3. Seasons and Bag Limits-Fishing Provisions
31 TAC §65.72
The Texas Parks and Wildlife Department adopts, on an emergency
basis, an amendment to §65.72, concerning Fish. The emergency action
is necessary to modify the state's coastal fisheries regulations to conform
with federal regulations in the Exclusive Economic Zone of the Gulf of Mexico.
The emergency action will function to reduce the bag limit for red snapper
from five fish per day to four fish per day. The section is adopted on an
emergency basis to prevent an imminent threat to the welfare of fisheries
resources and to protect those resources for the benefit of the citizens of
this state.
The amendment is adopted on an emergency basis under Parks and
Wildlife Code, Chapter 61, which authorizes the commission to regulate the
periods of time for taking or possessing aquatic animal life, the means and
methods for the take of aquatic animal life, and the places, species, quantity,
and the age or size of aquatic animal life that may be taken or possessed;
and under Chapter 79, which authorizes the department to take immediate action
as necessary to modify coastal fisheries regulations to provide for consistency
with federal regulations in the Exclusive Economic Zone.
