adopted to make §4.2(d) consistent with the current agency process for
issuing cooperative marketing association licenses. The amendment provides
that cooperative marketing association licenses expire one year from the date
of issuance or when the association is dissolved or its charter is forfeited.
No comments were received on the proposal.
The amendment to §4.2 is adopted under Texas Agriculture
Code (the Code), §12.016, which provides the department with the authority
to adopt rules as necessary for the administration of its powers and duties
under the Code, including Chapter 52, relating to cooperative marketing associations.
This agency hereby certifies that the adoption has been reviewed
by legal counsel and found to be a valid exercise of the agency's legal authority.
