Notice and Opportunity to Comment on Requests for Consistency Agreement/Concurrence under the Texas Coastal Management Program

On January 10, 1997, the State of Texas received federal approval of the Coastal Management Program (CMP) (62 Federal Register pp. 1439-1440). Under federal law, federal agency activities and actions affecting the Texas coastal zone must be consistent with the CMP goals and policies identified in 31 TAC §501. Requests for federal consistency review were received for the following projects(s) during the period of December 30, 1999, through January 6, 1999:

FEDERAL AGENCY ACTIONS:

Applicant: Exxon Pipeline Company; Location: The project will be located on an industrial site owned by Brazos River Harbor Navigation District, southeast of the Gulf Intracoastal Waterway (GIWW) and south of the Brazos River Channel into Brazos Harbor, northwest of Quintana, Brazoria County, Texas; Project No.: 99-001-F1; Description of Proposed Action: The applicant proposes to construct a pipeline station facility and install two oil pipelines that will connect the station with an existing pipeline facility on the north bank of the GIWW. A total of 2.5 acres of wetlands will be permanently filled for the proposed pipeline station to raise the ground elevation for levees, tanks, dikes, and equipment. A total of 16,570 cubic yards of sediment will be obtained from a Port of Freeport Disposal Area to use as fill material, of which, 2,340 cubic yards will be placed in a jurisdictional area. An additional 3.5 acres of wetlands temporarily impacted by construction activities will be returned to pre-project contours upon project completion. The purpose of the project is to transfer oil piped in from the Diana/Hoover Deep Draft Caisson Vessel located offshore in Alaminos Canyon, Area Block 25, Gulf of Mexico for delivery to refineries. As mitigation for the proposed impacts to 6 acres of wetlands, the applicant proposes to finance a project to construct two moist soil unit, 5 and 10 acres respectively, on the Peach Point Wildlife Management Area. The purpose of the project is to study different management techniques in order to provide high quality wetland habitat for wintering waterfowl and other wetland dependent wildlife; Type of Application: U.S.A.C.E. permit application #21525 under §10 of the Rivers and Harbors Act of 1899 (33 U.S.C.A. 403), and §404 of the Clean Water Act (33 U.S.C.A. §§125-1387).

Applicant: Port of Corpus Christi; Location: The project is located within Corpus Christi Bay on both sides of the Corpus Christi Ship Channel from Corps of Engineers Station 1065+00 to Station 539+00; Project No.: 99-002-F1; Description of Proposed Action: The applicant proposes to create barge shelves to separate barge and deep draft vessel traffic to improve navigation safety through reduction of the risk of barge - ship collision and for environmental protection by reducing potential for collision related spill and releases. The barge shelves will be created primarily by the relocation of navigation aids (by the U.S. Coast Guard) and by dredging material on the far east and west end of the proposed project. Approximately 160,000 cubic yards of virgin material may be dredged. Approximately 153,000 cubic yards of virgin material will be hydraulically dredged on the east end of the project and placed in Dredged Material Placement Area No. 10. The remaining 7,000 cubic yards of virgin material will consist of the distribution of existing/minor shoals within the barge shelf area. Maintenance dredging is also proposed for the project. The highest probabilities for maintenance dredging will be potential shoaling areas on the east and west ends where the new work is proposed; Type of Application: U.S.A.C.E. permit application #21527 under §10 of the Rivers and Harbors Act of 1899 (33 U.S.C.A. 403), and §404 of the Clean Water Act (33 U.S.C.A. §§125-1387).

