order to reliably track SIP performance, a comprehensive emissions inventory database is needed which tracks point source, area source, and mobile source emissions as well as metadata about those emissions, such as calculation methodology and the source data for the calculations. This database would also need to track applicable SIP requirements for all categories of emissions. The State of Texas Air Reporting System (STARS) database, which tracks industrial point source emissions is under construction, but area and mobile source emissions are not centrally stored and managed. Instead, they are spread out over multiple formats on multiple personal computers. The dispersion of this data is increasing as emission inventory development is decentralized to the local air pollution groups. Having a comprehensive emissions inventory database which tracks SIP performance will enhance the TNRCC's ability to comply with existing United States Environmental Protection Agency requirements. More importantly, it will help the TNRCC to more effectively develop the emissions reduction strategies which are at the heart of our mission.

Developing this database will take several years and a significant investment of agency resources. Database development will proceed in a series of distinct projects. Each project will provide significant value to the agency. The first project will be to document, in detail, emissions inventory requirements and procedures and to compare these requirements and procedures with existing data systems to see if an existing system could suit some or all of these requirements or if a custom-developed system will be required. Formal, unambiguous documentation of business requirements is a necessary first step in the development of any data management system.

Payments to the proposer for services conducted under this RFP will be paid entirely from state monies appropriated through the Legislative Appropriation Request (LAR) process specifically for this purpose.

Dates of Contract. The contract period will be April 16, 1999 (anticipated) through August 31, 1999, assuming the TNRCC is given the authority to let this contract. Prior to awarding a contracts for consulting services, a state agency must receive a finding of fact from the Governor's Planning and Budget Office. At the time of this notice the TNRCC has applied for, but has not received, a finding of fact.

Selection Criteria. Proposer(s) will be selected based on the ability of the proposer to carry out all requirements contained in the RFP. The TNRCC will base its selection on, among other things, technical approach, past performance, qualifications, and the management plan of the proposer(s). The selection criteria and review process are specified in the RFP. The TNRCC reserves the right to select and negotiate from the highest ranking proposals the proposal that best addresses all requirements in the RFP.

The proposed project is needed to prevent thermal overload on the 138-kV transmission line between Buda and the Turnersville substations. Thermal overload on a transmission line produces line sagging that reduces allowable line-to-ground clearance, causing severe equipment damage and pose great danger to the general public.
