Chapter 89. General Rules and Regulations

22 TAC §89.3, §89.12

The Texas Cosmetology Commission adopts the repeal of §89.3, concerning expiration of licenses and certificates, and §89.12, concerning display of rules and regulations as published in the March 12, 1999, issue of the Texas Register (24TexReg1723).

These rules are being repealed in accordance with HB1, of the General Appropriations Act, §167.

The repeal of these rules eliminate repetition of the commission's rules and regulations

No comments were received regarding the adoption of the repeals.

The repeals are adopted in accordance with Article 8451a, V.T.C.S.

This agency hereby certifies that the adoption has been reviewed by legal counsel and found to be a valid exercise of the agency's legal authority.

The Texas Cosmetology Commission adopts amendments to §89.6, concerning new locations and floor plans in schools, §89.8, concerning student registrations, §89.16, concerning license cancellation, §89.23, concerning transfer of hours between courses, §89.28, concerning withdrawal from school, §89.29, concerning practical application of the curriculum, §89.30, concerning examination applications, §89.32, concerning models for examination, §89.34, concerning applicants for license through reciprocity, §89.35, concerning uniforms, §89.36, concerning postmarks, §89.40, concerning cosmetology establishment transfers, §89.43, concerning items to be posted in salons or schools, §89.44, concerning salons in connection with other business, §89.47, concerning definition of a facial salon, §89.49, concerning definition of a manicure specialty salon, §89.53, concerning minimum requirements for public and private cosmetology schools, §89.74, concerning continuing education, §89.75, concerning field trip hours, without changes, §89.72, concerning cosmetology curriculums, with changes (the text will be republished), and adopts new §89.41, concerning change of location, and §89.52, concerning definition of a complaint without changes to the proposed text as published in the February 19, 1999, issue of the Texas Register (24 TexReg 1105).

These rules are being amended in accordance with House Bill 1, of the General Appropriations Act, §167.

These rules will define and clarify regulations and procedures for licensees of the cosmetology industry.

No comments were received regarding the adoption of the amendments and new sections.

The amendments and new sections are adopted in accordance with Article 8451a, V.T.C.S., which provides the commission with the authority to "issue rules consistent with this Act", to protect the public's health and safety.

§89.72. Curriculum Posted.

The curriculum listed has been established by the Texas Cosmetology Commission and must be followed by all cosmetology schools. The curriculum shall be posted in a conspicuous place in the school. A current syllabus and lesson plans for each course shall be maintained by the school and be available for inspection. Operator Curriculum:

Private, Public Post-Secondary Cosmetology Schools, and Adult Education Programs:

(A)

orientation and T.C.C. Rules and Regulations--100 hours;

(B)

shampoo and related theory--100 hours;

(C)

hair and scalp treatment and related theory--50 hours;

(D)

cold waving and related theory--200 hours;

(E)

chemical hair relaxing and related theory--50 hours;

(F)

hair coloring and related theory--200 hours;

(G)

manicuring and related theory--100 hours;

(H)

facials and related theory--50 hours;

(I)

haircutting, styling and related theory--500 hours;

(J)

Chemistry-75 hours;

(K)

Salon Management and Practices-75 hours; Total: 1,500 hours.

Public Secondary Program for High School Students: The Principal or Program Administrator must certify that each student has successfully completed 1,000 clocked cosmetology hours before 500 academic hours can be granted by the Texas Cosmetology Commission for successfully passing academically approved courses to include math, lab science and English:
