Chapter 55. CHILD SUPPORT ENFORCEMENT

The Office of the Attorney General (OAG) adopts the repeal of 1 TAC Chapter 55, Subchapter G, Contracts and Audits, §§55.151, 55.153, 55.154, 55.155, 55.156 and 55.157, and adopts new Subchapter G, Authorized Costs and Fees in IV-D Cases, §§55.151, 55.152 and 55.153 concerning court costs, without changes to the proposed text as published in the August 9, 2002 issue of the Texas Register (27 TexReg 6923-6924) and will not be republished.

The repeal of these sections is necessary because these sections no longer reflect current law and business practices.

The new sections address County Court Costs, Billing for Costs and Monitoring and Auditing for Costs in IV-D Cases. Section 55.151 describes costs and fees in IV-D cases the court may charge the Office of the Attorney General. Section 55.152 describes the billing process. Section 55.153 describes monitoring processes by the Office of the Attorney General

No comments have been received regarding the repealed and new sections.

Subchapter G. CONTRACTS AND AUDITS

1 TAC §§55.151, 55.153 - 55.157

The repeal of these sections is adopted under Texas Family Code §231.002.

The repeal affects Texas Family Code, Chapter 110 and Chapter 231.

Subchapter G. AUTHORIZED COSTS AND FEES IN IV-D CASES

1 TAC §§55.151 - 55.153

The new rules are adopted under Texas Family Code §231.002.

The new rules affect Texas Family Code Chapter 110, §§231.202, 231.204, 231.205 and Texas Government Code §§51.317, 51.38 and 51.319.
