1 TAC §355.781
The Health and Human Service Commission (HHSC) adopts amended §355.781,
concerning the reimbursement methodology for Rehabilitative Services, in Chapter
355, Reimbursement Rates. The amendment is adopted without changes to the
proposed text as published in the April 14, 2006, issue of the
Texas Register
(31 TexReg 3139) and will not be republished.
The amended §355.781 identifies the department (formerly the Texas
Department of Mental Health and Mental Retardation (TDMHMR) or successor agency)
as the Department of State Health Services (DSHS) and removes any references
to "TDMHMR". Also, due to the restoration of the general counseling benefit
to all Medicaid recipients, the reference to rehabilitative counseling and
psychotherapy is removed from the rule. The rule is further amended to allow
the provision of skills training in a group format to a child or adolescent.
HHSC did not receive any comments regarding the proposed rule during the
comment period.
The amendment is adopted under the Texas Government Code, §531.033,
which provides the Executive Commissioner of HHSC with broad rulemaking authority;
the Human Resources Code, §32.021, and the Texas Government Code, §531.021(a),
which provide HHSC with the authority to administer the federal medical assistance
(Medicaid) program in Texas; and the Texas Government Code, §531.021(b),
which provides HHSC with the authority to propose and adopt rules governing
the determination of Medicaid reimbursements.
This agency hereby certifies that the adoption has been reviewed
by legal counsel and found to be a valid exercise of the agency's legal authority.
