In accordance with Chapter 2167, §2167.054, Texas Government Code, the Texas Alcoholic Beverage Commission is requesting written proposals for lease space for the agency's Dallas Regional Office. The lease space will consist of approximately 4,450 net usable square feet. The space must be contiguous; easily accessible to a major freeway or traffic artery; be located in the Dallas metropolitan area; and be within an area beginning at the intersection of Highway 30 and Highway 35, north on Highway 35 to Royal Lane, east on Royal Lane to Highway 75, south on Highway 75 to Highway 30 and wet on Highway 30 to the point of origination. The term of the lease will be September 1, 1999 through August 31, 2004.

The Brazos Valley Workforce Development Board is submitting the CY99 Program Plan to the Texas Workforce Commission for review, comment, and approval for funding under authority of the Job Training Partnership Act and the Job Training Reform Amendments of 1992.

The Title IIB Summer Youth Employment and Training Program (SYETP) is available to economically disadvantaged youth age 14-21 living in one of the following Brazos Valley counties: Brazos, Burleson, Grimes, Leon, Madison, Robertson, and Washington. Approximately 300 youth will be provided education and work experience. Available activities under the CY99 Title IIB program include:

Notice and Opportunity to Comment on Requests for Consistency Agreement/Concurrence under the Texas Coastal Management Program

On January 10, 1997, the State of Texas received federal approval of the Coastal Management Program (CMP) (62 Federal Register pp. 1439-1440). Under federal law, federal agency activities and actions affecting the Texas coastal zone must be consistent with the CMP goals and policies identified in 31 TAC, Chapter 501. Requests for federal consistency review were received for the following project(s) during the period of January 22, 1999, through January 29, 1999:

FEDERAL AGENCY ACTIONS:

Applicant: Villa By the Sea, L.L.C.; Location: The project is located on Galveston Bay, at 3300 Todville Road, Lots 34, 36, 40, and 41, in Seabrook, Harris and Chambers Counties, Texas; Project Number: 99-023-F1; Description of Proposed Action: Department of the Army Permit Number 20533 was issued to Hank Fuller and was transferred to Villa By the Sea on 29 October 1998. The current permittee requests an amendment to the existing permit. Permit 20533 provided authorization to construct a pier, 800 feet long by 4 feet wide, with an 8 by 30-foot T-head. In addition, the permit authorized the placement of 415 cubic yards of concrete riprap along 250 feet of an existing wooden bulkhead, 20 cubic yards of concrete riprap under the new pier T-head, and approximately 2,500 cubic yards of clean fill into an existing 375-by 60-foot manmade pond. The permitee is requesting to amend the existing permit to authorize the expansion of the pier to 800 feet long by 5 feet wide and the T-head to 20 by 30 feet. In addition, the permittee is requesting to increase the volume of riprap to approximately 1,500 cubic yards along 270 feet of existing bulkhead, with a new configuration of 30 feet into the water and not to exceed 10 feet high with an approximate 3:1 face slope. All other aspects of the work would remain the same; Type of Application: U.S.A.C.E. permit application #20533(01) under §10 of the Rivers and Harbors Act of 1899 (33 U.S.C.A. 403), and §404 of the Clean Water Act (33 U.S.C.A. §§125-1387).

Pursuant to §306(d)(14) of the Coastal Zone Management Act of 1972 (16 U.S.C.A. §§1451-1464), as amended, interested parties are invited to submit comments on whether a proposed action is, or is not consistent with the Texas Coastal Management Program goals and policies, and whether the action should be referred to the Coastal Coordination Council for review. Notice of Issuance of Request for Proposals: Pursuant to Chapter 2254, Subchapter B, Texas Government Code, the Comptroller of Public Accounts (Comptroller) announces the reissuance of its Request for Proposals (RFP) for the purpose of hiring a consultant to assist in conducting a management and performance review of the Killeen Independent School District (Killeen ISD). From this review, findings and recommendations will be developed for containing costs, improving management strategies, and ultimately promoting better education for Texas children through school district management efficiency. The successful proposer or proposers will be expected to begin performance of the contract on or about April 12, 1999.

