EMERGENCY RULES An agency may adopt a new or amended section or repeal an existing section on an emergency basis if it determines that such action is necessary for the public health, safety, or welfare of this state. The section may become effective immediately upon filing with the Texas Register, or on a stated date less than 20 days after filing and remaining in effect no more than 120 days. [Brackets] indicate deletion of existing material within a section. TITLE 40. SOCIAL SERVICES AND ASSISTANCE Part II. Texas Rehabilitation Commission Chapter 117. Special Rules and Policies 40 TAC sec.117.5 The Texas Rehabilitation Commission (TRC) adopts on an emergency basis new sec.117.5 to adopt by reference the rules of the General Services Commission concerning charges for public records. The new rule adopted on an emergency basis implements the provisions of Chapter 428, Acts, 73rd Legislature (House Bill Number 1009) with respect to the cost of providing records to the public and the charges that the TRC may set to recover the full costs of providing public records. The purpose of the emergency adoption is to comply with House Bill Number 1009. The new rule is adopted on an emergency basis under Texas Human Resource Code, sec.111.018, which provides the Texas Rehabilitation Commission with the authority to make regulations governing personnel standards, the protection of records and confidential information, the manner and form of filing applications, eligibility, investigation, and determination for rehabilitation and other services, procedures for hearings, and other regulations subject to this section as necessary to carry out the purpose of this chapter.
