Emergency Sections An agency may adopt a new or amended section or repeal an existing section on an emergency basis if it determines that such action is necessary for the public health, safety, or welfare of this state. The section may become effective immediately upon filing with the Texas Register, or on a stated date less than 20 days after filing, for no more than 120 days. Provisions of the Real Estate License Act Fees 22 TAC sec.535.101 The Texas Real Estate Commission adopts on an emergency basis an amendment to sec.535.101, concerning fees. The amendment restates the existing fees charged by the commission and increases three fees in order to avoid a potential shortfall in the special fund from which the commission's appropriation is derived. The commission has recently experienced a significant decline in the revenue from fees paid by applicants and licensees. The commission has determined that the possibility of a shortfall in operating funds constitutes an imminent threat to the public welfare warranting adoption of the amendment on an emergency basis. The amendment increases the fee for filing an original application for a real estate broker license from $60 to $75, increases the fee for applying for a license examination from $15 to $25, and increases the fee for requesting a license due to change of sponsoring broker or change of address from $10 to $20. Broker annual renewal and original application fees are also subject to a $200 increase imposed by the 72nd Legislature in 1991. The amendment is adopted on an emergency basis under Texas Civil Statutes, Article 6573a, sec.5(h), which authorize the Texas Real Estate Commission to make and enforce all rules and regulations necessary for the performance of its duties. sec.535.101. Fees. (a)-(b) (No change.) The commission shall charge and collect the following fees: (1) a fee of $75 for the filing of an original application for a real estate broker license; (2) a fee of $36 for annual renewal of a real estate broker license; (3) a fee of $50 for the filing of an original application for a real estate salesman license; (4) a fee of $36 for annual renewal of real estate salesman license; (5) a fee of $25 for an application for a license examination; (6) a fee of $10 for filing a request for a license for each additional office or place of business; (7) a fee of $20 for filing a request for a license for a change of place of business or change of sponsoring broker; (8) a fee of $10 for filing a request to replace a license lost or destroyed; (9) a fee of $400 for filing an application for approval of a real estate education program program under Texas Civil Statutes, Article 6573a (the Act), sec.(f); (10) a fee of $200 a year for operation of a real estate education program under the Act, sec.7(f); and (11) a fee of $15 for transcript evaluation.