The Comptroller reserves the right to accept or reject any or all proposals submitted. The Comptroller of Public Accounts is under no legal or other obligation to execute a contract on the basis of this notice or the distribution of an RFP. Neither this notice nor the RFP commits the Comptroller to pay for any costs incurred prior to the execution of a contract.

Request for Proposal

In accordance with §4 of Article 3.50-2, Texas Insurance Code, the Employees Retirement System of Texas (ERS) is issuing a Request for Proposal (RFP) from qualified Dental Health Maintenance Organizations (DHMOs) to provide services under the Texas Employees Uniform Group Insurance Program (UGIP) beginning September 1, 1999. The locations in Texas for which proposals may be made are included in the RFP. DHMOs must provide the level of benefits required in the RFP and meet other requirements, specified herein.

Carriers wishing to respond to this request must: 1) be certified by the Texas Department of Insurance, 2) have been providing dental managed care services in the service area for which the proposal is made, and 3) demonstrate that it has a provider network in the proposed service area, as of the due date of the proposal, to provide adequate dental care to UGIP participants. The contract is a separate document from the RFP and must be taken separately from the ERS' website. The contract must be signed and returned with the carrier's response.

The RFP will be available the week of February 8, 1999 from the ERS' website. To access the RFP from the website, interested carriers must either fax their request on their company letterhead to the attention of Kim Johnson at (512) 867-7380, or send their request via email to kjohnson@ers.state.tx.us to receive their access code. An email request must include the name of the carrier, street address, phone number, fax number, and email address (if applicable).

The deadline for ERS' receipt of three (3) complete copies of the carrier's proposal and the original signed contract is 5:00 p.m., C.S.T., on March 8, 1999.

The ERS reserves the right to reject any or all proposals submitted when it is determined that such action would be in the best interest of the UGIP. The ERS is under no legal requirement to execute a resulting contract on the basis of this advertisement.

The ERS will base its evaluation and selection of carriers on factors including, but not limited to the following, which are not necessarily listed in order of priority: compliance with the RFP, operating requirements, cost impact on the UGIP, coverage of the service area counties, provider networks, quality of networks, administrative capabilities, and prior experience contracting with the ERS.

This application does not commit the ERS to pay any costs incurred prior to execution of a contract. Issuance of this material in no way obligates the ERS to award a contract or to pay any costs incurred in the preparation of a response. The ERS specifically reserves the right to vary all provisions set forth at any time prior to execution of a contract where the ERS deems it to be in the best interest of the UGIP.

The location listing “Throughout Texas” indicates that the radioactive material may be used on a temporary basis at job sites throughout the state.

In issuing new licenses and amending and renewing existing licenses, the Texas Department of Health, Bureau of Radiation Control, has determined that the applicants are qualified by reason of training and experience to use the material in question for the purposes requested in accordance with Texas Regulations for Control of Radiation in such a manner as to minimize danger to public health and safety or property and the environment; the applicants' proposed equipment, facilities, and procedures are adequate to minimize danger to public health and safety or property and the environment; the issuance of the license(s) will not be inimical to the health and safety of the public or the environment; and the applicants satisfy any applicable special requirements in the Texas Regulations for Control of Radiation.

This notice affords the opportunity for a hearing on written request of a licensee, applicant, or “person affected” within 30 days of the date of publication of this notice. A “person affected” is defined as a person who is resident of a county, or a county adjacent to the county, in which the radioactive materials are or will be located, including any person who is doing business or who has a legal interest in land in the county or adjacent county, and any local government in the county; and who can demonstrate that he has suffered or will suffer actual injury or economic damage due to emissions of radiation. A licensee, applicant, or “person affected” may request a hearing by writing Richard A. Notice of Emergency Cease and Desist Order on John H. Smith, M.D.

Notice is hereby given that the Bureau of Radiation Control (bureau), Texas Department of Health (department), ordered John H. Smith, M.D. (registrant-R17959) of Houston to cease and desist performing Chest PA (non grid) procedures with the Continental x-ray unit (Model Number 6621.201, Serial Number 749211) until the exposures at skin entrance meet the Texas radiation requirements. The bureau determined that continued radiation exposure to patients in excess of that required to produce a diagnostic image constitutes an immediate threat to public health and safety, and the existence of an emergency. The order will remain in effect until the registrant has received authorization from the bureau to perform the procedure.

