Part I. Texas State Library and Archives Commission

Chapter 2. General Policies and Procedures

Subchapter A. Principles and Procedures of the Commission

13 TAC §2.6

The Texas State Library and Archives Commission adopts new §2.6, concerning dates when advisory boards to the commission will be abolished, without changes to the proposed text as published in the June 25, 1999, issue of the Texas Register (24 TexReg 4669). Therefore, the text will not be republished.

The rule is being adopted to meet the requirements of Government Code §2110.008 that requires the commission to establish advisory boards for specified time periods.

The rule extends the life of several advisory committees until 2009.

No comments were received regarding the adoption of this rule.

The new section is adopted under Government Code §2110.008 that requires the commission to establish by a rule date on which an advisory committee will automatically be abolished and §441.006(a) which provides the Commission with authority to govern the Texas State Library and adopt rules on various subjects.

This agency hereby certifies that the adoption has been reviewed by legal counsel and found to be a valid exercise of the agency's legal authority.

Filed with the Office of the Secretary of State on August 6, 1999.

Chapter 5. County Librarian Certification

13 TAC §5.6

The Texas State Library and Archives Commission repeals §5.6 without change as published in the June 25, 1999, issue of the Texas Register (24 TexReg 4670).

The repealed section provided a penalty for persons submitting false information for county librarian certification.

The repeal reflects changes in administrative law and the determination that the rule exceeded the statutory authority given the Commission.

No comments were received concerning the repeal.

The repeal is adopted under Government Code §441.006(a) and §441.007(a), which provide the Commission with authority to govern the Texas State Library, to adopt rules on various subjects, and to adopt rules necessary to qualify county librarians.

This agency hereby certifies that the adoption has been reviewed by legal counsel and found to be a valid exercise of the agency's legal authority.

Filed with the Office of the Secretary of State on August 6, 1999.
