22 TAC §89.1
The Texas Cosmetology Commission adopts amendments to §89.1,
concerning Schedule of fines, without changes to the proposed text as published
in the May 14, 2004, issue of the
Texas Register
(29 TexReg 4716).
The adopted amendments to §89.1(b) of the Commission's schedule of
fines adds subsection (j) to §83.14, concerning failure to sanitize Whirlpool
Footspas (each foot spa) and §1602.267, concerning Shampoo Apprentice
Permit.
The adopted amendments specify the actual civil penalties the commission
shall assess for 1st, 2nd and 3rd violations.
No comments were received regarding adoption of the amendments.
The amendments are adopted under Texas Occupations Code, Chapter
1602, §1602.151, which provides the commission with the authority to
"adopt rules consistent with this chapter," to protect the public's health
and safety.
This agency hereby certifies that the adoption has been reviewed
by legal counsel and found to be a valid exercise of the agency's legal authority.