Notice of Prepaid Health Plan Procurement

The Texas Department of Health (department), Bureau of Managed Care, announces the opportunity for qualified entities to contract with the department under a Prepaid Health Plan (PHP) managed care model for the El Paso service area in the Texas Medicaid Managed Care Program (STAR Program).

The scope of services in the PHP model include physician, lab and x-ray services. Prepaid Health Plans will operate within the Texas Health Network (THN), which is the state administered Medicaid managed care plan. Birch & Davis Health Management Corporation is under contract with the department as the Plan Administrator for THN, and will provide quality assurance, member services, and utilization management, and claims payment for services which are not included in the PHP scope of services to THN members.

Eligibility: Qualified entities must have authority to conduct business in the State of Texas; be enrolled as providers in the Texas Medical Assistance Program (Medicaid); comply with all state and federal Medicaid laws, rules and regulations; and have the ability to perform all services and functions included in the Texas Department of Health and Prepaid Health Plan Contract for Services (TDH/PHP Contract). The TDH/PHP Contract is a non-negotiable contract and entities must be capable of performing the contract as proposed.

Timetable: The department will release and make the TDH/PHP Contract available to interested parties on February 8, 1999. Entities who believe they can comply with each of the TDH/PHP contract requirements, and wish to contract with the department must submit a Letter of Intent to the department not later than 5:00 p.m. Central Standard Time, on February 22, 1999. Letters of Intent may be mailed, submitted by facsimile or delivered in person to the address or facsimile number listed below. The department will perform a readiness review of interested entities to determine whether they can comply with the TDH/PHP contract requirements. Entities who are found to qualify for a TDH/PHP Contract will be offered a contract. The expected date for execution of TDH/PHP contracts is April 1, 1999. Implementation of managed care in the El Paso service area is scheduled to begin on December 1, 1999.

Correction of Error

The Motor Vehicle Board adopted amendments to §105.4 and §105.32. The rules appeared in the December 4, 1998, issue of the Texas Register (23 TexReg 12300).

Due to Motor Vehicle Board staff error, on page 12300, changes to §105.32(a)(2), allowing 15 days instead of 6 days to correct an offending advertisement, were not inserted. The section should read, “that the licensee committed a subsequent violation of the same advertising provision within the period beginning 15 days and ending 12 months after the licensees has received the notice required by paragraph (1) of this subsection.”

Notice of District Petition

The following notice was issued on January 27, 1999, pursuant to 30 Texas Administrative Code Chapter 293; Texas Water Code Chapters 49, and 54; and Article XVI, Section 59 of the Constitution of the State of Texas.

A petition has been filed for creation of EAGLE MOUNTAIN MUNICIPAL UTILITY DISTRICT of Tarrant County. The proposed District shall contain approximately 457.41 acres located within Tarrant County, Texas, and within the extraterritorial jurisdiction of the city of Fort Worth, Texas. According to the petition, a preliminary investigation has been made to determine the cost of the project, and it is estimated by the petitioners, from the information available at this time, that the cost of said project will be approximately $18,650,000.

If a written hearing request is not filed during the 30-day comment period, which extends from the day after the date of the second newspaper publication, the Executive Director may approve the above petition. To request a contested case hearing, you must submit the following: (1) your name (or for a group or association, an official representative), mailing address, daytime phone number, and fax number, if any; (2) the name of the applicant and the TNRCC Internal Control No.; (3) the statement "I/we request a public hearing"; and (4) a brief description of how you would be adversely affected by the granting of the request in a way not common to the general public. You may also submit your proposed adjustments to the petition which would satisfy your concerns.

If a hearing request is filed, the Executive Director will not approve the petition and may forward the petition and hearing request to the TNRCC Commissioners for their consideration at a scheduled Commission meeting. If a contested case hearing is held, it will be a legal proceeding similar to a civil trial in state district court.

