EMERGENCY RULES An agency may adopt a new or amended section or repeal an existing section on an emergency basis if it determines that such action is necessary for the public health, safety, or welfare of this state. The section may become effective immediately upon filing with the Texas Register, or on a stated date less than 20 days after filing and remaining in effect no more than 120 days. Management Access to Official Records 43 TAC sec.1.503 The Texas Department of Transportation adopts on an emergency basis an amendment to sec.1.503, concerning Cost of Copies of Official Records. The amendment to sec.1.503 is also being simultaneously proposed for public comment in this issue of the Texas Register. House Bill 1009, 73rd Legislature, 1993, required each agency by rule to specify the charges the agency will make for copies of public records. Section 1.503 lists charges for copies of official department records. To comply with House Bill 1009 by adding to sec.1.503 certain charges currently imposed by the department, thereby preventing a significant disruption in service to the public, it is necessary to adopt on an emergency basis an amendment to sec.1.503 to establish charges for: title histories and title and registration verifications; Texas Highways Magazine mailing lists; and copies of records available in various nonstandard sizes and media. The amendment is adopted on an emergency basis under Texas Civil Statutes, Article 6666, which provide the Texas Transportation Commission with the authority to promulgate rules for the conduct of the work of the Texas Department of Transportation; and Government Code, Chapter 552, which provides for access to public information. sec.1.503.