Applicant: Texas Parks and Wildlife Department; Location: The project is located in West Galveston Bay, in Carancahua and Dana Coves, and Pirate's Cove, near Jamaica Beach, Galveston County, Texas. The USGS Quad reference map is Lake Como, TX; Project No.: 99-003-F1; Description of Proposed Action: The applicant is requesting authorization to place 13,500 linear feet of sediment-filled geotextile tubes (geotubes) to create a protective breakwater. The geotubes will be placed over 20-foot-wide mats anchored by smaller geotubes. Borrow areas will be located immediately bayward of the geotubes. Approximately 20,250 cubic yards of material will be borrowed to fill the geotubes. The geotubes will be filled by hydraulic dredge or pump. Landward of the geotubes the applicant is proposing to construct 4 marsh terrace (levee) fields. Each field will consist of 133 individual terrace squares, 83 of which will measure 200-foot by 200-foot, 40 of which will measure 100 by 100-foot and 10 of which will measure 400 by 400-foot. A total of 54,180 linear feet of terrace levees will be constructed. Approximately 80,000 cubic yards of material will be removed from borrow areas adjacent to the proposed terraces. In addition, the applicant is proposing to dredge the entrance and circulation channels at Pirate's Cove. Approximately 18,000 cubic yards of material will be removed from 4,500 linear feet of existing channel. The material will be deposited to create marsh islands, in the shallow unvegetated flats landward of the easternmost geotube; Type of Application: U.S.A.C.E. permit application #21456 under §10 of the Rivers and Harbors Act of 1899 (33 U.S.C.A. 403), and §404 of the Clean Water Act (33 U.S.C.A. §§125-1387).

Applicant: DAD & SBD Interests Ltd.; Location: The project site is located in the southwest corner of the intersection of FM 528 and FM 518 and on the north side of Chigger Creek, Woodlake Subdivision, Friendswood, Galveston County, Texas. The USGS Quad reference map is Friendswood, Texas; Project No.: 99-004-F1; Description of Proposed Action: The applicant proposes to fill wetlands adjacent to Chigger Creek in order to develop a 57-acre tract of land for residential housing. Three separate wetlands, 0.14, 0.15, and 0.14 acre in size, will be filled causing a total of 0.43 acre of wetland impact. These wetlands are designated as "B", "C", and "F", respectively, on the project plans. Fill material will be obtained from on-site sources or from approved off-site supplies. Best management practices will be used to minimize silt runoff. Remaining wetlands and property along Chigger Creek that will not be developed will be deeded to the Galveston County Drainage District. These wetlands are designated as "A", "D", "G", and "H" on the project plans. As mitigation for this project, the applicant proposes an in lieu fee arrangement with the Texas Nature Conservancy (TNC) to enhance 350 acres of freshwater wetlands by Chinese tallow tree eradication on a 2,200-acre site owned by TNC near Texas City, Texas; Type of Application: U.S.A.C.E. permit application #21474 under §404 of the Clean Water Act (33 U.S.C.A. §§125-1387).

Applicant: Park 15 Partnership; Location: The project is located at 2800 F.MK. 2004, near Interstate 45, Texas City, Galveston County, Texas. The USGS Quad reference map is Texas City. Project No.: 99-005-F1; Description of Proposed Action: The applicant is requesting authorization to fill five isolated wetlands totaling 1.47 acres, on a 16.89-acre tract of land. The purpose of the proposed work is for the development of a multi-family apartment complex. As mitigation for wetland impacts, the applicant is proposing to create 1.5 acres of herbaceous wetland adjacent to an existing 0.46-acre depressional wetland and enhancement and preservation of 1.75 acres of existing wetlands. The mitigation site is located in Jack Brooks Park, off Highway 6, Galveston County, Texas; Type of Application: U.S.A.C.E. permit application #21484 under §404 of the Clean Water Act (33 U.S.C.A.§§125-1387).

Applicant: Port of Brownsville; Location: The project is located adjacent to the Rio Grande River at river mile 24, approximately one mile south of the Brownsville Ship Channel near Brownsville, Cameron County, Texas; Project No.: 99-006-F1; Description of Proposed Action: The applicant requests an extension of time for Permit 20221. The applicant proposes to place fill in wetlands to facilitate the construction of a two lane roadway connecting a proposed commercial vehicle bridge with the existing South Port Road, a single set of rail tracks and passing track connecting a proposed rail bridge to the railroad tracks adjacent to the Brownsville Ship Channel and South Port Road, and toll collection facilities. The road to be constructed from the bridge to the port facilities would consist of two 12-foot lanes with two 10-foot shoulders and would be approximately 16,000 feet long. The railway would be constructed directly adjacent to the road and would be 15-foot wide with 5-and 10-foot shoulders. Drainage structures consisting of 4-by 6-foot box culverts will be placed at 100-meter centers along the roadway in order to facilitate drainage during flood events. The roadway will impact 12.77 acres of wetlands located north of State Highway 4 on the subject tract. The applicant proposes to offset these impacts by enhancing and creating approximately 60.6 acres of wetlands adjacent to a tidally influenced lake (San Martin Lake) approximately 5 miles northeast of the project site; Type of Application: U.S.A.C.E. permit application #20221(01) under §10 of the Rivers and Harbors Act of 1899 (33 U.S.C.A. 403), and §404 of the Clean Water Act (33 U.S.C.A.§§125-1387).