Notice of Opportunity to Comment on Settlement Agreements of Administrative Enforcement Actions

The Texas Natural Resource Conservation Commission (TNRCC or commission) Staff is providing an opportunity for written public comment on the listed Agreed Orders (AOs) pursuant to Texas Water Code (the Code), §7.075, which requires that the TNRCC may not approve these AOs unless the public has been provided an opportunity to submit written comments. Section 7.075 requires that notice of the proposed orders and of the opportunity to comment must be published in the Texas Register no later than the 30th day before the date on which the public comment period closes, which in this case is March 14, 1999 . HAMMOND MOUND UTILITIES, INC., P.O. The Permian Basin Workforce development Board is submitting the CY'99 Program Plan for the employment and training program to the Texas Workforce Commission for review, comment, and approval for funding under the Job Training Partnership Act and the Job Training Reform Amendments of 1992.

The Title II-B Summer Youth Employment and Training Program (SYETP) is available to youth age 14 -21 who are economically disadvantaged (persons whose family income meets certain minimum levels set by the Federal government). Approximately 660 youth will be provided education and work experience through funds totaling approximately $1,211,904.

Persons served by these programs must live in one of the following Permian Basin counties: Andrews, Borden, Crane, Dawson, Ector, Gaines, Glasscock, Howard, Loving, Martin, Midland, Pecos, Reeves, Terrell, Upton, Ward, Winkler.

Request for Proposal

The Texas Department of Protective and Regulatory Services (TDPRS) is releasing a Request for Proposals (RFP) to solicit proposals for service contracts to be awarded under the Department's Services to At-Risk Youth (STAR) program.

The STAR program is designed to reduce and prevent problems of running away, truancy, abandonment, juvenile delinquency, and family conflict through the provision of timely and appropriate short term services to eligible youth and their families. The goal of the STAR program is to stabilize families and enable at-risk youth to remain in their own homes.

Eligible Clients: At-Risk Youth - Youth aged 7-17 who meet one of the following criteria: runaway youth (includes abandoned youth); truant youth; youth experiencing family conflict. Delinquent Youth: seven to nine year olds involved in delinquent offenses; youth aged 10-16 who have allegedly committed a misdemeanor or state jail felony and who have not been adjudicated delinquent by the court; a pre-adjudicated or deferred adjudicated youth is eligible for services.

Services to be provided include outreach, intake/assessment, crisis intervention, short term counseling, skills-based training, emergency residential services, and closure/ follow-up. The Department is soliciting services for all 254 counties in the state of Texas.

Offerors' Conference: An offerors' conference will be held in Austin on Thursday, February 25, 1999, at the TDPRS Winters Building, 701 W. 51st Street (51st and Lamar), lst Floor Board Room, from 10:00 a.m. until 3:00 p.m. Those entities interested in submitting a proposal or proposals for this service are encouraged to attend. At 3:00 p.m. the same day, an informational session will be held for those interested in submitting a proposal for the major urban areas of Harris, Dallas, Tarrant, Bexar, El Paso, Hidalgo, and Travis Counties.

Eligible applicants: Eligible offerors include private non-profit and for-profit corporations, cities, counties, partnerships, and individuals. Law enforcement agencies are not eligible to apply, nor are juvenile probation departments. Offers from counties must propose services and staff separate and apart from juvenile probation and juvenile justice departments. Historically underutilized businesses and minority and women-owned business enterprises are encouraged to submit proposals.

Limitations: Funding of the selected proposals will be dependent upon available federal and/or state appropriations. The Department reserves the right to reject any and all offers received in response to this RFP and to cancel this RFP if it is deemed in the best interest of the Department. If funds remain after the initial awards, TDPRS retains the right to negotiate increases in contracts with successful applicants who have indicated interest. Should successful offers exceed available funds, the Department will negotiate to achieve parity.

Terms: The effective dates of any contract awarded under this RFP would be September 1, 1999, through August 31, 2000.

Deadline: All proposals to be considered for funding through this RFP must be received by 4:00 p.m. April 26, 1999. Modifications to the original proposal are also due that date.

Evaluation and Selection: Review panels will score and rank the proposals. The evaluation criteria and method will be specified in the RFP packet.

Considerations are: need, cost, comprehensive program services, and community collaboration.

