The Texas Juvenile Probation Commission adopts amended §349.107 concerning, Standards for Child Abuse and Neglect Investigations in Secure Juvenile Facilities. The amendments are adopted without changes to the proposed text as published in the December 25, 1998, issue of the Texas Register (23 TexReg 13025) and will not be republished.

TJPC adopts these rules in an effort to improve juvenile probation services in general and specifically to protect children during the investigation of child abuse or neglect.

The amended rules will function primarily, but not exclusively, by setting down minimum steps which must be followed during a Priority II investigation and by clarifying the conditions under which TJPC may administratively close an investigation of child abuse or neglect.

No public comments were received.

The amendments to this standard are adopted under §261.401(b) of the Family Code and §141.042 of the Texas Human Resource Code, which provides the Texas Juvenile Probation Commission with the authority to adopt reasonable rules, including those which provide uniform procedures for investigating child abuse and neglect and which provide minimum standards for juvenile boards.

No other code or article is affected by these new standards as adopted.