Correction of Error

The Texas Department of Health proposed new rule for 25 TAC §289.255. The rule was published in the December 4, 1998 issue of the Texas Register (23 TexReg 12127).

On page 12132, §289.255(n)(2), paragraph (2) was split after the word paragraph, and should read “(2) Records of the administration of and the examinations required by paragraph (1) of this subsection shall be made and maintained for agency inspection in accordance with subsection (w)(7) of this section.”

The Texas Department of Health has taken actions regarding licenses for the possession and use of radioactive materials as listed in the table below. The subheading labeled “Location” indicates the city in which the radioactive material may be possessed and/or used. The location listing “Throughout Texas” indicates that the radioactive material may be used on a temporary basis at job sites throughout the state.

In issuing new licenses and amending and renewing existing licenses, the Texas Department of Health, Bureau of Radiation Control, has determined that the applicants are qualified by reason of training and experience to use the material in question for the purposes requested in accordance with Texas Regulations for Control of Radiation in such a manner as to minimize danger to public health and safety or property and the environment; the applicants' proposed equipment, facilities, and procedures are adequate to minimize danger to public health and safety or property and the environment; the issuance of the license(s) will not be inimical to the health and safety of the public or the environment; and the applicants satisfy any applicable special requirements in the Texas Regulations for Control of Radiation.

This notice affords the opportunity for a hearing on written request of a licensee, applicant, or “person affected” within 30 days of the date of publication of this notice. A “person affected” is defined as a person who is resident of a county, or a county adjacent to the county, in which the radioactive materials are or will be located, including any person who is doing business or who has a legal interest in land in the county or adjacent county, and any local government in the county; and who can demonstrate that he has suffered or will suffer actual injury or economic damage due to emissions of radiation. A licensee, applicant, or “person affected” may request a hearing by writing Richard A. Announcement of the Public Comment Period for the 1999 State of Texas Low Income Housing Plan and Annual Report-Draft for Public Comment

The Texas Department of Housing and Community Affairs (TDHCA) announces the opening of the public comment period for the 1999 State of Texas Low Income Housing Plan and Annual Report-Draft for Public Comment . This 31-day comment period begins on January 26, 1999, and ends at 12:00 p.m. February 25, 1999. The 1999 State of Texas Low Income Housing Plan and Annual Report-Draft for Public Comment is submitted in compliance with Sections 2306.0721-2306.0723 of the Government Code.

The 1999 State of Texas Low Income Housing Plan and Annual Report-Draft for Public Comment is one of three comprehensive planning documents that TDHCA is required to submit annually. It is the first document of its kind among the states and offers policymakers and housing providers a comprehensive reference on statewide housing need, housing resources and performance based funding allocations. The 1999 State of Texas Low Income Housing Plan and Annual Report-Draft for Public Comment serves in the following capacities: provides an overview of statewide housing needs; reports on the approximately 25 programs administered by TDHCA; provides the TDHCA's housing programs funding levels and performance measures; and reports on the distribution of TDHCA's resources in the previous fiscal year.

Eight public hearings will be held across the State during the second and third weeks of February. The hearings will take place in: Dallas, El Paso, Houston, San Antonio, Harlingen, Lubbock, Corpus Christi, and Austin . Times and locations of the public hearings will be published in the January 22, 1999 issue of the Texas Register .

Texas Lottery Commission

Request for Proposal

The Texas Lottery Commission is issuing a Request for Proposals for Instant Ticket Vending Machines ("ITVMs"). For the purpose of the RFP, an instant ticket vending machine is described as a ticket dispensing machine that dispenses instant tickets to Texas Lottery players without the assistance of retailers' personnel.

As a part of the RFP, the Texas Lottery will conduct a test of up to 6 weeks to determine the mechanical reliability and player acceptance of ITVMs, under actual operating conditions. The Texas Lottery may decide, based on its evaluation, that it is not in the best interest of the state to issue a contract under the RFP.