Public Notices of Interconnection Agreements

On January 28, 1999, Flashnet Telecom, Inc. and GTE Southwest, Inc., collectively referred to as applicants, filed a joint application for approval of an interconnection agreement under §252(i) of the federal Telecommunications Act of 1996, Public Law Number 104-104, 110 Statute 56, (codified as amended in scattered sections of 15 and 47 United States Code) (FTA) and the Public Utility Regulatory Act, Texas Utilities Code Annotated §§11.001-63.063 (Vernon 1998) (PURA). The joint application has been designated Docket Number 20394. The joint application and the underlying interconnection agreement are available for public inspection at the commission's offices in Austin, Texas.

The commission must act to approve the interconnection agreement within 35 days after it is submitted by the parties.

The commission finds that additional public comment should be allowed before the commission issues a final decision approving or rejecting the interconnection agreement. Any interested person may file written comments on the joint application by filing 13 copies of the comments with the commission's filing clerk. Additionally, a copy of the comments should be served on each of the applicants. The comments should specifically refer to Docket Number 20394. As a part of the comments, an interested person may request that a public hearing be conducted. The ACSEC and GHCEN desire the relief to begin a pilot project in the GHCEN 9-1-1 service area for 9-1-1 DBMS services and enable the implementation of statistical reports, quality assurance monitoring and the real-time routing of 9-1-1 calls.

South East Texas Regional Planning Commission

Request for Proposal

The South East Texas Regional Planning Commission-Metropolitan Planning Organization (SETRPC-MPO) is seeking a qualified consulting firm to assist in updating the Jefferson-Orange-Hardin Regional Transportation Study (JOHRTS) area Metropolitan Transportation Plan-2025 (MTP-2025).

The SETRPC-MPO already has a Consultant updating the socio-economic and demographic inputs for the transportation network of the JOHRTS area. Therefore, assistance performed by the Consultant in preparation of the JOHRTS MTP-2025 will focus on identifying and testing needed improvements and updates to the existing JOHRTS long-range roadway system and transportation network.

This will involve the analysis of:

(1) Currently defined and coded transportation networks used by the Texas Department of Transportation (TxDOT) for travel demand modeling purposes

(2) The most recent and available traffic forecasts prepared by TxDOT,

(3) The current transportation plan, and other appropriate plans.

Specific tasks to be completed by the consultant are stated below:

Review and Analysis of Existing Transportation Network Data, Forecasts, and Plans

The purpose of this task is to identify capacity deficient areas within the long-rage transportation network, and determine the level of required short-range and long-range system improvements. Specific activities in this task shall include:

(1) The review and analysis of all applicable plans, forecasts, policies, and data that affect transportation needs.

(2) Prepare an update of the JOHRTS MTP-2025, ensuring that it is consistent with the Transportation Efficiency Act for the 21st Century (TEA-21) requirements and local area needs.

(3) Collection of existing city thoroughfare and long-range transportation plans/comprehensive plans to identify future transportation network developments for anticipated future growth areas.

(4) Review currently defined and coded future transportation networks used by TxDOT for travel demand modeling purposes, as well as current travel forecast data and their results. Upon identification of shortcomings within the transportation networks, practical solutions shall be developed.

Recommendations of roadway projects for the JOHRTS MTP-2025 and subsequent network revisions shall then be developed. A network of highways, arterial roadways, and collector streets that serve as the JOHRTS thoroughfare plan will be identified and developed; new roadways and facilities should be considered as well as improvements and/or changes to the existing long-range network.

Develop and Test Alternative Networks

Based on recommendations developed in the previous task, new roadways and facilities as well as improvements and/or changes may be added to the JOHRTS long-range network. Using the TxDOT travel demand model (TRANPLAN), the Consultant will perform the following subtasks:

(1) Identify a range of alternative network scenarios that reflect the recommendations previously developed for incorporation into the 2025 network. These alternatives will be presented and discussed in cooperation with the SETRPC and the TxDOT to determine which scenarios will be analyzed through modeling applications.

(2)Code the recommended 2025 highway network scenarios, and run a traffic assignment for each scenario. Present and document the results of the highway alternatives analysis.

(3) Recommend a range of network scenarios, based upon new proposed transportation projects, that will provide the greatest improvement in air quality within the JOHRTS area.
