The Texas Board of Criminal Justice adopts amendments to §159.3,
concerning Continuity of Care System for Offenders with Mental Impairments/Memorandum
of Understanding, with changes to the text as proposed in the April 15, 2005,
issue of the
Texas Register
(30 TexReg 2166).
The purpose of the amendments is to clarify the Memorandum of Understanding
between the Texas Department of Criminal Justice (TDCJ), the Department of
State Health Services (DSHS), and the Community Supervision and Corrections
Departments (CSCDs) concerning a continuity of care system for offenders with
mental illness or mental retardation. The rule and the Memorandum of Understanding
(MOU) have been amended by deleting references to the local mental health/mental
retardation authorities as parties to the MOU.
No comments were received on the proposed amendments.
The amendments are adopted under Texas Government Code and Texas
Health and Safety Code, §614.013.

§159.3.Continuity of Care System for Offenders with Mental Impairments/Memorandum of Understanding.
(a)
The Texas Department of Criminal Justice (TDCJ) adopts
a memorandum of understanding (MOU) between the Texas Department of Criminal
Justice, the Department of State Health Services (DSHS), and Community Supervision
and Corrections Departments concerning a continuity of care system for offenders
with mental illness or mental retardation, as required by Texas Health and
Safety Code, §614.013.
(b)
Copies of the MOU are filed in offices of the Texas Correctional
Office on Offenders with Mental Impairments, 8610 Shoal Creek Boulevard, Austin,
Texas 78757, and may be reviewed during regular business hours.