Final Notice of Deletion of State Marine State Superfund Site

The executive director of the Texas Natural Resource Conservation Commission (TNRCC) by this notice is issuing a public notice of deletion (delisting) of a facility from the state registry (state Superfund registry) of sites which may constitute an imminent and substantial endangerment to public health and safety or the environment due to a release or threatened release of hazardous substances into the environment.

The site which has been deleted is the State Marine state Superfund site which was originally placed on the state Superfund list in January 1987. The site is on Pleasure Islet, on Old Yacht Club Road, in the city of Port Arthur, Jefferson County, Texas.

This notice is issued to finalize the deletion process which began on November 20, 1998, when the executive director of the TNRCC issued a public notice in the Texas Register (23 TexReg 11859) of TNRCC's intent to delete the State Marine site from the state Superfund registry, following the determination made pursuant to the Texas Health and Safety Code §361.183(d) that the site has been accepted under the Federal Superfund program and was thereby eligible for deletion. The notice further indicated that the TNRCC shall hold a public meeting, as required by 30 TAC §335.344(b), if a written request is filed with the executive director of the TNRCC within 30 days, challenging the determination by the executive director made pursuant to the Texas Health and Safety Code §361.183(d). Equivalent publication of the notice was also published in the November 20, 1998 edition of the Port Arthur News .

The TNRCC did not receive a request for a public meeting from the potentially responsible parties or any interested persons during the request period (within 30 days of the publication of notice), therefore, the State Marine state Superfund site is hereby deleted from the Texas state Superfund registry. Notice of Application and Notice of Administrative Completeness on the Application for Standby Fees, Impact Fees, and/or District Creations

The following standby fee notice was issued on January 5, 1999, pursuant to Chapter 49 of the Texas Water Code and 30 TAC Chapter 293. The purpose of standby fees is to distribute a fair portion of the cost burden for operation and maintenance of the District facilities and/or for financing capital costs of the District facilities to owners of property who have not constructed vertical improvements but have water, wastewater or drainage facilities or capacity available. The Commission may approve the annual standby fees as requested, or it may approve a lower annual standby fee, but it shall not approve an annual standby fee greater than that requested. The standby fee is a personal obligation of the person owning the undeveloped property on January 1 of the year for which the fee is assessed. A person is not relieved of his pro-rated share of the standby fee obligation on transfer of title to the property. On January 1 of each year, a lien is attached to the undeveloped property to secure payment of any standby fee imposed and the interest or penalty, if any, on the fee. The lien has the same priority as a lien for taxes of the District.

FAYETTE COUNTY WATER CONTROL AND IMPROVEMENT DISTRICT-MONUMENT HILL; application to adopt and impose a quarterly standby fee of $18.00 per equivalent single family connection for calendar years 1999-2001, on unimproved property within the District.

The following notice for creation of a new district was issued on December 10, 1998, pursuant to Article XVI, Section 59 of The Constitution of the State of Texas, Chapter 49 and 54 of the Texas Water Code, and 30 Texas Administrative Code Chapter 293.12.

The Texas Department of Protective and Regulatory Services announces a request for proposal (RFP) for "Community Youth Development (CYD) Teen Summit" for youth active in their local CYD Youth Advisory Committee, in the State of Texas.

The "Community Youth Development (CYD) Teen Summit" is to be provided for youth, ages 12 to 17, with emphasis on youths ages 13 to 16, to develop their leadership skills and develop a plan for their local Youth Advisory Committee. The CYD Teen Summit should be designed to strengthen the foundation for local Youth Advisory Committees and participants should learn leadership skills, develop youth-adult partnerships, and create a plan to take back to their committee and to strengthen their local Youth Advisory Committees.

Eligible Offerors: Eligible offerors, are public or private non-profit agencies, with demonstrated knowledge, competence, and qualifications in delivering similar statewide services. Eligible offerors who may also be Historically Underutilized Businesses, Minority, Women, and Small Business Enterprises, are encourage to apply.

Amount of Award: The maximum amount for an initial contract awarded under this RFP shall not exceed $ 80,000.

Term: Any contract awarded under this RFP will be for a five month period, beginning April 1, 1999 and ending August 31, 1999.

