22 TAC §107.102
The Texas State Board of Dental Examiners (Board) adopts
amendments to §107.102, concerning procedures in conduct of investigation,
without changes to the proposed text published in the April 11, 2003, issue
of the
Texas Register
(28 TexReg 3032). The
text will not be republished. The section makes the investigatory process
more efficient and reduces the amount of staff resources required to complete
an investigation.
The amendment adds and deletes language to 22 TAC §107.102(d), (e),
(f) and (g) to clarify the review process. Specifically, language at §107.102(d)
and (e) provide that the word "undercover" be eliminated in order to include
all types of cases not just "undercover" cases. §107.102(f) and (g) provide
a more efficient process for each individual case while ensuring that proper
consideration is given to each case.
No comments were received regarding adoption of the amendment.
The amendment is adopted under Texas Government Code §2001.021
et seq; Texas Civil Statutes, the Occupations Code §254.001 which provides
the Board with the authority to adopt and enforce rules necessary for it to
perform its duties, and §255.006, General Rules Regarding Complaint Investigation
and Disposition, particularly subsection (d).
This agency hereby certifies that the adoption has been reviewed
by legal counsel and found to be a valid exercise of the agency's legal authority.