Public Notice of Amendment to Interconnection Agreement

On December 22, 1998, Southwestern Bell Telephone Company and Sprint Communications Company, L.P., collectively referred to as applicants, filed a joint application for approval of an amendment to an existing interconnection agreement under §252(i) of the federal Telecommunications Act of 1996, Public Law Number 104-104, 110 Statute 56, (codified as amended in scattered sections of 15 and 47 United States Code) (FTA) and the Public Utility Regulatory Act, Texas Utilities Code Annotated §§11.001-63.063 (Vernon 1998) (PURA). The joint application has been designated Docket Number 20278. The joint application and the underlying interconnection agreement are available for public inspection at the commission's offices in Austin, Texas.

The commission must act to approve the interconnection agreement within 35 days after it is submitted by the parties.

The commission finds that additional public comment should be allowed before the commission issues a final decision approving or rejecting the amendment to the interconnection agreement. Any interested person may file written comments on the joint application by filing 13 copies of the comments with the commission's filing clerk. Additionally, a copy of the comments should be served on each of the applicants. The comments should specifically refer to Docket Number 20278. As a part of the comments, an interested person may request that a public hearing be conducted. The comments, including any request for public hearing, shall be filed by January 25, 1999, and shall include:

1) a detailed statement of the person's interests in the agreement, including a description of how approval of the agreement may adversely affect those interests;

2) specific allegations that the agreement, or some portion thereof:

a) discriminates against a telecommunications carrier that is not a party to the agreement; or

b) is not consistent with the public interest, convenience, and necessity; or

c) is not consistent with other requirements of state law; and

3) the specific facts upon which the allegations are based.

After reviewing any comments, the commission will issue a notice of approval, denial, or determine whether to conduct further proceedings concerning the joint application. The commission shall have the authority given to a presiding officer pursuant to P.U.C. Procedural Rule §22.202. The commission may identify issues raised by the joint application and comments and establish a schedule for addressing those issues, including the submission of evidence by the applicants, if necessary, and briefing and oral argument. The commission may conduct a public hearing. Interested persons who file comments are not entitled to participate as intervenors in the public hearing.

Request for Proposals for Regional Facility Planning

The Texas Water Development Board (Board) requests, pursuant to 31 Texas Administrative Code (TAC) Chapter 355, Subchapter A, as amended, the submission of planning proposals leading to the possible award of contracts for regional facility planning. This planning will evaluate and determine the most feasible alternatives to meet water supply and/or wastewater facility needs, estimate the costs associated with implementing feasible water supply and/or wastewater facility alternatives, and identify institutional arrangements to provide water supply and/or wastewater services for areas in Texas. In order to receive a grant, the applicant must have the authority to plan, implement, and operate regional water supply and/or wastewater facilities.

Planning applications may be submitted by eligible political subdivisions from any area of the State. To be eligible for funding at least two political subdivisions must participate in the proposed study and more than one service area must be evaluated for feasibility of regional facilities. In addition, applicants must supply a map of the geographical planning area to be studied.

Description of Planning Purpose and Objectives. Note: Studies related to the development of regional water supply plans, the evaluation of water supply alternatives, and drought response plans as defined in Senate Bill 1, 75th Session, Texas Legislature are not eligible for funding under this Request for Proposals. The purpose of this program is for the State to assist local governments to prepare plans that document water supply and/or wastewater service facility needs, identify feasible regional alternatives to meet water supply and/or wastewater facility needs, and present estimates of costs associated with providing regional water supply facilities and distribution lines and/or regional wastewater treatment plants and collection systems. A water conservation plan and a drought management plan must be developed to ensure that existing and future sources are used efficiently and as a basis for confirming demand projections of future need. The Board's population and water demand projections will be considered in preparing projections.

Discrete phases to implement regional water supply and/or wastewater facilities to meet projected needs will be identified. Cost estimates will be made for each respective implementation phase to determine the capital, operation, and maintenance requirements for a 30-year planning period. Separate cost estimates will be made for each regional water supply and/or wastewater system component, including the water conservation program.

Description of Funding Consideration. Up to $600,000 has been initially authorized for FY 99 assistance for regional facility planning from the Board's research and planning fund. Up to 50 percent funding may be provided to individual applicants, with up to 75 percent funding available to areas identified in 31 TAC §355.10(a), as amended, as economically disadvantaged. In the event that acceptable proposals are not submitted, the Board retains the right to not award contract funds.

Ten double-sided copies on recycled paper of a complete regional facility planning grant application including the required attachments must be filed with the Board prior to 5:00 p.m., February 25, 1999.
